    The Eviction Moratorium Is Extended After President Acknowledges That is Unconstitutional.

    After acknowledging that the CDC did not have the legal authority to extend the eviction moratorium, and after Congress could not get the votes for a legislative moratorium, President Biden still directed the CDC to extend the eviction moratorium through October 3, 2021.  The CDC moratorium applies in those counties that are considered to have "high" or "substantial" community transmission levels for COVID-19.  We suspect there will be numerous lawsuits challenging the validity of the order, but property owners need to know their rights in the interim.  Join Zona Law Attorneys Scott Baluha and Mark Zinman to discuss the newest CDC eviction moratorium order.

    ASU Constitutional Law Professor Ilan Wurman joins Mark Zinman on the Zona Law Podcast to discuss the constitutional issues raised by federal and state eviction moratoriums that have been implemented over the past 15 months.  Currently, there are several federal lawsuits challenging the Center for Disease Control eviction moratorium, including one case that is being appealed to the United States Supreme Court.  Whether or not something is constitutional, implicates numerous areas of the law and legal principles.  We were lucky to have Professor Wurman join us to discuss these complicated issues.  Professor Wurman provides an excellent, in depth analysis of the issues, in an understandable and approachable manner. As of June 8, 2021, while there are cases holding the CDC unconstitutional, those rulings are stayed on appeal, and thus the CDC eviction moratorium continues to be enforced.

    Zona Law Attorneys Scott Baluha and Mark Zinman discuss recent changes in the law that affect property owners.  Most importantly, the CDC eviction moratorium has been extended through the end of June, 2021.  At the same time, Arizona Governor Ducey has lifted all mandates regarding COVID-19 in Arizona, allowing business to reopen.  However, just because the Governor’s orders have changed, doesn’t mean that things automatically return to normal.  The Governor has encouraged business to follow the CDC and other applicable guidelines.  This will affect how property managers handle operations at their communities.

    Matt Koglemeier and Mark Zinman the CDC order. A federal judge in Texas held that the CDC moratorium is unconstitutional. However, that doesn't automatically mean that it is invalid everywhere. This is a great step forward for property rights, but it's not the end of the line.
