    On this episode of Slut or Nut: The Podcast, Kelly chats with sexual assault and personal injury lawyer Simona Jellinek about what it is like to sue in a civil suit if you have been sexually assaulted or sexually abused. While victims of sexual assault often thing of going to the police to report a sexual assault, suing the person who abused or assaulted you, or suing the institution that hid or perpetuated your assault, or protected the perpetrator of the assault is also an option, and sometimes is an option that has better long term results for the survivor of the assault. Simona discusses what it is like to go through the civil suit process, things to consider, the statute of limitations in civil cases, the impacts of childhood sexual abuse, historical assault cases, liabilities, damages, and the pros and cons of suing individuals and institutions who had a role in your sexual assault. As the law around these sexual assault and sexual abuse in civil cases is constantly changing and varies significantly in different locations, we advise you to consult with a personal injury lawyer in your own area if you are considering pursuing a civil suit related to your sexual assault or related to past sexual abuse you may have experienced.     On this episode of Slut or Nut: The Podcast, Kelly chats with retired Ontario Judge, writer and teacher Marvin Zuker about his verdict and sentencing in the rape trial of R. vs Ururyar, the case featured in Slut or Nut the Diary of a Rape Trial. Zuker is also in the documentary film. Kelly asks him “Should judges be feminists?” The answer isn’t so simple. One can’t help but think that part of the process is broken. The beautiful verdict that Zuker wrote was overturned in the appeal court. The man accused of raping Mandi Gray never did community service, and he never served his 18-month sentence. He never had restrictions about being around females and drinking alcohol. Instead, he got a one-year protection order - stipulating that he would not go near Mandi Gray- also known in Canada as a Peace Bond. She could have gotten the same thing just from a stalking charge, or a harassment or trespassing charge. Not only did he not serve his sentence, but the maximum time the peace bond could be legally applied, was only for 1 year. Now that year is up. Now Mandi faces see him around the corner, in the hallways, and at the food court of her workplace, as he has also returned to work there. So I ask you, if the system is broken, which it appears it is, what now for victims of sexual assault? What now for the average person wanting to help prevent sexual assault? Changing the legal system sounds impossibly hard, but what is the alternative? Protests? Doxing? Public Shaming? Just what is the point of spending hours reporting to the police, going through a trial, having your personal details laid public, and possibly missing hours of work - just to have the person who assaulted you return to work with you a year later after the peace bond expires. And why can’t we have peace bonds that last forever? Until the other person dies? Why would you need to go through the bureaucratic headache of renewing a protective order every year? I just don’t get it….     On this episode of Slut or Nut: The Podcast, Kelly chats with Jane Doe and Mandi Gray about why judicial reform isn’t working for sexual assault survivors, why we need survivor pensions, and what not to say to your victim support worker. Mandi and Jane Doe are also featured in the documentary film- Slut or Nut: The Diary of a Rape Trial. Jane Doe cannot use her real name due to a publication ban on her name as a result of testimony in the trial of the man who sexually assaulted her and with survivor, researcher and writer Mandi Gray. You may recognize the voices of both women as they are both featured in the documentary Slut or Nut the Diary of a Rape Trial. Since the recording of this episode- Mandi Gray has been sued for speaking in support of another survivor of sexual. Sued for supporting another survivor? Sued for tweeting? Sued for supporting a friend? What? Yes. So in Vancouver writer and former University of British Columbia professor Stephen Galloway has sued twenty different women, mostly students he has never met, including Mandi for tweeting and talking about him in their pursuit of supporting their friend who alleged that Mr. Galloway sexually assaulted her while she was his student. He is suing the women for defamation of his character for their tweets and public comments surrounding the case. This lawsuit is going to trial and the women being sued, mostly students, survivors of sexual assault and activists are now facing legal costs and must hire lawyers to represent them in British Columbia, where most of them do not even live. So next time someone wonders why a woman doesn’t report. Well, you get the picture. Because if your rapist isn’t found guilty- which only 6 out of every 1,000 are... Then homeboy can just turn around and sue you. True Story.
