Joseph Sherman, formerly a bodyguard for Sean "Diddy" Combs, has filed a defamation lawsuit against Thalia Graves and her attorney, Gloria Allred. This legal action follows Graves' allegations that, in 2001, both Combs and Sherman drugged, bound, and raped her at a Bad Boy Entertainment recording studio, recording the assault and distributing it as pornography.In his lawsuit, Sherman asserts that he ceased working for Combs in 1999 and has never met Graves, labeling her claims as "utterly and entirely false." He contends that Graves contacted him in November 2023, seeking his cooperation as a witness against Combs in exchange for excluding him from legal proceedings. Sherman includes alleged messages from Graves in his lawsuit to support this claim.Sherman argues that the accusations have caused significant harm to his reputation and livelihood. The four essential elements of common law defamation are: (1) a defamatory statement, (2) the statement was "of or concerning" the plaintiff, (3) the statement was published to a third party, and (4) the plaintiff suffered damages as a result.Libel is defamation in written or other tangible form and is generally actionable without proof of special damages. Slander is spoken defamation and typically requires proof of special damages unless it falls under the category of slander per se.Actual malice is defined as knowledge that a statement was false or reckless disregard for whether it was true or false. This high standard applies to public officials and public figures in defamation claims due to First Amendment considerations.Intrusion upon seclusion occurs when a defendant intentionally intrudes upon the solitude, seclusion, or private affairs of another in a manner that would be highly offensive to a reasonable person. An example is unauthorized wiretapping of a private phone line.The key element in appropriation of name or likeness is the defendant's use of the plaintiff's name, image, or identity for a commercial purpose without the plaintiff's consent, thereby exploiting the economic value of their identity.To establish intentional interference with contractual relations, a plaintiff must show: (1) a valid contract, (2) the defendant's knowledge of the contract, (3) the defendant's intentional acts to induce a breach or interfere with the contract, (4) an actual breach or disruption, and (5) resulting damages."Scope of employment" refers to activities that an employee is hired to perform, occur substantially within the authorized time and space limits of their job, and are motivated, at least in part, by a purpose to serve the employer.One exception to the rule that employers are not liable for independent contractors' torts is when the activity involved is inherently dangerous, meaning it poses a significant risk of harm that cannot be eliminated by reasonable care.The single publication rule states that all copies of a publication are treated as a single publication for the purposes of a defamation action, limiting the number of lawsuits that can arise from widespread dissemination of the same defamatory material.When a private individual sues for defamation involving a matter of public concern, they must generally show at least negligence on the part of the defendant. To recover presumed or punitive damages, they typically must demonstrate actual malice.

Today I'm announcing a major multi-million dollar defamation lawsuit against @Meta, the owner of @Facebook & @Instagram.The case is WILD and has implications for ALL OF US. On top of falsely calling me a criminal, Meta suggested my kids be taken from me.Watch for the full story but here's a summary:This all started with Meta's AI falsely claiming that I was charged with a crime from January 6th but… I wasn't even in DC that day (I was in TN) and I've never been charged with a crime IN MY LIFE.We found this out in August of 2024 when I was exposing woke policies at Harley Davidson. One dealership was unhappy with me and they posted a screenshot from Meta's AI in an effort to attack me. This screenshot was filled with lies. I couldn't believe it was real so I checked myself. I've never met him and this is all false.• Meta's AI claims I've engaged in Holocaust denial. I've NEVER denied the Holocaust.• Meta's AI tells advertisers NOT to advertise with me because of the lies it invented.• Meta tells employers NOT to hire me because of the lies it invented.• Meta suggested that MY KIDS BE TAKEN FROM ME because it would be better for them to be raised by someone more friendly to DEI and transgenderism.• Meta's ironically claimed that I've been sued for DEFAMATION and EMOTIONAL DISTRESS. I've never been sued for either.I've tried to fix this privately since last year. Instead of fixing this and instituting safeguards, Meta has given us the runaround.Meta later BLACKLISTED my name from being searched (insane) but it didn't end the defamation because Meta includes my name in news stories. You can then ask for more info about me. If you do that, Meta goes back to defaming me. In fact, the lies this week are the worst yet!Meta's AI admits that a false accusation over J6 is extremely harmful to whoever is accused.
