Members of the Seanad are being warned that they must amend the Defamation Bill coming before them this week, as the legislation in its present form won't do enough to protect small businesses from “vexatious” defamation claims. That is the view of the Alliance for Insurance Reform, which says a large volume of these claims affect local retailers, corner shops, and businesses in the tourism and hospitality sectors. ISME – the Irish Small and Medium Enterprises Association – is also warning Senators that they have a “last chance” to reform defamation law. To discuss this further, Alan Morrissey was joined by Brian Hanley, CEO Alliance for Insurance Reform and Crystel Robbins Rynne, HR Locker CEO. Picture (c) Oireachtas.ie

Our special guest today is Scottish author and social researcher David F Porteous, and we cover a lot of different topics. In this episode we talk about K-pop and plate tectonics, the naming of cats, Oasis and AC/DC, the trickiness of venomous snakes and drug-addled spiders, Donald Trump's visit to the UK, defamation, the nature of community, Nepal's Gen Z protests — and we even get our Barlows confused. This episode was recorded back on Friday 19 September, which explains some of the date references.Full podcast details and credits at:https://the9pmedict.com/edict/00253/Please consider supporting the podcast:https://the9pmedict.com/tip/https://skank.com.au/subscribe/

A federal judge has tossed Donald Trump's $15 billion defamation lawsuit against The New York Times and Penguin Random House. Judge Steven D. In a four-page court order that is one for the ages, Judge Steven Merryday "struck" for the record Donald Trump's complaint that he filed in his absurd $15 billion defamation suit against The New York Times.Judge Merryday, appointed to the federal bench by President George H.W. Bush. eviscerates Trump's legal filing, saying it does not comport with the Rules of Civil Procedure. The judge notes: "The reader must endure an allegation of 'the desperate need to defame with a partisan spear rather than report with an authentic looking glass' and an allegation that 'the false narrative about 'The Apprentice' was just the tip of Defendants' melting iceberg of falsehoods.' Similarly, in one of many, often repetitive, and laudatory (toward President Trump) but superfluous allegations, the pleader states, 'The Apprentice' represented the cultural magnitude of President Trump's singular brilliance...'"So, yeah, the judge threw out the blathering, bloviating, nonsensical pleading, and gave Trump's lawyers 28 days to try to do it right, in accordance with the rules of procedure. For nightly live Law Talks, please join Glenn on Substack: glennkirschner.substack.comIf you're interested in supporting our all-volunteer efforts, you can become a Team Justice patron at: / glennkirschner If you'd like to support Glenn and buy Team Justice and Justice Matters merchandise visit:https://shop.spreadshirt.com/glennkir...Check out Glenn's website at https://glennkirschner.com/Follow Glenn on:Threads: https://www.threads.net/glennkirschner2Facebook: https://www.facebook.com/glennkirschner2Instagram: https://www.instagram.com/glennkirsch...Bluesky: https://bsky.app/profile/glennkirschn...TikTok: https://www.tiktok.com/glennkirschner2See Privacy Policy at https://art19.com/privacy and California Privacy Notice at https://art19.com/privacy#do-not-sell-my-info.

EASY LISTENING DEP'T.: The administration may have accused Venezuelan cartels of bringing fentanyl into the United States, but the New York Times has reported that Venezuela plays essentially no role in the fentanyl trade. The story does return to the fact that there is no legal basis for these killings, but it mostly slides past the fact that the extralegal basis doesn't hold up either. Mostly though, the question is when an unrepentant killer racks up new victims, does that make the overall story smaller or bigger? Is the Times here to tell us the story of an out-of-control killing spree or the story of business as usual? Please visit, read, and support INDIGNITY! https://www.indignity.net/

Alan Dershowitz's comments about potentially suing Michael Cohen over statements linking him to Jeffrey Epstein reflected a defensive legal strategy aimed at protecting his reputation. Dershowitz has consistently denied any wrongdoing in connection to Epstein and framed Cohen's remarks as defamatory. By raising the prospect of a lawsuit, he positioned himself as someone seeking to challenge those statements through formal legal channels rather than allowing them to circulate unchecked. His response was characteristic of a high-profile attorney using the law as a means of addressing reputational harm in a public dispute. From a broader perspective, the episode illustrates how litigation is often employed by prominent figures facing reputational challenges tied to controversial associations. Defamation law allows individuals to pursue damages if false and harmful claims are made against them, though such cases also raise complex questions about free speech and public discourse. Dershowitz's stance toward Cohen underscored the tension between preserving one's reputation and navigating the fallout of being connected—directly or indirectly—to Epstein. In this sense, the situation was less about uncovering new facts regarding Epstein and more about the legal and rhetorical strategies used by those whose names surface in his orbit.(commercia at 7:36)to contact me:bobbycapucci@protonmail.comsource:Alan Dershowitz Says He's Suing Michael Cohen Over Epstein Claims (thedailybeast.com)

Kinsella on Liberty Podcast: Episode 470. From my appearance on the Ayn Rand Fan Club with Scott Schiff and William. Their Shownotes: Patent attorney, Libertarian & Ayn Rand fan Stephan Kinsella joins William & Scott to talk about his history in the liberty world and his unique view that property rights should only pertain to physical things, and not to intellectual property. The conversation delves into Kinsella's journey from Objectivism to anarcho-capitalism, his critical stance on intellectual property (IP), and his broader views on libertarian principles. Recorded on August 18, 2025, the episode explores the philosophical and practical implications of IP laws, their impact on innovation, and their compatibility with property rights, while also touching on contemporary libertarian movements. Stephan Kinsella's Background and Philosophical Evolution Kinsella shares his personal journey, starting with his introduction to Ayn Rand's The Fountainhead in high school, which sparked his interest in Objectivism. Initially a “hardcore Objectivist” for eight years, he later gravitated toward Austrian economics and anarcho-capitalism, influenced by thinkers like Ludwig von Mises and Murray Rothbard. As a patent attorney in Houston, Texas, Kinsella began questioning the validity of IP laws in the early 1990s, finding existing justifications—whether utilitarian or Objectivist—unsatisfactory. His career as a patent lawyer, paradoxically, coincided with his growing opposition to the patent and copyright system, which he argues violates fundamental property rights. Critique of Intellectual Property Kinsella's primary critique of IP centers on its violation of tangible property rights. He argues that patents and copyrights impose non-consensual restrictions, or “negative servitudes,” on how individuals can use their own property, such as a printing press or factory. Drawing from libertarian principles, he contends that property rights should stem from homesteading or contract, not state-granted monopolies. Kinsella rejects both utilitarian arguments (e.g., IP promotes innovation) and natural rights arguments (e.g., creators inherently own their ideas), asserting that there's no empirical evidence for underproduction of creative works without IP and that the concept of owning labor or ideas is flawed, rooted in a misinterpretation of John Locke's labor theory. Trademark, Defamation, and Reputation Rights The discussion extends to trademark and defamation laws, which Kinsella also opposes. He explains that trademark law, originally intended to prevent consumer fraud, has evolved into a “reputation right” that protects brands like Rolex or Chanel from dilution, even absent deception. He argues that fraud laws already suffice to address deceptive practices, rendering trademark law unnecessary. Similarly, Kinsella rejects defamation laws, asserting there's no property right in one's reputation, as it's merely others' opinions. He distinguishes incitement to violence as a separate issue,
