Wright begins by describing the history and politics of race-conscious admissions. President Trump stated in a tweet over the weekend that he fired General Michael Flynn as National Security adviser for lying to Vice President Mike Pence and the FBI. The tweet set off a storm in the media as pundits talked about the issue of what the president knew and when he knew it. Does that build the foundations for an obstruction of justice case? Andrew McCarthy, a contributing editor to National Review and a former top federal prosecutor, weighs in on the potential strength of an obstruction case. He also discussed his calls to end non-disclosure agreements that help shield sexual harassers in Congress. Professor Andy Wright of Savannah Law School gives Rick Ungar and guest co-host Rick Tyler a different view on how a possible obstruction case would play out.

Duration: 32:18 In this episode of Unprecedented, we talk with Cogan Schneier, a reporter for The National Law Journal who wrote about the groundbreaking privacy and civil rights lawsuit when it was filed last week. “While the lawsuit doesn’t have any smoking gun … if it were to make it past the initial stages and say go into discovery, there would be a lot of interesting information that would likely come out of that,” Schneier says.  We also hear from Andrew Wright, an attorney in the Obama White House who’s now a law professor at Savannah Law School and a contributor to the legal news blog Just Security. Wright puts the case in its historical context — stretching back to the Watergate break-in — and talks about some of the hurdles it will likely face in court.
