Send us a textEric Pence is a guest I actually wanted to chat with a couple of years ago, but it is even better that it is occurring now because this summer he completed the Leadville Trail 100 for the 30th time, becoming just the second person to do so, after the legendary Bill Finkbeiner. Eric and I go back to the early 1990s days of the race, so we have lots of stories to share about that pioneering era, quite a few unique race memories, and the changes we have seen over the years. Eric discusses what has kept him going all of these decades, especially the support from his close and extended families, including his wife Anne, who has written a LT100 crewing guide, and his son Ethan, who has become an ultramarathoner himself. Discussion about his family certainly wouldn't be complete without talking about his sister Pam, to whom he donated a kidney several years ago, and who is married to legendary Mark Macy of adventure running fame. This Day in Legal History: Fugitive Slave ActOn September 18, 1850, President Millard Fillmore signed the Fugitive Slave Act into law, intensifying the national divide over slavery. As part of the Compromise of 1850, the law mandated that all escaped enslaved individuals, upon capture, be returned to their enslavers and that officials and citizens of free states were legally obligated to cooperate. Federal commissioners were authorized to issue arrest warrants without a jury trial, and those accused had no right to testify in their own defense.The law also imposed heavy penalties on anyone aiding a fugitive, including fines and imprisonment, which provoked outrage among abolitionists and free Black communities. The act effectively nationalized the institution of slavery, forcing even anti-slavery states to participate in its enforcement. This led to dramatic and sometimes violent resistance, including the formation of vigilance committees and the expansion of the Underground Railroad.Free Black Americans faced new dangers under the law, as it encouraged bounty hunters and unscrupulous officials to seize and enslave them under false pretenses. Several high-profile cases, such as the capture of Anthony Burns in Boston in 1854, drew mass protests and highlighted the law's harsh impact. The Fugitive Slave Act deepened sectional tensions and hardened Northern opposition to slavery, pushing the nation closer to civil war.A Chapter 7 trustee for the bankrupt fintech startup GloriFi has filed a $1.7 billion malpractice lawsuit against law firm Winston & Strawn and its Houston managing partner, Michael Blankenship. The suit alleges the firm prioritized the interests of GloriFi's founder, Texas oil investor Toby Neugebauer, over the company's, ultimately contributing to its collapse. GloriFi—formally known as With Purpose Inc.—marketed itself as an “anti-woke” financial institution aimed at conservative consumers. The complaint claims Winston & Strawn enabled Neugebauer to engage in self-dealing, manipulate board control, and undermine corporate governance, deterring major investors and derailing a proposed SPAC merger that once valued the company at $1.7 billion.The trustee accuses the firm of negligence, fiduciary breaches, and aiding fraudulent transfers, alleging its conduct drove investor confidence down and played a key role in the company's failure. Winston & Strawn denies wrongdoing and promises to contest the "meritless claims." The legal action follows a court-approved settlement earlier this year that allowed GloriFi's trustee to pursue claims via a separate entity tied to one of the investors. This is one of multiple legal efforts by the trustee, who previously sued Chapman & Cutler LLP over similar allegations related to Neugebauer's control of the company. High-profile backers of GloriFi included Peter Thiel, Ken Griffin, Vivek Ramaswamy, and an aide to former Vice President Mike Pence.Winston & Strawn Sued in ‘Anti-Woke' Bank Startup Bankruptcy (1)A U.S. immigration judge ordered the deportation of Mahmoud Khalil, a Palestinian-American activist and Columbia University student, to either Algeria or Syria. The ruling is based on allegations that Khalil intentionally misrepresented facts on his green card application. Khalil's legal team disputes the decision and plans to appeal, citing a separate federal court order that currently prevents his detention or deportation while his civil rights case proceeds.Khalil, a lawful permanent resident, was previously held for over 100 days by immigration authorities and missed the birth of his child while in custody. He was released in June after a federal judge criticized his prolonged detention over a civil immigration issue as unconstitutional. Khalil claims the government's efforts to remove him are retaliatory, tied to his outspoken pro-Palestinian activism and free speech. The world of Donald Trump's legal battles has shifted yet again over these past few days, with courtrooms buzzing from Atlanta to Washington, D.C. and even all the way up to the U.S. Supreme Court. Let me walk you through what's unfolded, because the headlines haven't stopped and the stakes keep rising.Just last week, Trump claimed victory after a court threw out a massive civil fraud penalty that was hanging over him. That multimillion-dollar judgment stemmed from years of litigation around alleged financial misstatements in his business empire. While Trump declared this a vindication, things remain anything but quiet. There are still plenty of legal clouds on the horizon—especially when it comes to criminal charges tied to the 2020 election.Let's zoom in on the federal election obstruction case, one of the country's most closely watched trials. Jack Smith—the special counsel with the Department of Justice—charged Trump with conspiracy to overturn his loss to Joe Biden. This all ties back to the January 6th Capitol riot, and the allegation is that Trump spread lies about election fraud to pressure state officials and even tried to get then-Vice President Mike Pence to reject the results. Trump pleaded not guilty, but the case became tangled in questions about presidential immunity. The D.C. Circuit Court of Appeals ruled in early 2024 that Trump wasn't immune. He pushed it up to the Supreme Court, which decided in July 2024 that former presidents do have some immunity for their official acts, but not everything.Things took another twist when Jack Smith filed an updated indictment last August, only to later drop the charges in November after Trump won reelection—in part because as a sitting president, he'd be immune from prosecution on at least some charges. By January of this year, Smith issued a detailed report saying there was enough evidence to convict, but action has stalled.Meanwhile in Georgia, the election interference case has been bogged down by drama surrounding Fulton County District Attorney Fani Willis—her personal relationship with a special prosecutor even led to her removal by a state appeals court last December. While Georgia's Supreme Court still has to decide if it'll take up an appeal on her removal, six counts have already been thrown out, and Trump still faces ten counts there. Whether that case goes forward during his presidency is completely up in the air.But Trump's legal teams aren't just fighting on criminal fronts. As of yesterday, the Trump administration jumped back into the Supreme Court ring, appealing a federal judge's order demanding that billions in foreign aid be paid out—foreign aid that was frozen by Trump's executive order back in January. Solicitor General John Sauer warned that if the court doesn't intervene, Trump's government will have no choice but to quickly spend billions they want to keep frozen under a review led by Secretary of State Marco Rubio.That is the whirlwind—the cases are overlapping, the legal arguments are novel, and with Trump back in the White House, every trial is a political earthquake.
