This Day in Legal History: Plessy v. FergusonOn May 18, 1896, the U.S. Supreme Court decided Plessy v. Ferguson, a case that became one of the most infamous constitutional decisions in American history. The dispute arose from a Louisiana law requiring separate railroad cars for Black and white passengers. Homer Plessy, who was of mixed race, deliberately sat in a whites-only rail car to challenge the law. After he was arrested, Plessy argued that the statute violated the Thirteenth and Fourteenth Amendments. The Supreme Court rejected that argument and held that racial segregation did not violate the Constitution as long as the separate facilities were considered equal. This became known as the “separate but equal” doctrine.In practice, the doctrine gave legal cover to segregation across the South and helped support the broader Jim Crow system. The Court treated segregation as a matter of public policy rather than as a badge of racial inferiority imposed by law. Justice Henry Billings Brown wrote the majority opinion, reasoning that enforced separation did not necessarily imply inequality. Justice John Marshall Harlan dissented, warning that the Constitution should be color-blind and that the ruling would become as harmful as the Court's decision in Dred Scott. His dissent later became one of the most important statements in American civil-rights law. For nearly six decades, Plessy allowed governments to maintain racially separate schools, transportation, and public facilities.The decision was finally undermined in 1954, when the Supreme Court decided Brown v. Board of Education and rejected segregation in public education. Plessy remains a stark example of how constitutional interpretation can either protect civil rights or help entrench systems of inequality.A proposed class action filed in Washington federal court accuses Amazon of keeping money it allegedly collected from customers through prices inflated by now-invalidated Trump administration tariffs. The plaintiffs say Amazon could seek refunds from the federal government after the U.S. Supreme Court struck down the tariffs, but has refused to do so because it wants to stay in President Trump's good graces. The lawsuit claims Amazon passed tariff costs on to shoppers, then failed to commit to returning that money even though other retailers have allegedly pursued refunds. The customers point to Amazon's abandoned plan to show tariff-related price increases on product pages as evidence that the company can identify both the tariff amounts and the consumers who paid them. They also claim Amazon backed away from that plan after criticism from the Trump administration and a call involving Amazon CEO Jeff Bezos.The complaint alleges violations of the Washington Consumer Protection Act, unjust enrichment, and money had and received. The plaintiffs say Amazon misled consumers by suggesting tariffs were not increasing prices, while allegedly raising prices on certain low-cost goods after the tariffs took effect. They also argue Amazon failed to tell customers it would not seek tariff refunds even if the tariffs were later found unlawful. The proposed class would include Amazon customers who paid tariff-related surcharges from February 4, 2025, through February 20, 2026. The suit estimates the class could include tens of millions of buyers and seeks to recover money the plaintiffs say belongs to consumers. Similar lawsuits have been filed against other major companies, including Nike, Sony, Nintendo, Costco, Temu, and FedEx.Amazon Skipped Tariff Refunds To Appease Trump, Suit Says - Law360The Federal Circuit held its biennial judicial conference in Washington, D.C., bringing together its active judges, agency leaders, district judges who have recently sat by designation, Chief Justice John Roberts, and Solicitor General D. John Sauer. Chief Judge Kimberly Ann Moore opened the event with lighter moments, including praise for Senior Judge Raymond C. Clevenger and the debut of an AI-generated Federal Circuit theme song meant to make the court feel more accessible. The conference did not address the ongoing suspension of Judge Pauline Newman, although she attended the event while continuing to challenge the suspension at the Supreme Court. Judge Moore said the court issued 630 opinions in 2025, its highest total in a decade, and noted an effort to use fewer one-line Rule 36 affirmances. Still, court leaders and practitioners criticized Rule 36 decisions, especially because they give lower courts and litigants little explanation.The judges also discussed en banc arguments, emphasizing that lawyers must stay focused because full-court arguments leave little time for extended exchanges with any one judge. A major theme was the renewed use of district judges sitting by designation, with 23 visiting judges helping decide nearly 200 cases since February 2024. Visiting district judges said the experience gave them a new appreciation for appellate work, the quality of Federal Circuit advocacy, and the process of narrowing trial records into appealable issues. Federal Circuit judges also described sitting on other courts, including in criminal sentencing matters, which several said gave them a deeper appreciation for the workload and human stakes faced by district judges. The judges offered practical advice to lawyers, urging them to narrow issues, address weaknesses directly, provide full context for citations, and make appropriate concessions. USPTO Director John Squires also appeared and defended his approach to discretionary denials of inter partes review petitions, saying he is returning the process to what Congress intended under the America Invents Act.Fed. Drops A Theme Song, Talks Guest Judges - Law360President Donald Trump has dropped his $10 billion lawsuit against the IRS and Treasury Department, a move linked to discussions about creating a $1.8 billion compensation fund for people who claim they were unfairly investigated by prior administrations. The court filing did not describe any settlement, but Trump's lawyers said the case was still early enough that he could dismiss it without court permission or IRS approval.The dismissal was filed “with prejudice,” meaning Trump cannot bring the same claim again. Trump and his sons filed the lawsuit in January, accusing the IRS of failing to protect confidential tax information after his tax records were leaked. A former IRS contractor, Charles Littlejohn, was sentenced to prison for leaking Trump's tax information as well as records belonging to many others. Trump brought the case as a private citizen, not in his official role as president. The federal judge overseeing the case had already questioned whether a sitting president could properly seek personal monetary damages from an agency inside the executive branch.The dismissal follows settlements in lawsuits brought by Trump allies, including Michael Flynn and Carter Page. On our political radar this week… Pam Bondi joins Meat Loaf, Joan Rivers, Dennis Rodman, Sinbad, Dionne Warwick, Andrew Dice Clay, Omarosa … and Kristi Noem: “You’re fired!” VIDEO: Bye Bye Bondi (A Tribute) Senator Elissa Slotkin – speaking in Iowa – confirms what we've been saying for weeks: she's open to running for President. Two more special elections this week, two more sharp turns to Democrats: –In Wisconsin, liberal candidate Chris Taylor cruised to an easy victory over her conservative opponent in the state Supreme Court race with 60 percent of the vote, expanding the liberal majority on the court to 5-2. – Georgia, Democrat Shawn Harris lost by about 12 percentage points in the race to replace Marjorie Taylor Green, but he shifted the district 25 points to the left. Trump won the district by 37 percentage points in 2024. A national Republican group said Monday it's dumping $45 million into Michigan's open U.S. Senate race as an initial investment to help presumptive GOP nominee Mike Rogers flip the seat from Democratic control. The operative word is “initial”, meaning even more millions will flow into Michigan Republican sources. Trump is calling on Congress to give Pete Hegseth a staggering $1.7-trillion dollars over the next year. To fund it, Trump wants to cut virtually every other federal program including a 23% cut for NASA even as four astronauts take a first-ever-for-humans trip to the far side of the moon. One item calling for a major increase: White House repairs and renovations. Trump wants to spend 377-million dollars on fixing up the place, an 860 percent increase. Two more major league grifts from Trump: –The Justice Department has settled for roughly $1.2 million a lawsuit from Michael Flynn, the former national security adviser to President Donald Trump who pleaded guilty during Trump’s first term to lying to the FBI about his conversations with a top Russian diplomat and was later pardoned. Bottom line: if Trump likes you, taxpayers will pay you to lie to the FBI. –Semafor is reporting that Trump has directed the State Department to send $1.25 billion – without any Congressional appropriation or authorization to do so – to Trump's Board of Peace. The transfer effectively places the money directly in the hands of Trump, the board’s chairman. Trump and the board’s executives control funding for the Board of Peace — and Trump selects the executive board — and the president will continue to do so even after his second term ends in January 2029. In the race for Governor – John James is ducking still another candidate debate, this one set for the end of the month in vote-rich Oakland County. James has seen his once overwhelming lead for the GOP gubernatorial nomination shrink as septuagenarian Perry “Quality Guru” Johnson dumps millions into an effort to spend his way into office. Governor Whitmer says she will not endorse a candidate for U.S. Senate or Secretary of State. She earlier ruled out an endorsement in the race for the gubernatorial nomination. It's pretty easy for Democrats to be critics of Donald Trump, his policies and his corruption. More important to most people is answering the question: “so what are you going to do?” State House Democrats have answered, releasing their Vision for a Brighter Michigan. We're joined by House Democratic Leader Ranjeev Puri who led development of the plan. The son of Indian immigrants, Leader Puri made history in 2020 as the first person of color to represent his Canton Michigan district and the first Sikh-American in Michigan's legislative history. In his second term he served as majority whip, making him the highest-ranking South Asian in state government nationwide. Remarkably, he is one of two first-generation Indian-Americans in top legislative leadership: Senate Majority Floor Leader Sam Singh is also the son of Indian immigrants. Israel killed Iran's navy commander — the architect of the Strait of Hormuz blockade. And the USPS announced a 7% fuel surcharge on packages, citing the Iran war. The cost of this conflict is now literally showing up in your shipping rates. In wannabe king news, Trump announced he'd sign an executive order to pay TSA workers — something he could have done at any point instead of using their paychecks as leverage. He's also eyeing the White House Treaty Room as a potential bedroom. And his signature will begin appearing on U.S. currency in June, ending a 165-year tradition, to mark America's 250th birthday. At CPAC, Deputy AG Todd Blanche boasted that Kash Patel has purged everyone involved in Trump's prosecution from the FBI, endorsed the view that all executive branch employees work directly for Trump, and floated having ICE agents show up at polling locations on Election Day. The DOJ settled with Michael Flynn for $1.25 million — for the crimes he pleaded guilty to — while the Miami Herald reported that bags of shredded documents were found outside the jail where Epstein died days after his death, the FBI closed the inquiry and an anonymous letter to a federal judge alleged a coverup. The DOJ also issued two new criminal referrals against New York AG Letitia James, this time for homeowners insurance fraud, based largely on social media posts from a Trump ally. In a major escalation, Iran's Supreme Leader Ali Khamenei and former President Mahmoud Ahmadinejad were reported killed, along with dozens of senior officials. Iran then closed the Strait of Hormuz, which carries about 20% of global oil supply. Oil prices are projected to jump roughly 9% as markets reopen. Members of Congress from both parties are now pushing for a War Powers Act vote, noting they were not consulted before the strikes began. At the Pentagon, AI drama escalated. A stateless vessel has no right to the protections normally afforded to ships under a national flag, including immunity from interference by other states. UNCLOS Articles 92, 94, 110, and customary maritime law spell out the consequences clearly: 1. Stateless vessels have no sovereign protection. A flagged ship is an extension of its flag-state's sovereignty. A stateless vessel is not. This matters because “war crimes” presuppose protected persons or protected property. A stateless vessel is legally unprotected. 2. Any state may stop, board, search, seize, or disable, a stateless vessel. UNCLOS Article 110 explicitly authorizes boarding and seizure. The law does not require states to risk their own personnel or assets while doing so. Disabling a vessel that refuses inspection, including firing on it, is legally permitted under both UNCLOS and long-established state practice. 3. War crimes require an armed conflict. You cannot commit a “war crime” outside an armed conflict. War crimes occur only within the context of international humanitarian law (IHL). Enforcing maritime law against a stateless vessel is a law enforcement action, not an IHL situation. No armed conflict = no war crime possible. 4. Lethal force may be used when a vessel refuses lawful orders. The International Maritime Organization's “Use of Force” guidance for maritime interdiction recognizes that disabling fire, even lethal force, is lawful when a vessel refuses lawful boarding, attempts to flee, poses a threat, or engages in illicit activities such as piracy or narcotics trafficking. Once again: law enforcement rules apply, not IHL. 5. Sinking a stateless vessel is not prohibited by UNCLOS. UNCLOS permits seizure of a stateless vessel and leaves the means entirely to the enforcing state so long as necessity and proportionality are respected. If the vessel flees, attacks, or refuses lawful commands, sinking it is legally permissible. Many states routinely do this to drug-smuggling vessels (e.g., semi-submersibles) without it ever being treated as a war crime. 6. No flag = no jurisdictional shield. The entire reason international law requires ships to fly a flag is to prevent this exact situation. Flagless vessels are legally vulnerable by design. Because a stateless vessel has no protected status, because UNCLOS authorizes interdiction of such vessels, because lethal force may be used in maritime law enforcement when necessary, and because war crimes require an armed conflict that is not present here, sinking an unflagged ship in international waters is not a war crime. Ballantine also provided altered documents to Sidney Powell, and submitted an FBI interview report with redactions to information that was crucial to the case, according to En-Wikipedia.  When the US government threw out the case against  General Flynn, Ballantine declined to sign the motion to dismiss the charges against him.
