University of Iowa law professor Derek Muller joins Cases and Controversies to review the May 16 decision striking down another provision of the Bipartisan Campaign Reform Act. Muller explains how the issue of campaign finance splits the justices along ideological lines and what future challenges might come before the conservative-majority court. NCLA Files Amicus in Sen. Cruz Campaign Lawsuit Mark explains the standing issue that led NCLA to file a SCOTUS amicus brief in FEC v. Cruz. FEC is urging the Supreme Court to adopt a new, heightened standard for establishing that an injury is “fairly traceable” to complained-of conduct, a showing required of all plaintiffs in order to establish their standing to sue. Adopting FEC's theory of standing would significantly restrict judicial challenges to all kinds of unlawful federal government action.  The Clean Air Act and the Constitution Disallow EPA's Power Grab NCLA filed an amicus brief with the U.S. Supreme Court this week in West Virginia v. EPA, supporting the Petitioner States' challenge against giving EPA vast power over entire economic sectors through a misreading of the Clean Air Act (CAA). NCLA argues that the judgment of the U.S. Court of Appeals for the D.C. Circuit should be reversed. The Constitution vests all legislative power in Congress. This means that national policy decisions are to be made by Congress, not by administrative agencies. The decarbonization of the energy industry—which the decision below authorizes EPA to impose—is a major national policy decision that Congress has not expressly made. With Jennifer Kerns, Beltway Correspondent, we puzzle over Cruz' alarming response to the Trump Rally cancellation, and we also review two new Cruz Campaign hires: One being consummate insider Neil Bush, and the other an individual with a very disappointing record on immigration issues. We further analyze the skillful propaganda campaign now being waged against frontrunner Trump -- possibly connected to the off-record portions of the recent GOP Establishment gathering at Sea Island, Georgia? Also, we lament the decline of the once noble National Review, wherein writer Kevin Williamson states that white, working class, Trump-supporting communities "deserve to die." On July 31, 2012, he defeated Lieutenant Governor David Dewhurst in the Republican primary runoff, 57%–43%. Cruz defeated former state Representative Paul Sadler in the general election on November 6, 2012. He won 56%–41% over Sadler.
