The EPA released the final Affordable Clean Energy (ACE) Rule in June 2019. The ACE Rule replaces the 2015 Clean Power Plan and establishes emissions guidelines for states to utilize when crafting plans to limit carbon dioxide at existing coal-fired power plants. Our panelists will discuss how the ACE Rule differs from the Clean Power Plan in terms of statutory construction, delegation of authority and flexibility to the states. Discussion will include anticipated legal challenges as well as judicial review timelines.Featuring: Michael J. Nasi, Partner, Jackson Walker (Austin)Thomas A. The ZeroNetFifty podcast will return with a second season in August.
Host Daniel Raimi talks with RFF Research Associate Amelia Keyes about her recent research on the Trump administration's Affordable Clean Energy (ACE) rule. Amelia and several colleagues have estimated the effect of the rule on emissions of carbon dioxide, sulfur dioxide, and nitrous oxide, finding that ACE could actually increase these emissions rather than reduce them. The debates on bulk-power system reliability, resiliency, and the “federal fuel wars” continue at the Federal Energy Regulatory Commission (or FERC) and the North American Electric Reliability Corporation (or NERC). While the Trump Administration’s Affordable Clean Energy (ACE) rule proposal is getting the headlines, the more behind-the-scenes efforts underway at FERC and NERC continue to shape federal energy policy, energy markets and grid planning. In this episode of Grid Geeks I talk with Ric O’Connell, the Executive Director of Grid Lab, and Mark Ahlstrom, President of the Energy Systems Integration Group, to get the latest updates from the frontlines clean energy policy, including expanding the role of energy storage on the grid, integrating “resilience” into energy markets, and updating NERC reliability standards. Acting EPA Administrator Andrew Wheeler talked about touring Kentucky with Andy Barr, the Affordable Clean Energy (ACE) rule and possible resistance to it, coal and its future in the Commonwealth and beyond, single-use straws, and more.
