RUU TPKS Bukan Solusi Kekerasan Seksual Oleh. Sri Retno Ningrum (Penulis Ideologis) Voice over talent: Giriyani NarasiPost.Com-Kasus pemerkosaan yang dilakukan oleh seorang guru di Bandung bernama Herry Wirawan terhadap belasan orang santrinya membuat wakil ketua komisi III DPR RI Ahmad Sahroni mengaku geram. Sahroni pun mendesak agar pelaku dihukum seberat-beratnya dan para korban diberikan konseling yang tentunya sangat dibutuhkan. Lebih jauh lagi, Sahroni sangat antusias dengan draf Rancangan Undang-Undang tentang Tindak Pidana Kekerasan Seksual (RUU TPKS) yang dibawa ke paripurna DPR kemudian dibahas bersama DPR dan Pemerintah (Sindonews.10/12/2021). Di sisi lain, banyak organisasi Islam yang berada dalam naungan Majelis Ormas Islam (MOI) meminta agar DPR tidak terburu-buru mengesahkan RUU tersebut, sebab masih ada beberapa hal yang kontroversial. Selain itu, MOI masih mempersoalkan Permendikbudristek Nomor 30 Tahun 2021 karena masih menggunakan paradigma sexual consent dan relasi gender. Dalam paradigma itu, yang dipersoalkan dalam kasus seksual hanyalah yang dilakukan tanpa persetujuan para pelakunya. Sehingga jika dilakukan suka sama suka, maka tidak perlu dipersoalkan (Hidayatullah.com 9/12/2021). Apabila kita mengamati RUU TPKS ternyata ada pihak yang menginginkan RUU itu segera disahkan menjadi UU TPKS, Namun di sisi lain ada pihak yang meminta agar pemerintah tidak terburu-buru untuk mengesahkan RUU TPKS. Tentu tak bisa dimungkiri bahwa RUU TPKS masih ada diksi yang tetap dipertahankan, seperti: kekerasan seksual, secara paksa, keinginan seksual, pemaksaan hubungan seksual, dan pemaksaan menggunakan alat kontrasepsi. Sebagaimana pasal 1, 4, 5, 6, 7, dan 8. Apabila kita simpulkan bahwa jika aktivitas seksual dilakukan tanpa paksaan dan didasari oleh rasa suka sama suka, maka tidak masalah meskipun jika aktivitas seksual dilakukan kedua belah pihak belum menikah. Maka jelas dari konten yang terdapat dalam pasal tersebut telah melegalkan perbuatan zina. Padahal, bukankah Allah Swt. telah melarang perbuatan zina?
