On today's show, Bob covers two types of court actions affecting trust planning. The “Heggstad” petition under Probate Code Section 850 may be used to gather in property owned by someone at death to turn it over to their trust without going through the entire Probate court process. A trust modification petition under Probate Code Section 15403 permits the modification or even termination of an irrevocable (unchangeable) trust through the court. Bob handles both types of petitions for his own clients and often the clients of attorneys throughout the State of California. This episode features Glen Heggstad, a renaissance man who has circumnavigated the globe four times, most of which was on a motorcycle—solo. But he would be the first to say he was not alone, as he found friendship and family everywhere he went. He’s also a competition wining master martial artist and instructor, author of two books chronicling his adventurous life (One More Day Everywhere: Crossing 50 Borders on the Road to Global Understanding—including being kidnapped and held for weeks in Columbia by rebels (Two Wheels Through Terror: Diary of a South American Motorcycle Odyssey). In fact, this latter experience was made into a National Geographic docudrama, Locked Up Abroad, that has been seen worldwide in a number of languages. Glen’s hardscrabble upbringing has not diminished his humanity, which is also expressed in his inimitable spirit—for example, he donates all royalties from his books to Room to Read. Glen Heggstad had some tough beginnings, including foster homes and living on the street. He travelled at the age of 16 and joined a bike gang in his early twenties but soon changed his ways and took up martial arts. Learning progressed to teaching and soon Glen had the most successful martial arts school in his area and became well respected for his school and his work with troubled youth. Glen then decided to retire from martial arts competition and loaded his motorcycle for adventure heading south for Tierra del Fuego. Except it didn't quite work out as planned, Glen was captured in Colombia by rebel guerrillas and held prisoner. He was tortured, starved, beaten and abused during his five weeks in captivity but he managed to stage his imminent death which won him freedom. After that horrific ordeal he didn't even go home, Glen had his original goal still in his sights and never let go. - He rode to Tierra del Fuego as planned. Incredible story.
