For those who don't believe this is a government plot to make spoons stick to noses, FDA approval for the Pfizer-BioNTech Covid vaccine is great news. Afghanistan is kind of a mess, which experts and journalists describe as “not their fault”, and probably a president's fault. While some Republicans insist that it's not too late to bomb Afghans back to the stone age, most Americans like us out, and know the difference between friends and enemies. Our performance in Afghanistan is improving, but makes lousy b-roll.  In Washington, moderate Democrats turned out to be extreme assholes once that they found out how much Senators Sinema and Manchin got out of obstruction. Congratulations go out to Matt Gaetz, who eloped with his sweet alibi to California this weekend. Matt is definitely marrying up. Donald Trump allowed Matt to get married for some odd reason. Donald remains an idiot, screwing up the future of Space Command so that he could score points with Rick&Bubba in Alabama. Both Donald and Mo Brooks discovered that their big lies might have become more powerful than they are, when the two were booed at this weekend's rally.

Onlyfans said they were banning sexually explicit content. Seinfield co-creator Larry David gave Trump-a-lo/ diddler Alan Dershowitz the most righteous business at a grocery store. Disneyland launched an app meant to help the rich avoid long lines at the theme park. Yet another law enforcement officer was arrested for being a violent insurrectionist on January 6th. Pensacola Sheriff Dave Morgan reimbursed taxpayers for a statue erected in the oinker's likeness. Democrat Val Demmings could beat Little Marco. When Texas runs out of ICU beds, hospitals will consider vaccination status before admitting patients. If there's a recall in Cali, Newsom may have to face a GOP challenger who brandished a gun at his now-former girlfriend.

This week: HOLY MAJOLY we had one hell of a Friday news dump this weekend. The Department of Justice is not messing around, my friends, and we love to see it. So much has happened that indicates this Justice Department is NOT just going to ignore the former administration and their misdeeds and I'm glad we were all a little patient with Merrick Garland; there is still one more litmus test for me. I had three red lines I was hoping the Justice Department wouldn't cross and they did the right thing on two of them so now there's only one left. The three red lines were the DoJ representing mo brooks, the DoJ representing trump in the insurrection suits, and the DoJ announcing they will not pursue obstruction of justice charges against the former guy. With the decision this week from Main Justice that they want the court to deny certification of Mo Brooks' speech at the Ellipse being within the scope of his job as a Congressman, the DoJ said LOUD AND CLEAR. Today's episode updates two separate lawsuits related to the 1/6 insurrection: Rep. Eric Swalwell's suit against Trump, Trump Jr., Rudy Giuliani and Alabama Rep. Mo Brooks and the ongoing drama surrounding sanctions for the Kraken lawyers in King v. Whitmer, the Michigan lawsuit that exposed just how nonsensical all of the Kraken election lawsuits were. In the first segment, we learn that neither Merrick Garland's Department of Justice nor counsel for the House of Representatives believe that "inciting insurrection" is within the scope of your employment if you're a member of the House of Representatives, so... Mo Brooks is on his own on this one. This is all about the Westfall Act, which we last discussed in Episode 498. In the main segment, we check back in now that all the supplemental briefs have been filed after the mammoth 6-hour Michigan sanctions hearing. Learn who had the worst filing (hint: someone did worse than Lin Wood!), who had the... least worst?... and what is in store for all of the Kraken lawyers! Remember all of this is about Rule 11 of the Federal Rules of Civil Procedure. Finally, if you search the transcript you'll see Howard Kleinhendler make the "fraud vitiates everything" argument, for which David Fink rightly skewers him in the City of Detroit's supplemental brief.
