From there Hawk lays out the political reality. Even with 52 or 53 Senate seats, Democrats would be far short of the Republican votes needed for conviction, and a Republican-controlled Senate might decline to hold a trial at all. He notes how Mitch McConnell pointed to the courts after January 6th, and how impeachments historically boost a president's poll numbers, as they did for Bill Clinton and for Trump twice before. Weighing it out, Hawk points to an open 2028 White House, a Senate GOP already tired of Trump after the primary losses of John Cornyn, Bill Cassidy, and Thom Tillis, and his own mixed feelings. He explains why he leans toward moving on rather than grinding Congress to a halt, while acknowledging the constitutional argument for using the remedy the founders provided. On Monday morning's War Room, Navarro's complaint was that Jeanine Pirro has not fired John Crabb, the Justice Department prosecutor who handled both cases. Bannon pushed back, because he likes Pirro. Hawk's observation is that Crabb remains employed in good standing, which says something about how much pull Navarro actually has. Then there is the older footage. Navarro sat with Ari Melber on MSNBC and described the Green Bay Sweep, the plan to keep Trump in office after the 2020 election, on camera and unprompted. The democrats caused the chaos at the Capitol on January 6th, 2021, for a few reasons, one of which was to make the topic of election integrity off-limits.

The first ticket on Mary and Andrew's agenda: the latest on Todd Blanche's confirmation. After prodding from two Republican Senators, Blanche released a Sunday night statement allegedly rescinding the $1.776 “Anti-Weaponization Fund” to pacify their concerns. And by all measures, it worked. But in Andrew's estimation, the statement was “the world's smallest fig leaf,” with both hosts noting that the “settlement agreement” can only be changed in writing if signed by both parties. Mary calls it “basically a press statement” rather than a legal order. Then, they turn to former FBI Director James Comey's filing of multiple motions to dismiss his “Seashell” indictment, including one on the grounds of vindictive and selective prosecution. They detail court filings that show an array of issues with the case, including surveillance of him and his wife by the Secret Service. Next, Andrew and Mary detail why Jeanine Pirro's Reflecting Pool case against Olympian David Hearn fell apart, after a disastrous rush to charge before the facts were in. David Waldman and Greg Dworkin take on a new day, week, month, and the same old chaos. Donald K. Trump won his 43rd club championship at one of his courses. It's called TALENT, and money. You know Donald. Always bullshitting. You know he is, he knows he is. Leave it there, you're cool, but call Trump on it and you have a fight. Because, admitting he's wrong just isn't part of the game… and not playing along can lose you a job, send you to prison, or worse. Capital One was playing along, but Trump wouldn't walk away, could not shut up, and Capital One quit playing. It made absolutely no difference if Todd Blanche formally rescinded Trump's J6 slush fund, which is why Blanche did it. Gops are playing along with that, but Trump doesn't play along with anybody's bullshit but his own. Dems are strongly favored to take the House, and maybe the Senate. Abdul El-Sayed's name might not be enough to keep voters from scratching in the bubble next to it. Low-turnout voters might not turn out. Indecisive Democrats aren't sure what to do. Gop staff is filling up with young Groypers. The Evangelical Church is filled people who are Christian as an afterthought.

From there Hawk turns to what he sees as the deeper issue: the electorate itself. He argues that in 2024, voters had full knowledge of Trump's record, the attempt to overturn the previous election, the events of January 6th, the indictments and the New York felony convictions, and chose him anyway. For Hawk, that choice, not any single official, is the root of where the country now finds itself. He is blunt that he sees no short-term fix. His view is that the results reflect the will of the people who turned out to vote, and that the same dynamics will outlast this administration. Hawk closes on a personal note about why he has chosen to live far from dense population, and signs off wishing viewers a safe week. The reason is basic contract law. The underlying document is a settlement agreement in Trump versus IRS, signed in May by the Trump plaintiffs, the Department of Justice, and the IRS commissioner. Section eight of that agreement states it may be modified only with the written agreement of all parties. The two documents Blanche released today rescind a related DOJ order, but one is unsigned entirely and the other carries only Blanche's signature, not the Trump attorneys or the IRS. Under the four corners of the contract, Hawk argues, neither touches the settlement, which remains fully enforceable. His conclusion is pointed. Because the settlement is intact, Hawk contends Trump could sue the government to compel the fund the day after Blanche is confirmed and would win. He credits MSNBC's Ken Dilanian and CNN's Elie Honig as the only two commentators he saw get it right, and argues Cornyn and Tillis are advancing the nomination on the strength of paperwork that carries no legal weight. That reversal drew a sharp response. Senator Thom Tillis posted that despite Trump saying the fund was dead, he clearly intends to resurrect what Tillis called the payout pot, and that Blanche, whom Tillis considers qualified, likely will not be confirmed because of it. The Judiciary Committee vote is set for Tuesday, the same day as the Michigan Senate primary. Hawk makes his recurring point: Trump could have pardoned the January 6th defendants in his final two weeks in 2021 but did not, and now wants to compensate them. He also connects the dismissal of the reflecting pool case, where the DC US Attorney conceded a lack of evidence, to a broader argument about a Justice Department stumbling through high-profile cases. He notes Blanche can remain acting Attorney General even without confirmation.
