POPULARITY
Theories of nuisance, market-share, and consumer protection liability have become increasingly popular among plaintiffs who cannot trace an alleged harm to any specific defendant. Recently, states and local governments have sought to impose market-share liability on companies based on allegedly misleading statements (or silence) about the potential effects of their products. These cases raise difficult legal issues that remain underdeveloped because the risk of a crippling damages award often pressures companies to settle claims early in litigation.Featuring:Mr. Theodore J. As federalism becomes an increasingly important principle of our constitutional structure, Chief Judge Jeffrey Sutton of the U.S. Court of Appeals for the Sixth Circuit has published a timely book titled, Who Decides? States as Laboratories of Constitutional Experimentation (Oxford, 2021). Judge Sutton, a former law clerk to Justices Lewis Powell and Antonin Scalia, argues that constitutional law in America--encompassing the systems of all 51 governments--should have a role in assessing the right balance of power among all branches of our state and federal governments.A distinguished group of legal thinkers and practitioners joins us to discuss this book.Featuring: -- Hon. This panel of current and former state Attorneys General will examine the relationship between the federal and state governments, vertical separation of powers, as well as the regulatory regime within states. Many state AG offices are litigating more, and more important cases, than ever before. A recent spate of lawsuits has pitted a fair number of states against the federal government, challenging underlying federal authority for discreet actions taken. Meanwhile, laws and regulations by state government actors, including business licensing and other regulations governing business and employment, are being challenged by others, often defended by state Attorneys General. The panel will discuss and debate these and other emerging challenges. -- This panel was presented at the 2015 National Lawyers Convention on Friday, November 13, 2015, at the Mayflower Hotel in Washington, DC. -- Featuring: Hon. Adam Laxalt, Attorney General, State of Nevada and Hon. William H. Pryor Jr., U.S. Court of Appeals, Eleventh Circuit. Moderator: Mr. Adam J. White, Counsel, Boyden Gray & Associates. Introduction: Mr. Leonard A. Leo, Executive Vice President, The Federalist Society.
