The case, brought by Human Rights Law Centre on behalf of Tarneen, Benny Zable and with new applicant David Hack, questions the validity of Victoria Police's extraordinary powers within designated areas, including stop and search powers and the ability to direct people to leave areas if they refuse to remove a face covering. While the 6-month declaration of Naarm's CBD as a designated area was ended early, organisers are concerned about the impact that ever-expanding police powers will have on fundamental protest rights, particularly those of First Nations people in the lead up to Invasion Day 2026. Following on from our chat on 18 December 2025, where Ilo spoke about some of the work he has been doing to document designated areas, today's interview focuses on the report 'A Tale of Two Cities: The Hidden Geography of Police Powers in Victoria', released this week by the Centre, which identifies the racialised impact of designated area policing via an analysis of declarations between 2019-2024. Civil society organisations and legal advocates have raised alarm about the speed at which these laws have been rushed through Parliament, with consultation on the exposure draft of the Combatting Antisemitism, Hate and Extremism Bill 2026 announced on the 13th of January this year in the wake of the Bondi attack. This rally was met with a significant police presence, with attendees prevented from taking to the streets by NSW Police due to new powers to restrict public protests granted after the Bondi attack in December 2025. The upcoming Invasion Day rally in Sydney is anticipated to proceed without heightened policing due to a last-minute carve-out of the rally route from New South Wales' increasingly draconian protest laws. Shane discusses the closing of the John Curtin Hotel, the interim report of the Social Housing Regulation Review, the ongoing case for public over social housing from a financial perspective, the state government offloading homelessness services to the private sector, stories of radical direct housing action in the 70s, and the Barak Beacon housing estate in Port Melbourne currently facing "renewal". Cathryn joins us to discuss the grim reality that homelessness kills, and the memorial which was held with the crowdfunded and volunteer-run organisation From Us 2 U ("vote" for them to raise funds here). She also speaks to the issue of a severe lack of funding towards public housing by the Victorian Government while funds are diverted towards profitable prison systems and extremely predatory policing targeting vulnerable communities. Peaceful protests calling for a change to the January 26 Australia Day holiday turned ugly as police clashed with protesters and, on one occasion, a protester was forcefully removed by bikies.Thousands gathered for Invasion Day protests in Australia's capital cities and in regional centres.After hours of speeches at the Domain in the Sydney CBD, where police told protesters they could gather but not march, a number of protesters were arrested.In Canberra, a man wearing a Make America Great Again cap and waving an Australian flag was forcibly removed from an Invasion Day rally by three men in bikie colours.As he drove away, the assembled crowd cheered.In Melbourne, thousands marched from Parliament House down Bourke Street after a peaceful protest in which police refused to remove their hats, a stance in line with police procedure.The clash between police and protesters at the Domain in Sydney followed a warning from police.“If you do the right thing, I'll do the right thing,” an officer told an organiser as 3000 people gathered.Among protesters there is Paul Silva, the nephew of David Dungay Jr, a Dunghutti man from Kempsey, who died in prison custody in 2015.“I'm here to demand the abolishment of Australia Day,” he told news.com.au.
