Släktforskaren Elisabeth hittade en skilsmässoanteckning från 1829 hos en anmoder. Hon fann en historia med arsenik, misshandel och eländigt äktenskap. Var gick gränsen mellan husaga och misshandel? Att bryta upp från ett äktenskap var ingen lätt sak i det gamla Sverige. Det krävdes mycket goda och entydliga skäl för att det kristna sakramentet - äktenskapet- skulle brytas.Men i dagens program får vi höra om Anna som i 1800-talets början mer än väl uppfyllde kraven som lagen hade satt upp för skilsmässa.Det var Annas ättling Elisabeth Wahlberg som upptäckte historien när hon började släktforska för några år sedan och fastnade vid en liten anteckning i en husförhörslängd från Bäve församling i Bohuslän.Noteringen gällde hennes morfars fars föräldrar Anna Hansdotter och Andreas Hansson som inom loppet av ett och ett halvt år gick från lysning och giftermål till skilsmässa.- 1828 tar de ut lysning på våren och de gifte sig i juni samma år och så föds deras enda barn, Hans, tio dagar efter vigseln, berättar Elisabeth Wahlberg. - Det jag först såg var att de hade fått skiljebrev av Domkapitlet i Göteborg och anledningen till det var att han hade försökt giftmörda sin hustru.Elisabeth har under sin forskning försöka ta reda på vad som egentligen hände med det unga paret på gården Rosseröd i Bohuslän i början av 1800-talet. Hon har plöjt igenom mängder av rättsprotokoll och fram träder en våldsam man som försöker ta livet av sin unga hustru. Frågan är hur Anna kunde falla för Andreas?- Ja det kan man fråga sig, säger Elisabeth Wahlberg. I sitt överklagande säger Anna att hon blev gift med hemmansägaren Andreas "vilken jag inte mer än till blotta namnet kände". Kanske var giftermålet mellan Anna och Andreas ett sätt att komma undan den skam som det innebar att få barn utanför äktenskapet vid den tiden. Och när man idag läser rättegångsprotokollen får man intrycket att sonen har en annan far än Andreas.- Han kallade sin son för horunge  fast han står som far i födelseboken och jag funderar om Hans överhuvudtaget är Andreas son. Det enda jag har hört från min mamma var att det ryktades om att han skulle vara av adlig ätt, säger Elisabeth Wahlberg.   Så här skriver Anna Hansdotter till Domkapitlet i Göteborg den 21 december 1829 Okänd med mitt öde blev jag gift med hemmansägaren Andreas Hansson i Rosseröd av Bäve socken, viken jag inte mer än till blotta namnet kände, men som i hela sitt uppförande gjort sig föraktad av alla, och kommen i dess hus där jag trodde mig få njuta de rättigheter mig som hustru tillkom mot uppfyllandet av mina åligganden, blev jag istället obarmhärtigt misshandlad, slagen och förnekad de nödigaste för mitt livs uppehälle. Tåligt motstod jag min mans alla elakheter och trodde det dess förhärdade samvete skulle vakna och han besinnade sin villa, mera noggräknat uppfyllda sina plikter. Men förgäves. Olycklig i mitt förbund, har jag måst påkalla lagens styrka för att vinna en upplösning lika så nyttig som nödvändig. Allra ödmjukastAnna Hansdotter- Det blev sen rättegång och det ena vittnet är torparen Snell som vittnar att han sett och hört hur Andreas misshandlat sin hustru och hur de gett henne oätlig föda. Snell berättar också att Andreas kommit hem till honom och bett honom ge Anna ett vitt pulver. Men istället för att göra det varnar han Anna och talade om vad Andreas hade för avsikter.Sedan bränner Snell giftet i Annas åsyn, och det visar sig att pulvret är arsenik.- Kanske är Snell torpare under Anderas och att det förväntas att han ska vara lydig, funderar Elisabeth.Andreas kommer tillbaka till Snell och frågar om han verkställt sitt uppdrag varpå Snell säger att han misslyckades. Då säger Anderas att han ska skaffa något som är ännu mer verksamt.Häradsrätten den 12 november 1829 Den avskedade artilleristen och nu torparen Sven Snell vittnar att han omkring sist trettondedag fått besök av Andreas Hansson och blivit lovad ansenliga skänker om han häruti ville gå Andreas tillhanda. Andreas ska därpå upptagit ur fickan ett hopvecklat papper varuti var förvarat något vitt glittrande pulver, och som Andreas sade vara gift. Vid överlämnandet begärdes Sven att på ett något hemligt sätt bibringa Andreas hustru att förtära detta emedan hennes död då voro säker. Andreas begav sig sedan bort från Sven av fruktan att Andreas kunnat, i händelse av vägran, ge uppdraget till någon annan som vore nog elak att verkställa och använda giftet. Sven efterskickade därefter Anna för att berätta för henne om Anderas onda uppsåt, samt därjämte uppvisa för henne giftet vilket han i hennes åsyn kastade på elden och varnade henne för Andreas vidare försåt. Sven vittnade om att han förliden annandag jul såg Andreas piska sin hustru trenne åtskilliga gånger, även som att han sett honom slå och misshandla parternas späda barn. På fråga tillade vittnet Sven att Andreas vid ovan omvittnade tillfälle sist trettondedag utlovat penningar samt ett täcke med lakan om Sven ville förgifta Anna samt tillagt att Sven efter Annas död skulle erhålla till skänks hennes bästa klänning. Vittnesmålen upplästes och vidkändes av vittnena som begärde ersättning för deras inställelsebesvär.Efter de här vittnesmålen enas rätten om att paret ska beviljas skilsmässa och Anna tar med sig sin son Hans till sin hemby och flyttar in hos en morbror. Och Andreas får sitt straff. Häradsrätten prövar rättvist döma till skillnad uti parternas, hustru Anna Hansdotters och Anderas Hanssons äktenskap, med förbud för honom att ingå nytt äktenskap så länge som kärandehustrun lever eller är ogift. Och varde parterna enligt Kungabrevet den 24mars 1748 förvisade till Högvördiga Domkapitlet i Göteborg att sedan utslaget vunnit laga kraft undfå skiljebrev. På Häradsrättens vägnar O Westerdahl Uddevalla 30 december 1829Anna tar med sig sonen Hans till sin hemby och Anderas får sitt straff.- Ja, jag tycker nog han fick ett milt straff. Han tilldömdes nämligen att betala antingen 100 Daler och i brist på likvida medel så kunde han tillbringa 24 dagar i fängelse på bröd och vatten, berättar Elisabeth Wahlberg. - Men efteråt står det också att Anna tilldelas allt löst och fast vilket innebar att Anderas blev ställd på bar backe och bodde på undantag efteråt. Sonen Hans flyttar till Annas föräldrahem och Elisabeth har sett att han flyttade som fjortonårig pojke till byn Skepplanda där han antagligen jobbade som dräng. Så småningom gifte sig Hans och fick barn, varav ett var Elisabeths morfar.Elisabeth känner att det varit intressant att ta fram den här familjeberättelsen ur historiskt synpunkt, men känner samtidigt att det är underligt att hon aldrig hört talas om den här historien från hennes familj.         Blå eller blodig, halt eller lytt - husagans gränserNär Andreas Hansson ställdes inför rätta anklagad för att ha försökt förgifta sin hustru var det ett brott som samtiden såg extra strängt på. Att giftmörda eller försöka giftmörda hade en egen rubrik i den viktiga lagbok som skrevs 1734. Det berättar Marie Lindstedt Cronberg som är historiker vid Lunds universitet.- Giftmord har en egen paragraf i lagen, så man ser det som ett specialfall av mord och dråp.  Också försök till giftmord var belagt med dödsstraff, berättar hon.    - Jag tror att det hängde samman med att man hade så svårt att värja sig mot giftbrott och att man därför tyckte att det var en väldigt dolsk handling som ingen kunde försvara sig emot.Andreas Hanssons försök att förgifta sin hustru var det stora ärendet i rättegången men under förhandlingarna i rätten så kom också frågan om misshandel upp. När den här rättegången genomfördes så hade ingen man rätt att aga sin fru. Annars hade det ju länge funnits ett gammalt begrepp, med rötterna i de medeltida landskapslagarna, som kallades husaga och som gav husbonden rätt att använda våld för att uppfostra sin fru, sina barn och sitt tjänstefolk. Även om lagarna moderniserats vid tiden för den här rättegången och husagan inte längre gällde hustrur, så kan det mycket väl vara så att mannen i det här fallet trodde sig ha rätten att slå, säger Marie Lindstedt Cronberg.   - När man tittar på rättsfall från den här tiden så ser man att män ofta åberopar sin rätt att slå sin hustru, men jag har aldrig funnit att någon svensk domstol har tillerkänt mannen en sådan rätt, utan tvärt om gör domstolen alltid ett uttalande som säger att det är förkastligt. Också kyrkan fördömde den här sortens våld, och man ser också hur grannar och släktingar går emot den man som tar till våld.    - Så det är nog främst män som är lite rättshaverister eller som gärna tog till ett dominant beteende som brukade våld, tror Marie Lindstedt Cronberg.Det fanns en slags logik bakom husagan, det gäller bara att förstå hur samhället var uppbyggt, menar hon. Husbonden var representanten för en av de många enheter som samhället bestod av och därför behövde han skydd och vissa maktbefogenheter.- Samhället såg helt annorlunda ut än idag. Sverige var ett agrarsamhälle som var uppbyggt runt hushållen, och hushållen var inte i första hand familjer och hem utan de skulle kunna liknas vid företag. Det var inom dem man producerade nästan allt som konsumerades i samhället. Dessa små företag var strikt hierarkiskt uppbyggda med husbonden som den som ansvarade för allt som skedde i hushållet. Statsmakten lade helt enkelt den juridiska rätt i händerna på husbonden, som han behövde för att kunna upprätthålla lag och rätt, berättar Marie Lindstedt Cronberg. Hon menar att det kanske inte alltid var så enkelt att vara husbonde.  - Om han brast i autoritet och tjänstefolket inte lydde honom- vad skulle han då ta sig till? Då låg det nog nära till hands att han tog till våld.    - Men det var ingen bra väg, den man som slog folk i sitt hushåll kom snabbt i vanrykte. Aggression var ett svaghetstecken som inte höjde hans manlighet.När det gäller husbondens relation till hustrun så har landslagens gamla skrivning om att mannen hade rätt att näpsa sin hustru försvunnit i 1734 års lag. Istället fanns en paragraf som straffbelägger män som slår sin hustru. Men vissa kriterier måste vara uppfyllda, berättar Marie Lindstedt Cronberg.    - Han ska ha slagit henne Blå eller blodig, lam eller lytt. Det betyder att mer lindrigt våld inte täcktes in av lagen. Dessutom skulle mannen ha en viss sinnesstämning för att han skulle dömas för misshandel.    - Han skulle vara hatisk eller onykter eller möjligen ha förälskat sig i en annan kvinna.Även om det blivit förbjudet för mannen att aga sin hustru, så var det fortfarande tillåtet från 1858 att aga sina unga pigor och drängar flickor upp till 16 år och pojkar upp till 18 år. Men våldet var tänkt att uppfostra och därför var det viktigt att det utövades utan aggression.Husagan skulle vara övervägd, välavvägd, fri från aggression och balanserad. Man hade inte rätt att slå tjänstefolket så att det uppstod bestående skador.Kanske fanns det faktiskt en och annan husbonde som tog lagstiftarnas tankar på allvar och utövade den tänkta sortens husaga befriad från ilska och aggression, men i de fall som kommer till domstol så är det en annan bild som träder fram.    - De fall man kan hitta handlar aldrig om kontrollerad aga, utan där finns alltid ilska, vrede och berusade husbönder, så den behärskade situationen har vi väldigt svårt att se några spår av. Överhuvudtaget är våldsbrott mot hustrur och tjänstefolk en väldigt liten brottskategori i svenska domstolar.- Men det är svårt att tro att de få rättsfallen handlar om att våld var ovanligt, utan vi måste istället tolka det som att det var väldigt svårt att ta sig rätt mot en husbonde.Under 1800-talet förändrades samhället snabbt i takt med industrialiseringen. Tjänstehjonen fick en annan roll och blev gradvis arbetskraft, en ny status som inte på samma sätt lydde under en husbonde. Ändå dröjde det en bit in på 1900-talet innan det slutligen blev förbjudet att aga unga pigor och drängar. Husagan diskuterades livligt i den svenska riksdagen, från 1800-talets mitt och framåt.  De konservativa krafterna i parlamentet ville att allting skulle förbli vid det gamla och talade om urminnes rättigheter, medan de liberala krafterna talade för individens, i det här fallet arbetarens,  frihet och rättigheter. Under diskussionerna, som de liberala till sist vann, kan man se hur bilden av husbonden snabbt förändras.- Från att man hade sett väldigt positivt på husbonden eftersom han var viktig i det gamla samhället, så blir han i de här diskussionerna verkligen nerdragen i smutsen, berättar Marie Lindstedt Cronberg.
