A cheerleader in Pennsylvania was suspended for a Snapchat video she made off-campus. She sued and the case ended up at the Supreme Court who ruled today in her favor. Dr. Sigal Ben-Porath from the University of Pennsylvania wrote an amicus brief in the case and joined Adam to discuss the outcome. See omnystudio.com/listener for privacy information.
Are the kids alright? Sigal Ben-Porath and Jay discuss the thorny issues of free speech on college campus by first traversing some philosophical groundwork offered by Hannah Arendt. Together they explore what speech is "beyond the pale", "a waste of time", "too dangerous", or simply disingenuous cover for nefarious politics. Ultimately, the questions of what kinds of responsibilities educational (and housing) institutions have to their students and tenants and what the purpose of school really is become central to the conversation.
The issue of free speech on campus has become an increasingly visible debate for higher education. Dr. Sigal Ben-Porath (University of Pennsylvania professor, fellow at Harvard's Edmond J. Safra Center for Ethics, and former chair of Penn's Committee on Open Expression) joins Jeremy to discuss what she has found to be the most common misconceptions concerning student views on free expression. While discussing the vital nature of free speech to colleges' mission, she outlines ways in which colleges can articulate a dual commitment to free speech and inclusivity, which may serve to ease campus tensions. The conversation also moves to the importance of returning to well-rounded civic education in the United States, as well as the ways in which the historical precedent of school choice—which pre-dates America's Founding—should reframe the discussion on this critical issue. On March 2, President Trump announced his plans to sign an executive order “requiring colleges and universities to support free speech if they want federal research dollars.” Considering whether or not such an order would be constitutional, how it might be enforced, and how it could affect colleges and universities—two experts on campus free speech, Sigal Ben-Porath of the University of Pennsylvania and Adam Kissel, former Deputy Assistant Secretary for Higher Education at the U.S. Department of Education, join host Jeffrey Rosen. They discuss the state of free speech on campuses across the country, and debate the best ways to tackle challenges to free speech, from speech zones to speech codes to protecting the rights of students and universities alike. "Universities and colleges are the most effective site for practicing the First Amendment in the United States today." This is why Sigal Ben-Porath, Professor at the University of Pennsylvania and author of Free Speech on Campus and Citizenship Under Fire: Democratic Education in Times of Conflict, developed the idea of "inclusive freedom". Student, faculty and staff rights are respected while all opinions can be voiced. Professor Ben-Porath shows how some of the campus controversies have distorted the fact that universities and colleges actually have a robust free speech culture which they exercise every day, and how we can uphold our commitment to free expression without compromising the university's key mission of advancing knowledge in pursuit of the truth.
