gittin 36: pruzbul by “Dafsplaining”: daf yomi made simple
The Torah commands us that every seven years at the end of the Shemitah (Sabbatical) year, all loans must be absolved and the creditor is forbidden from collecting those loans. More than a thousand years later, the sage Hillel found a legal loophole called Pruzbul to allow creditors to collect their loan after the Shemitah year had passed. What is the Pruzbul and how does it work? What is the point of a commandment if we have a loophole to get around it? Is G-d happy when we find loopholes to avoid his commandments? Even if it's legal, is it in the spirit of the Torah? A class about the 'Absolving of Loans' and the Pruzbul loophole.
This year we find specific laws relating to loans and making sure you are able to collect them. What is the Jewish ethic of making loans to those in need? How does a Pruzbul fit into this picture? 1) In the 8th brocho of Shmone Esrei we ask for healing, ending with praising HaShem as healer of the Jewish people. But HaShem heals all flesh, as expressed in the end of the brocho of Asher Yotzar: רופא כל בשר. So why the specification in this blessing?[1] 2) We made a Pruzbul last Erev Rosh haShono; this year again?[2] 3) We have a non-Jewish helper come each Friday night. I have been leaving an envelope with cash for her to take when she leaves at the end of the evening. If the hospital calls me on Shabbos and tell me that the patient is deteriorating rapidly, may I travel to be with him in his last moments of this life?[9] 9) The government has given grants to assist people to pay their energy bills. Need one set aside Maaserfrom this income?[10] 10) I recently bought a home. The previous had planted an apple tree in the garden. Upon closer inspection, it is certainly a grafted tree, the root-stock being from another species. We explain how using this document, contrary to widespread belief, upholds both the letter and the spirit of the law of Shmita, the Sabbatical Year.
