受訪者： 臺灣高等檢察署 朱立豪檢察官 節目內容： 主題：離職時的電磁紀錄 離職資料要怎麼處理才不會踩雷？一不小心，備份就變刑事！電磁紀錄、營業秘密、Email備份…上班族最容易誤觸的法律陷阱今天非常值得大家停下手邊的事情認真聽！ 你認為離職前做的這些動作「很正常」嗎？ 把自己做的資料放到 USB？ 把重要信件寄到自己的 Gmail？ 拍一下電腦畫面存證？ 留一些案例、客戶名單以後方便參考？如果你心裡想：「這很平常吧？」那今天你一定要好好聽，因為這些「我們以為很習慣的行為」，很可能在法律上通通算—未經授權重製電磁紀錄，甚至涉及著作權、營業秘密法、刑法359，最嚴重會被搜索、偵訊、判刑。今天我們非常榮幸邀請到 臺灣高等檢察署朱立豪檢察官，要帶我們了解身邊很多人「不知道卻天天在犯」的離職風險。 案例：R君在甲公司任職十年，從助理開始一路擔任企劃、研發等工作，被乙公司加薪挖角，離職前依工作習慣將公司公務電腦硬碟內工作上所保 管之資料存出備份，並將重要的公務電子郵件轉寄到私人信箱，不料離職半年後被警調持搜索票搜索並約詢，到底原因為何?員工在就職時，往往會簽署保密協定與智慧財產權約定，大致會約定在職期間及離職後，不得洩漏公司之機密資訊，以及任職期間所完成之智慧財產權，均屬僱主所有。而離職時，會填離職單，其中也可能有交還檔案及電磁紀錄甚至是刪除已取得僱主電磁紀錄之選項，一般都會勾選已交還，但電磁紀錄可以重製，不少勞工或僱主會忽略事前已經重製之檔案，有無確實執行交還或刪除。公司說我違反營業秘密法，我該怎麼辦？公司一旦懷疑你保留資料，就會： (1)查電腦紀錄(2)認定你未授權重製(3)可能申請搜索票 【解決方法】 立即整理證據：沒有傳送、沒有外流 配合調查，不要說模糊語句 調查時避免說「我只是習慣備份」（這句是最常讓法官認定你“有動機”的關鍵）。要完全避免風險，我離職流程要做哪些？【最高強度自保清單】 1. 清空所有備份裝置（USB / 雲端 / 外接硬碟） 2. 刪掉手機裡所有公司資料 3. 登出所有公司帳號（Gmail、Teams、ERP 系統…） 4. 填寫離職單時，如實確認 5. 讓公司檢查你的電腦（保留證據） 6. 不下載、不複製、不轉寄、不拍照 7. 不碰客戶資料 8. 不保留舊專案 9. 若需作品 → 必須書面授權做到這九點，出事的機率幾乎是「零」。溫馨提醒：離職是人生常態，但法律責任不是說一句「我不知道」就能免責。 今天要記下最重要一句話：「你做的，不代表你擁有；你會用的，不代表你可以帶走。」 做好分寸，把資料留在原公司，未來職涯更安心、轉職更順利，也不會因為一個檔案毀掉十年努力。再次感謝 朱立豪檢察官帶來這麼重要又實用的解析，也祝福所有朋友都能順利離開每一段工作、平安開始下一段旅程。

受訪者： 臺北地檢署 邱稚宸檢察官 節目內容： 主題：「他說話開黃腔！」淺談言語性騷擾所構成之性騷擾責任「他說話開黃腔！」言語性騷擾，你以為沒碰到就沒事？錯！一句話害你吃上官司？！「他開黃腔！」言語性騷擾的法律地雷一句不當玩笑＝行政罰鍰＋民事賠償！你以為沒碰到就沒事？錯！今天，我要帶大家看清一件很多人誤會、卻非常嚴重的事情。你是不是也看過有人在聊天時突然冒出一句：「哎唷妳這樣穿很犯規喔！」或者是「你身材這麼好，不多講兩句怎麼行？」有些人甚至自以為幽默，說：「開玩笑啦！不要那麼敏感嘛∼」但！你知道嗎？這種「一句話」，不只不幽默，還可能讓你直接觸犯法律，面臨罰鍰、民事賠償，甚至在職場留下紀錄！今天我們邀請到臺北地檢署邱稚宸檢察官，由他來為大家剖析： 哪些言語是法律認定的性騷擾？沒碰到人，為什麼也會觸法？民眾最容易踩到的「開黃腔地雷」有哪些？「一句玩笑」真的可能讓你賠到痛？ 聽完今天這集，你會發現：嘴巴失控，比手腳失控更可怕！ 有時在實務上會遇到，在對話過程中，遭到他人以性暗示的言語開黃腔的狀況，那這樣的開黃腔的人會不會構成性騷擾防治法第25條的乘機性騷擾罪的刑事責任？ 以下來簡單跟大家介紹性騷擾責任部分 性騷擾定義為任何不被歡迎的、性或性別相關的行為，這些行為可能使人感到不舒服、受到冒犯或侮辱，甚至可能干擾到個人的正常生活及損害其人格尊嚴。這不僅包括物理上的接觸，也涵蓋了言語上的騷擾，如不恰當的黃色笑話或評論。關於性騷擾本身的定義為： 性騷擾防治法第2條： 本法所稱性騷擾，指性侵害犯罪以外，對他人實施違反其意願而與性或性別有關之行為，且有下列情形之一： 一、以明示或暗示之方式，或以歧視、侮辱之言行，或以他法，而有損害他人人格尊嚴，或造成使人心生畏怖、感受敵意或冒犯之情境，或不當影響其工作、教育、訓練、服務、計畫、活動或正常生活之進行。 二、以該他人順服或拒絕該行為，作為自己或他人獲得、喪失或減損其學習、工作、訓練、服務、計畫、活動有關權益之條件。至於性騷擾加害人需負的責任，可分為三種：行政責任（罰鍰）：性騷擾的情情境大致可以區分為職場、學校、部隊或其他情況，被害人分別可以向所屬職場、學校、部隊的性別平等教育委員會、所在地的直轄市、縣（市）主管機關或警察機關提起申訴，並依照性騷擾防治法第27條之規定，由縣市主管機關處以罰鍰。 刑事責任：依照性騷擾防治法第25條所規定，性騷擾加害人將涉及刑罰部分，係僅限於意圖性騷擾，乘人不及抗拒而為親吻、擁抱或觸摸其臀部、胸部或其他身體隱私處之行為，將處2年以下有期徒刑、拘役或併科新臺幣10萬元以下罰金；且若是利用性騷擾防制法第二條第二項之權勢或機會而犯之者，加重其刑至二分之一。且需注意的是，性騷擾的刑事責任乃告訴乃論，是被害人需在案發開始6個月告訴期間內提起性騷擾之告訴。 民事責任：依照性騷擾防治法第12條之規定，對他人為性騷擾者，負損害賠償責任。前項情形，雖非財產上之損害，亦得請求賠償相當之金額，其名譽被侵害者，並得請求回復名譽之適當處分。依前二項規定負損害賠償責任，且屬權勢性騷擾者，法院並得因被害人之請求，依侵害情節，酌定損害額一倍至三倍之懲罰性賠償金。有時候，就是差那一秒的克制，能讓你避免掉一個官司。 如果我被言語性騷擾，我可以怎麼做？那如果聽眾朋友遇到言語性騷擾，該怎麼辦？ 邱檢察官：明確拒絕、保存證據（聊天、錄音、截圖）職場/學校/部隊提出申訴、向主管機關申訴、視情況求償，如是肢體騷擾 → 六個月內提刑事告訴提醒大家，你不是孤單的，法律是站在你這邊的。幽默可以讓人放鬆，但不尊重的話，卻會讓人受傷，也會讓自己陷入法律風險。讓我們一起讓生活更安全、更友善。感謝臺北地檢署邱稚宸檢察官今天的分享，也謝謝所有聽眾朋友的陪伴。
