受訪者： 臺灣高等檢察署 曾靖雅檢察官 節目內容： 主題：《防患未然的司法防線：預防性羈押新制全面解析》 115年刑訴修法重點一次看懂！哪些行為可能讓你「還沒再犯就先被羈押」？從酒駕、詐騙到性影像犯罪，帶你看懂最新法律紅線與生活風險！今天這一集，我們要談一個「很多人以為離自己很遠，但其實就在生活周邊」的重要法律議題——預防性羈押。 你有沒有想過，有些人「還沒真的再犯」，卻已經被法院裁定羈押？ 這不是未審先判，而是為了避免「一再發生的危險行為」，法律提前設下的防線。 尤其在今年4月17日修法後，像是酒駕、詐騙、性影像犯罪、兒少性剝削，甚至槍砲犯罪，都被納入預防性羈押的範圍。 今天帶大家從「法律規定」到「實務案例」，一一拆解哪些情況最容易踩雷？民眾又該如何自保？ 115.4.17修正通過刑事訴訟法第101條1預防性羈押修法解析●什麼是預防性羈押？《刑事訴訟法》第101條之1 被告經法官訊問後，認為犯下列各款之罪，其嫌疑重大，有事實足認為有反覆實行同一犯罪之虞，而有羈押之必要者，得羈押之： 一、刑法第一百八十五條之三不能安全駕駛罪。 二、刑法第二百八十六條之凌虐或妨害未成年人健康發育罪、第 三百十九條之一之妨害性影像罪、第三百十九條之二之加重妨害性影像罪、第三百十九條之三之供人觀覽性影像罪、第三百十九條之四之製作不實性影像罪、兒童及少年性剝削防制條例第三十六條第一項至第五項、第三十八條第一項、第三項、第四項之罪、詐欺犯罪危害防制條例第四十三條、第四十四條之罪。 組織犯罪防制條例第三條第一項前段之罪。 ●本次修法核心：五大新增罪名：不能安全駕駛（酒駕、毒駕）、 殺害 幼童、妨害性影像、兒少性剝削、詐欺及槍砲犯罪 ●不能安全駕駛（《刑法》第185條之3） ●妨害性影像（《刑法》第319條之1至之4） ●兒少性剝削（第36條、第38條） ●詐欺犯罪（詐欺犯罪危害防制條例第四十三條、第四十四條、《組織犯罪防制條例》第3條） ●殺害幼童（《刑法》第286條、第272條之1） ●槍砲（《槍砲彈藥刀械管制條例》第9條之1、第12條、第13條、第13條之1》 什麼是「預防性羈押」？和一般羈押有什麼不同？ 預防性羈押，是指法院在審酌被告涉嫌重大犯罪，且有具體事實顯示「可能再犯同類型犯罪」時，即使案件尚未判決，也可先行羈押。與一般羈押（如逃亡、串證）不同，預防性羈押強調的是「未來風險」。例如一名多次酒駕的駕駛，雖本案尚未判決，但若證據顯示其持續飲酒駕車，法院可認為有再犯危險而裁定羈押。這制度的目的，是避免社會危害一再發生，而非懲罰過去行為。 這次修法為何特別擴大預防性羈押範圍？ 此次修法的核心，在於回應近年社會高度關注的重複性犯罪問題，例如酒駕致死、詐騙集團反覆犯案、性影像外流等。這些犯罪具有「高度再犯性」與「持續危害性」，若僅依傳統羈押條件，往往難以及時阻止。因此立法者將多項罪名納入，讓司法機關在風險明確時，能提前介入。例如詐騙車手被釋放後立即再犯，就是典型修法背景案例之一。

受訪者： 臺北地檢署 劉宇倢檢察官 節目內容： 主題：聊聊書記官！你以為在等，其實有人在撐：揭開書記官的真實日常從一通電話到一紙文書，解析司法流程背後最關鍵卻最被誤解的角色！ 你有沒有曾經打電話到地檢署卻沒人接？或者查到案件結果了，卻遲遲沒收到通知？甚至心裡想：「司法是不是效率很差？」但今天，我們要帶大家換一個角度來看，在每一件案件背後，其實都有一群人默默撐著整個流程運作，他們不是站在檯面上的主角，卻是讓司法能順利運轉的關鍵人物。今天帶我們深入了解「書記官」這個常被誤解、卻極其重要的角色。從民眾最常遇到的疑問，到實務運作的真相，讓我們一起看懂—司法，其實比你想像中更忙、更細緻，也更需要理解與支持。 其實地檢署中有很多位置是由書記官來擔任的，今天要談的最常跟民眾第一線接觸的偵查書記官。書記官是檢察官最重要的幫手，檢察官和書記官一起組成一個股，負責維持這個股所有案件的運作。 民眾是直接到地檢署書面遞狀、口頭申告，或是去警局報案，案件送到地檢署以後，書記官要將每個案件的資料維護並整理成卷宗，以北檢而言，每天有3、5到10多件的不等的新案。 檢察官看過卷宗之後會批示，比如開庭、調資料、移附調解等等，此時書記官又需要拿著批示去寄發傳票或製作相關的文書；如果有開庭經驗的朋友就會知道，開庭時書記官會坐在檢察官身旁，負責繕打筆錄；如果有拘提、通緝到案需要臨要開庭的狀況，也是由書記官聯繫法警安排開庭；在民眾看不到的地方，像是警察調基地台位置、拘提被告、提訊在監在押的人、對被告做限制出境出海、吸毒的被告向法院聲請觀察勒戒這些程序，也都少不了書記官協助檢察官送件、跑流程。 到了案件可以終結、檢察官寫完書類時，也是由書記官製作起訴書、不起訴處分書或簽呈，寄給相關的當事人，起訴的話要給被告跟法院，扣案物品也要移交，不起訴則要給告訴人和被告，當然也包含律師，而且並不是寄出文書後這個案件就終了，書記官還要整理寄件回證、確認再議期間、檢查有沒有要沒收或廢棄的扣案物、在前案紀錄表上登記結案時間、確定時間等。 除了以上這些文書工作之外，書記官也是開庭通知或函文上面的聯繫窗口，所以很多民眾接到通知，就會開始打電話，不管是請假、問案情、問流程，甚至單純抱怨、謾罵的，這些電話通通都是由書記官來接聽，但書記官其實常常因為開庭、送公文而不在位置上，而且書記官是不能回答任何關於案件內容或法律程序的諮詢問題，也不能擅自答應民眾、律師的請假，或答應做任何的傳喚證人、調資料等作為，所以建議大家，收到傳票以後，請務必仔細看上面的日期、時間和註記，如果確實有事必須請假，最好是檢附相關的證明、日後有空的時間，以請假狀的方式，讓檢察官決定是否改期，如果有想補充的資料，也盡量在開庭日期前先行提出。 至於案件的細節、結案方向，和之後可能面臨的法律流程，這些不是書記官能夠在電話中告知的，建議如果很有疑慮的朋友，可以向專業人士諮詢，如果委任律師，事先請務必上法務部律師查詢系統確認對方確實有律師資格，如果有預算的考量，也可以攜帶相關資料，透過市政府、法扶、法院提供的法律諮詢，來獲得初步但是正確的建議。 最後也要提醒大家，除了執行科依照確定判決通知繳交罰金之外，如果接到自稱書記官、檢察官的人加你LINE、要求提供帳戶或金錢，都不是真的，地檢署不會以任何理由要求民眾提供帳戶、金融卡、密碼給我們，請千萬不要上當了!!

受訪者： 臺北地檢署 高永珍檢察事務官 節目內容： 主題：《一滑就觸法？手機時代的隱私紅線大解析》從偷拍、錄音到定位追蹤—你以為只是方便，其實可能踩進法律地雷！在智慧手機幾乎人手一機的時代，拍照、錄影、錄音早已成為日常，但你知道嗎？很多我們習以為常的行為，其實可能已經觸碰法律紅線！今天帶大家一起來了解《中華民國刑法第315條之1》妨害秘密罪。從日常生活最常見的「偷拍」、「偷錄」、「追蹤」，到大家常誤以為「沒關係」的小動作，其實都可能涉及刑責。今天的節目不只是法律說明，而是要讓大家真正聽懂、記住，避免一個不小心，就從滑手機變成上法庭！現代智慧手機普及，手機多具有拍照、攝影的功能，人人都可隨身擁有拍攝工具，在捷運上、電梯間，若成為他人偷拍的對象，刑法第 315 條之 1 規定妨害秘密罪，可用來處罰類似的行為嗎？為了保障個人隱私權，針對使用社會上常見的各種電子或光學設備，竊取他人隱私活動的行為，在電子設備或光學設備普及的時代，犯罪者使用工具來窺視、竊錄他人非公開活動、言論及身體隱私部位情形，確實愈來愈發普及，故本條刑法規範日益受到重視，茲針對該條內容，做以下的介紹： 刑法第315-1條的法律規定內容？ A：刑法第 315-1條規定：有下列行為之一者，處三年以下有期徒刑、拘役或三十萬元以下罰金：一、無故利用工具或設備窺視、竊聽他人非公開之活動、言論、談話或身體隱私部位者。二、無故以錄音、照相、錄影或電磁紀錄竊錄他人非公開之活動、言論、談話或身體隱私部位者。 刑法第315-1條構成要件？ A：其分為「無故窺視竊聽罪」和「無故竊錄罪」兩種類型，並從客觀和主觀層面，討論妨害秘密罪的構成要件。 （1）無故窺視竊聽罪定義：刑法第315條-1第一款：「無故利用工具或設備窺視、竊聽他人非公開之活動、言論、談話或身體隱私部位者。」 為了保護隱私權空間隱私，指私生活不受干擾，個人得自主決定是否獨處，保有自我內在空間資訊隱私，指個人自主控制個人資料之資訊隱私權，決定是否揭露其個人資料、及在何種範圍內、於何時、以何種方式、向何人揭露之決定權。 在捷運或公共場所偷拍他人，真的會構成犯罪嗎？很多人以為「公共場所就可以拍」？這是民眾最常誤解的地方之一！即使在捷運、電梯或街頭等公共場所，也不代表可以隨意偷拍他人。法律重點不在「地點是否公開」，而在於「拍攝內容是否涉及他人隱私」。例如偷拍裙底、胸部，或刻意放大拍攝特定身體部位，即使在公開場合，仍屬於對他人「身體隱私部位」的侵害，可能構成妨害秘密罪。 依《刑法第315條之1》，這類行為可處三年以下有期徒刑、拘役或30萬元以下罰金。很多人誤以為「只是拍一下沒傳出去」，但只要有竊錄行為就可能成立犯罪。提醒大家，公共場所不是免責區，尊重他人隱私才是基本原則。 幫朋友「抓姦」偷偷錄音或錄影，真的可以當證據嗎？會不會反而違法？這類「幫忙蒐證」其實風險非常高！很多人以為為了抓外遇或蒐集證據，可以合理偷拍或偷錄，但法院實務已多次指出，「抓姦」並不是合法理由。若未經同意錄下他人私下對話或行為，仍可能構成妨害秘密罪。 除非錄音內容包含「自己參與的對話」，且目的是保護自身權益，而非惡意蒐證，才比較可能被認定為合法。否則，即使出發點是正義，也可能觸法。刑責同樣是三年以下徒刑或罰金。提醒民眾，蒐證一定要合法，否則證據不但無效，還可能讓自己變成被告。

受訪者： 更生保護會臺北分會 蔡雨霓毒品個管師 節目內容： 主題：一段陪伴，改變一個家庭的未來——更生之路，不再孤單從偏見到理解，從困境到重生——當社會願意伸出手，每一個家庭，都有重新站起來的機會。 今天我們要談的，是一段很多人熟悉、卻很少被理解的故事。當一個人走錯了路，他要面對的，不只是法律責任，更是來自家庭、社會，甚至自己內心的壓力。特別是當「毒品更生人」回到家庭，他不只是重新生活，更是在努力修補關係、撐起責任。 今天我們邀請到更生保護會臺北分會的蔡雨霓個管師，透過她的第一線經驗，帶大家看見——陪伴，真的可以改變一個家庭的未來。 我是臺北更保的蔡雨霓個管師，為北大社工系畢業、曾任社會局社福中心社工，來更保下個月即滿一年，很榮幸為大家服務! 很多人會好奇，這樣的工作壓力不小，也充滿挑戰，您當初是怎麼踏進來的？為何蔡雨霓個管師是什麼原因，讓您選擇投入更生保護工作？ 其實我的選擇，來自一段很真實的生命經驗。我來自中南部的城市， 因為我自己的直系家人就是毒品更生人，從小我就看見他想努力改變，但卻因為家族的排斥與社會眼光，逐漸失去信心。那種「想變好卻被否定」的感受，其實非常沉重。因更保近期擴增毒品個管師業務，有幸能到更保服務，希透過陪伴和服務，讓毒品更生人感受到社會的溫暖，給予過渡期的協助和資源連結，最終自立。也因為這樣，我更能理解更生人的處境。他們不是不努力，而是缺少一個願意相信他的人。所以當我有機會進入更保服務時，我希望自己可以成為那個「願意多陪一段路的人」。這份工作對我來說，不只是專業，而是一種回應過去的方式，也是一種對社會的承諾。 案件探討:今天想分享我到臺北分會後、印象深刻並開案服務至今的案件。 (一)案家概況 案主小A為單親媽媽，與前夫育有二子，老大(案長子)歸案前夫、老二(案次子)自己照顧，但老二為特殊兒童、照顧較不容易，而案母已往生多年、案父為分會甫接案不久即往生；小A上有兩個哥哥，兄妹們皆有前科，而大哥因病已被安置。 2案次子跟小A感情融洽，每日會與小A分享在校生活點滴。 3.案二哥住案家附近，故會協助照顧案家。 (二)經濟概況 案家雖有福利身分、但小A有警覺不可皆依賴他人，雖有持續工作、但工作不穩；小A因工作繁忙、甚難兼顧家庭生活和採買，較無時間準備食物給孩子，故有生活相關物資需求。 (三)分會協助 1.分會收集案家資訊、釐清案家需求，了解案家經濟較吃緊，故接案後經評估立即協助轉介民間食物銀行，讓案家可固定前往領取物資，並於三節時亦有提供物資，減緩案家開銷；小A會在小朋友上半天課時，下課後載小朋友前往食物銀行用點數換取小孩喜歡的物資。 2.因案家經濟不佳、較多時間在工作，也很少陪伴子女，故分會辦活動時、會邀請案家共襄盛舉，包含今年2月上電台分享之「家支家庭聯誼－AI繪動 玩轉未來」暖心親子活動，當時案家也有參與；據小A所述，小朋友因玩得太high，回家倒頭就睡，十分難得。 3.陪同小朋友就診，了解現醫療概況。 如果家屬不知道如何幫助更生人，可以怎麼做？很多家屬其實也很無助，該怎麼辦？家屬可以先尋求專業協助，不需要自己承擔全部壓力。 我們會提供諮詢與支持，協助家屬了解如何陪伴、如何設立界線，避免過度壓力或衝突。陪伴不是犧牲，而是一起找到更好的方式。
