Happy National Farm Animal Awareness Week, everyone! In this episode, we're both running on fumes. Mike just got off a redeye flight, having slept maybe three hours total, and is in physical pain. Erin has just returned to normalcy after a week-long "crash out" that started when something fell out of a kitchen cabinet. This was all happening while she was also having a nightmare with QuickBooks and her taxes, manually entering transactions and spending days dehydrated at a co-working space to meet the deadline. Meanwhile, Mike was in Seattle and Bellingham for a wedding, staying in a beautiful, architect designed house on a lake that had some definite signs of wealth. Biggest problem was the Wi-Fi. We also share our thoughts on a rather sad whale museum he visited that had a comically small TV for its theater. We then get into some planning for our upcoming trip to Ohio to ride the Goodyear blimp, debating whether we should fly or drive. We give a PSA for the upcoming Track and Field World Championships in Tokyo before diving into some NFL stories , including a niche Philly Eagles bar in Tokyo , Jalen Hurts' mom's unhinged TikTok posts , a breakdown of which NFL stadium has the most expensive hot dog and the cheapest, and the hilarious story of Hunter Renfrow missing calls from the Panthers because his daughter was watching Bluey. We also react to a bongo performance of the national anthem at a hockey game and give an important update on Erin's garage toad, Toady. We discuss the controversy surrounding comedian Hannah Berner, who is being accused by fellow comedian Kim Congdon of not paying $10,000 for jokes used in her comedy special. We also celebrate the return of the viral "Krispy lady," who finally tried a Krispy Kreme donut. We cover some interesting competitions, like the world record for the fastest 100 meter dash on Legos barefoot and a high stakes boat docking competition in the Chesapeake Bay. We also talk about the man who breakdanced during a city council meeting to protest a property tax hike. Finally, we share the incredibly wholesome tale of a mom who asked the "workmen of the world" to help convince her son to take naps.

In this episode, we cover three major stories shaping Arizona real estate. First, Vestar unveils a massive mixed-use development in Mesa—complete with 2,500 apartments, a 600-room resort hotel, and millions of square feet of office and retail space. We discuss what this means for the East Valley's growth trajectory. Next, we break down Phoenix Metro's dominance in national economic growth rankings, with Phoenix, Mesa, Gilbert, Chandler, Goodyear, Surprise, and Peoria all landing in the top 10 across categories like housing, jobs, and income growth. Finally, we explore why apartment construction has dropped to a 10-year low—and what that means for rents, absorption, and investors in a high-demand market like Phoenix.

In this powerful conversation, Dr. Hotze sits down with Dr. Nathan Goodyear, a leader in integrative oncology, to discuss how addressing the root causes of cancer can help patients achieve better health outcomes and an improved quality of life. Dr. Goodyear explains how his approach focuses on supporting the immune system, reducing inflammation, and using natural, targeted therapies that work with the body's healing processes. They explore how factors like the immune system, nutrition, toxins, tubal ligation, hysterectomy, mitochondria, and hormone imbalances play a role in overall impacts on your health, unnecessary symptoms, and even the potential development of cancer, and how restoring balance can help assist the body's ability to fight back in resolving symptoms and illnesses. If you or someone you love is facing cancer, this episode will open your eyes to treatment strategies that prioritize health, wellness, and quality of life over the one-size-fits-all approach of conventional medicine. Necessary & Proper Episode 90: Nondelegation Doctrine Adds Another Good Year?

Necessary & Proper Podcast

Play Episode Listen Later Aug 12, 2025 63:33

For many years, legal scholars have declared that the nondelegation doctrine is dead. Professor Cass Sunstein once quipped that the nondelegation doctrine had only “one good year” and more than 200 “bad ones.” But that has changed recently. In 2024, the en banc Fifth Circuit held that the Federal Communications Commision’s (FCC) Universal Service Fund is unconstitutional on nondelegation grounds. It was one of the only times since 1935 that a court has done so, and it appears that 2024 (and beyond) may turn out to be good years for the nondelegation doctrine. Contrary to the FCC’s argument, the en banc Fifth Circuit concluded that the Universal Service Fund operates as a tax, which only Congress has the power and authority to require. Regardless of the public policy that it seeks to advance, Congress cannot delegate this power to the FCC or to any other executive branch agency. The nondelegation doctrine has not been entirely dead for the last hundred years; courts often construe statutes so as not to invalidate them under the nondelegation doctrine. The en banc Fifth Circuit rejected that approach. Does the canon in the common law of agency, mentioned by the Fifth Circuit, known as delegata potestas non potest delegari (Latin for “delegated power may not be delegated”), have any impact on the original meaning of the nondelegation doctrine? Assuming the nondelegation doctrine is valid, what are the standards that courts should look to when determining whether a statute is sufficiently intelligible? Do words like “in the public interest” or instructions for the agency to “provide reasonable regulations” provide sufficient guidance to agencies? What kind of principles can be applied that are also judicially enforceable? If the Supreme Court affirms the Fifth Circuit, what will be the impact on other statutes? To discuss these important questions and others, Jeff Beelaert, a partner at Stein Mitchell, and Trent McCotter, a partner at Boyden Gray, will join us. Featuring: Jeffrey Beelaert, Partner, Stein Mitchell Trent McCotter, Partner, Boyden Gray PLLC Moderator: Devin Watkins, Attorney, Competitive Enterprise Institute

It's not a stretch to say there is no quality footwear culture quite like Japan's. But WHY does the Japanese passion for making and wearing great boot and shoes  exist?Well, I had to go to Tokyo to find out. As the final piece of our five-part Sole Searching: Tokyo YouTube series, I sat down with Michiya Suzuki—ex-Red Wing Japan GM and co-founder of The 2 Monkeys boot brand—to crack it open. Turns out, it's part Americana, part rebellion, and part deep cultural reverence for craft. Michiya walked me through how Red Wing became a fashion staple in Japan, how the iconic Iron Ranger boot came to life, and why today's Tokyo bootmakers are blending spade-shaped soles, Goodyear welts, and wild originality into something entirely new. We also got did a bit of unraveling of Japan's essential shoemaking web—everyone from nail makers, to hand-stitchers still doing it the slow, stubborn way. And why, even as the old guard fades, Michiya's betting that a few brave passionates will lace up and keep the tradition kicking. You can also watch this interview on our @stitchdown YouTube channel. https://www.youtube.com/watch?v=bwfAV6KoUC0 Support the Shoecast, get full bonus episode access, and join the most interesting shoe-and-boot-loving community on the internet with a Stitchdown Premium membershiphttps://www.stitchdown.com/join-stitchdown-premium/Check out our site!https://www.stitchdown.com/2025 dates and location for Stitchdown's Boot Camp 3—the world's fair of shoes and boots and leather and more—coming soon.https://www.stitchdownbootcamp.com/

In this interview, Jared speaks about transitioning from chemical engineering to wine studies at Washington State University after watching A Good Year with Russell Crowe. After his initial interest in the science and chemistry behind winemaking, a New Zealand Syrah in 2010 opened his eyes to a passion in wine itself.During school, Jared spent a semester abroad at Lincoln University, where he saw a more complete “grape to bottle” experience of winemaking. His first wine job after college was at 12th & Maple in Dundee, after which he returned to Australia for a harvest in the southern hemisphere. After an additional harvest in California, he set his sights on New Zealand. Here, he worked at two different wineries, extending his working visa to stay for several years, and meeting his future wife in the process. Once again, he added more hands-on experience to his rapidly increasing wine knowledge. In 2019, Jared and his wife moved back to the States to work in Oregon wineries and start a family. During this time, he worked for Willamette Cross Flow, Jackson Family Wines, Failla Oregon, and Yamhill Valley Vineyards before eventually finding a position at Résonance, where he currently works. This interview was conducted by Rich Schmidt at Résonance in Carlton on July 10, 2025.

AI Series: Balancing Data Infrastructure Resource Demands

Ten Across Conversations

Play Episode Listen Later Jul 11, 2025 53:15

Previous episodes in our AI series have focused on the evolving features of artificial intelligence itself: its potential to democratize education and to improve city planning and weather forecasting. In this final installment, we examine its costs: the accelerating resource demands of AI and other data-intensive technologies.  Maya Chari, this year's Ten Across + APM Research Lab data journalism fellow, recently investigated the true water and energy costs associated with data center facilities in the Phoenix metro area— now on track to become the second largest market in the U.S. Though granular industrial data can be difficult to come by, Maya located a report submitted by Microsoft to City of Goodyear officials, stating that one of their proposed data centers would use as much potable water each year as 670 homes. Amplified across the 140 other data centers currently dotting the state of Arizona alone, the scale of such consumption becomes clearer.  As data centers rapidly multiply in response to market demand around the world—often preferring arid places like the water-stressed U.S. Southwest—critical questions are pressed about whether and how such development can be sustained.    In back-to-back conversations in this episode, we'll hear from experts involved in managing and reducing the impact of the physical infrastructure behind our digitized lives. Bobby Olsen, chief planning, strategy, and sustainability executive at the Arizona electric and water utility Salt River Project, describes planning to meet staggering levels of projected energy demand. And Dr. Kerri Hickenbottom, principal investigator at University of Arizona's Hickenbottom Environmental Research Lab, discusses working in concert with the public and private sectors to improve water reuse strategies and overall efficiency of data center operations.  To support our I-10 neighbors' disaster recovery in Central Texas this week:  Kerr County Flood Relief Fund  Related articles and resources:  “At Amazon's Biggest Data Center, Everything is Supersized for A.I.” (The New York Times, June 2025)  “Are Data Centers Depleting the Southwest's Water and Energy Resources?” (American Public Media Research Lab, February 2025) “Thirst for power and water, AI-crunching data centers sprout across the West” (Stanford University, April 2025)  “'I can't drink the water' —life next to a US data center” (BBC, July 2025)  “Meta is building a new data center in Louisiana—and this Senate committee wants to know why it's being powered by gas (exclusive)” (Fast Company, May 2025)  “Phoenix ranks as the second-largest data center market in the U.S.” (AZ Big Media, March 2024)  Credits:  Host: Duke Reiter  Producer and editor: Taylor Griffith  Music by: Curved Mirror, Hushed, and From Now On  Research and support provided by: Kate Carefoot, Rae Ulrich, and Sabine Butler  About our guests:Bobby Olsen is associate general manager and chief planning, strategy and sustainability executive at the Salt River Project, a public power and water utility in Arizona. Bobby has more than 20 years' experience in energy planning. He also serves on the board of Arizona Forward, a non-profit leading the charge for sustainability in Arizona.  Kerri Hickenbottom is an associate professor in the Department of Chemical and Environmental Engineering at the University of Arizona and is principal investigator in the Hickenbottom Environmental Research Lab. It's Tuesday, July 1, A.D. 2025. This is The Worldview in 5 Minutes heard on 140 radio stations and at www.TheWorldview.com.  I'm Adam McManus. (Adam@TheWorldview.com) By Kevin Swanson and Adam McManus Chinese Communists give pastors 3 years in jail for leading church Three pastors from Linfen Covenant Home Church in Shanxi, China have been sentenced to 2-4 years of prison time for various charges related to their leading an unregistered church in the communist country. The church issued a statement, announcing that “We honor the service of Li Jie, Han Xiaodong, and Wang Qiang who suffered for righteousness, and we are willing to bear the cross with the Lord. We receive this verdict with a grateful and obedient heart.” Jesus offers this encouragement in Revelation 2:10 -- “Do not fear any of those things which you are about to suffer. Indeed, the devil is about to throw some of you into prison, that you may be tested, and you will have tribulation ten days. Be faithful until death, and I will give you the crown of life.” Brazilian homeschool mother facing $20,000 of fines Today, a Brazilian court will hear a case of a mom prosecuted for homeschooling her son.   Regiane Cichelero is facing fines of $20,000 and threats of losing custody of her child, for choosing home education on religious grounds.  Alliance Defending Freedom International has taken up the case.  Her legal counsel, Julio Pohl, pointed out that “No parent should fear state punishment for choosing to homeschool their child. Regiane made a lawful and conscientious decision to teach her son at home. We are hopeful that the court will affirm her rights and take an important step toward protecting parental rights in Brazil.”   Regiane continues to homeschool despite the risks involved. Pray for this case, which may serve as a precedent for the other 70,000 homeschooled children in Brazil.   Victory of Christian Colorado camp over transgender agenda Also, Alliance Defending Freedom has announced a favorable settlement for the Idrahaje Christian Camp in Bailey, Colorado. The camp was under threat of losing its license for refusing to submit to state requirements regarding the transgendering of bathrooms and living quarters. The name of the camp is taken from the phrase “I'd rather have Jesus more than anything!”  They use the first two letters of the first four words. The State of Colorado agreed not to take any enforcement action against Camp IdRaHaJe for violation of the gender identity requirements. The state has also clarified in a memo on its website that “churches, synagogues, mosques, or any other place that is principally used for religious purposes” are exempt from the transgendering requirements. Syria's own government helped massacre 1,500 Alawites Reuters has reported on its investigation of the Syrian massacre of 1,500 Alawites in March of this year. The perpetrators included units belonging to the new government based in Damascus. Ahmed Hussein al-Sharaa of the Free Syrian Army and Al-Qaeda took over Syria in January of this year. The new government has also instituted a constitution stating that  “The religion of the President of the Republic is Islam. … Islamic jurisprudence is the principal source of legislation.” This constitutes a step up in Islamic rule over Syria. According to Open Doors, Syria is the 18th most dangerous country worldwide for Christians. Iraq allows Muslim men to “marry” 9-year-old girls The new Iraqi government is also following Islamic Sharia law closely. Earlier this year, Iraq's parliament voted to give Islamic courts more control in family law, and permit child marriages for girls as young as nine years of age.  Supreme Court allows parents to opt kids out & requires porn sites to verify age Here in America, the U.S. Supreme Court is allowing parents opt-out rights for their elementary-aged children from having to participate in homosexual-themed lessons. That comes by a vote of 6 to 3. Writing for the majority, Justice Samuel Alito emphasized that “What the parents seek here is not the right to micromanage the public school curriculum, but rather to have their children opt out of a particular educational requirement that burdens their well-established right ‘to direct ‘the religious upbringing' of their children'” under  the free exercise clause of the First Amendment.  Another 6-3 ruling, the High Court has also upheld a Texas Law requiring pornographic websites to verify users are over 18 years of age.  Only adults will be allowed into these sinful activities. Writing for the majority, Justice Clarence Thomas concluded, ”The power to require age verification is within a State's authority to prevent children from accessing sexually explicit content.” But, in Matthew 5:27-28, Jesus said, “You have heard that it was said to those of old, ‘You shall not commit adultery.'  But I say to you that whoever looks at a woman to lust for her has already committed adultery with her in his heart.” U.S. government buying its own bonds The U.S. government is buying back its own bonds. Barchart reports the largest buyback in history occurred earlier this month.  Under the direction of Treasury Secretary Scott Bessent, the department bought $10 billion of its own bonds.  Federal Reserve on the ropes The Federal Reserve issued $150 billion of bonds in May, but only managed to sell half of them.   Also, the Fed has recorded its first two-year-in-a-row financial loss, totaling $192 billion in 2023 and 2024. This is the first time this has occurred in the Fed's 110-year history. Year to date,  the federal deficit  stands at $1.37 billion as of the end of May. That's 14% higher than last year at this time.  Dad jumps into ocean off Disney Cruise ship to save daughter Here's a story demonstrating a remarkable act of courage and love on the part of a dad. A young child fell off the fourth deck of a Disney cruiseliner on Sunday.   Her father took immediate action, dove in after her. . . and held her while treading water, until a rescue boat pulled them out of the ocean waters. An eyewitness explained what happened to WPLG News. EYEWITNESS: “They were playing shuffleboard that was on the fourth floor. The parents were playing, and then the little girl was climbing up on the railing and flew off.” One passenger said,  “The ship was moving quickly, so quickly, it's crazy how quickly the people became tiny dots in the sea, and then you lost sight of them.” Another passenger said, “I saw the mother crying and but when they rescued them, I think that's when the tears really started flowing.  I prayed to God to save them, and He did!” The Disney Dream was heading back from the Bahamas to Fort Lauderdale when the incident occurred. Worldview teens share their hearts 15-year-old Titus Beran in Omaha, Nebraska wrote me at Adam@TheWorldview.com. He said, “I love the verses included in the newscast! They really help me focus back on God's Word and bring every area of life, even politics and news, into captivity to the obedience of Christ.” And 16-year-old Leah Smith in Franklin, Kentucky wrote, “I have been subscribed to The Worldview in 5 Minutes for a little over a year. I don't watch the news on a regular basis, but have been continually blessed by the ministry of this website. It is so irregular to have such a concise, non-secular newscast that makes me aware of political news, needs of persecuted Christians, and even basic information that keeps me up to date on what is going on. “When I read your newscast transcript,  I am not only encouraged by stories of fellow believers, but I am also moved to pray for the issues in our world. God is truly using your Christian newscast to reach people with the truth. It has been a blessing in my life!” What Troy's three boys enjoy about The Worldview Troy in Horseshoe Bend, Arkansas talked to his three sons -- Sovereign, age 12, Shalom, age 10, and Apollos, age 7 -- about The Worldview. They said, “I like to start my morning at breakfast listening to it.” “I like how I get to hear about people around the world who need Jesus.”  And “I like that I can hear the news which is filtered through a Biblical lens.” Troy added, “We praise the Lord for all of you and your diligent service to the Lord. It is so exciting to hear about donors from all over the world who are united to us in Christ. What an encouraging example to our younger generation. Thank you from the bottom of our hearts.” 42 Worldview listeners gave $12,534.95 to fund our annual budget And finally, toward our $123,500 goal by yesterday, June 30, to fully fund The Worldview's annual budget for our 6-member team, 42 listeners stepped up to the plate. Our necks are hurting from the whiplash of information regarding what tyres are actually fastest off-road. Ronan teases a fresh discussion he had about optimising one sponsored rider for Unbound and some surprising lessons that came from that. It's a topic that continues to fascinate, especially given some of the world's best cross-country mountain bikers have been racing Short Track on 50 mm gravel tyres. In addition to that, you'll hear Dave Rome, Alex Hunt, and Ronan McLaughlin explain why none of them are currently choosing to use 3D-printed saddles. There's a PSA for anyone with wireless shifting, and of course, there's new stuff to talk about, too.As usual, members also get our Ask a Wrench segment, which this week sees Dave Rome and pro race mechanic Brad Copeland answer a handful of questions, including: how keep 11-speed shifting running long-term, understanding bike handling, and best practises for travelling with new SRAM Full Mount derailleurs (Transmission and XPLR).
