TFA is a nonprofit IRS 501c4 "issue advocacy" organization whose mission is to promote, preserve and protect in Tennessee the rights recognized by the 2nd Amendment. TFA is actively engaged in grassroots support, legislative engagement and increasingly in court battles to remove infringements on those rights. These podcasts are intended to provide information regarding legislation, court cases and the law pertaining to firearms owners and their rights in Tennessee.

Jeff Long that was submitted to a federal district judge on January 23, 2023.   In that agreed order, the state of Tennessee admits that its ban on most 18-20  year olds being eligible for handgun permits or to engage in permitless carry is an unconstitutional law that also constitutes a federal civil rights violation.

    On January 23, 2023, an agreed order signed by the state of Tennessee's Attorney General's office was submitted to a federal judge.  That order concludes that Tennessee's "scheme" to deny individuals 18-20 years old who can otherwise lawfully possess a handgun from being able to get a permit or to carry in compliance with Tennessee's permitless carry law unconstitutional.  In this interview, WTN's Brian Wilson discusses with John Harris, TFA's executive director, the significance of that federal court decision as well as why it is that Tennessee does not have "constitutional carry" at all.

    In Tennessee, the constitution provides that the people elected legislators and the governor.   Those are two separate branches of government.  The legislators have the constitutional duty to enact laws that reflect the public policy decisions of the state.  In a constitutional republic, the legislature is typically closer to and more accountable to the people - and should be.  In contrast the governor is only an administrator.  It is not the job of the governor to set or determine public policy - the job of the governor is to implement and enforce the laws enacted by the legislature.

     Tennessee's constitution requires that elected officials, including the governor, the legislators, judges and local officials take an oath of office. That oath imposes on these individuals an affirmative duty to protect and defend the rights of individuals as protected by the constitutions of the state or the United States. Those rights include the rights that are recognized by the constitution and subject to the 2nd Amendment's “shall not be infringed” mandate. Tennessee law also makes it a Class E felony for a public official to engage in “official oppression”. Richard Archie discusses how elected officials who knowingly or intentionally breach their oath of office, perhaps by infringing your rights as protected by the 2nd Amendment, may be subject to criminal prosecution. If that is true, why is it that the state's district attorneys and/or the Tennessee Bureau of Investigation seem to never investigate this felony?

     In November 2022, a federal district court in Texas was asked to dismiss a federal criminal charge against an individual who had been arrested for being in possession of a handgun but who had an order of protection against him. Under federal law, a part of the Gun Control Act, the pending order of protection caused the man to be classified as a “prohibited person” relative to firearms ownership or possession. That status exposed him to federal felony charges.   TFA's Richard Archie reviews highlights from the Court's opinion.
