Walking in to hear the news today that Daniel Havili had been sentenced to 2 years and 9 months for the manslaughter of Fau Vake Was like being punched in the solar plexus myself. Fau and his brother ended up in a brief brawl against 4 strangers in May last year. The Vake brothers did not throw any punches themselves and were not the aggressors, prosecutors have repeatedly pointed out. Fau died. Hit by Daniel Havili. He fell and hit his head causing a brain bleed. As the judge noted he had no chance to defend himself. The blow is often described as a coward punch. I prefer killer hit. The CCTV footage clearly shows Fau standing with his arms at his side. Not in fight mode. Havili moved his weight to one side and then lashed out with a well-timed and well-judged punch that felled a Mixed Martial Arts professional instantly. Dan Hooker, the UFC fighter and mate of Fau Vake's, is horrified. He felt there was as much murderous intent in that one punch as in a flurry of 200. But the horror is in the sentence. A man went out, spoiled for a fight and killed someone and the consequence is under 3 years in jail. Perhaps less with parole. Crown Prosecutor Claire Paterson submitted Havili should have a starting point of five-and-a-half years in jail. But that was ignored. Perhaps the problem is in the charge. Manslaughter was not invented for brawlers. Manslaughter generally refers to accidental homicide arising from an unlawful act or failure to act, where death could not reasonably be expected. Can you argue that the severity of brawls these days means that death cannot be expected? We've seen it happen too many times. The City Kickboxing crew are horrified. They have argued all along that the law is wrong. And all along I have agreed. The senseless taking of a life by a drunk man with anger problems cannot be tolerated just like any murder.
Daniel Havili has been sentenced to two years and nine months in prison for his role in MMA fighter Fau Vake's death. Havili was one of the four men who attacked Vake and his brother in Auckland CBD and he threw a coward punch that knocked Vake to the ground. A man who punched a young MMA fighter in the head, has been sentenced to six months' home detention. Fau Vake later died and his friend has likened the sentence to a Covid-19 restriction - not justice. Last week Luke Mealamu of Mealamu Security, posted on his FB page about an incident, involving him & members being assaulted in the early hours of Sunday morning 4th July in Manukau. Luke was the victim of a Coward punch. This follows recent incidents such as the death of up & coming MMA fighter Fau Vake in May, who died in hospital after he was hit from behind on Symonds Street on 16 May, along with a number of incidents over recent years involving “Cowards punch”. Honestly I think we're too soft on blokes who throw coward punches and end up really hurting the person they've attack.You will have heard Mike Angove on Hosking's show this morning. He's the coach of an MMA fighter called Fau Vake, who was allegedly punched in the head from behind on Saturday night while waiting for a taxi.That young man, who is a father, is now in a coma, and according to his coaches it will take a miracle for him to survive.You can probably well understand why they want a tougher law to deal with people who throw punches like this. And we have had several calls in the past for this, from Winston Peters suggesting a mandatory eight year jail term to National's Matt King even trying to pass a law in 2018 that would jail these people for up to 20 years.Now I'm not convinced we need a new law, only because we already have the available laws to deal with it and we have seen them used. For example, the guy who allegedly killed another with a punch outside Te Papa in Wellington is now facing a manslaughter charge.Buy this is where I get a little worried. Most of the examples I've come across of these coward punch throwers is that they might be charged with something significant, but they often end up with quite light sentences Take Grenville McFarlane. He punched a teacher in Auckland while out on the town in 2013, killed him and ended up charged with manslaughter. Two years and four months in jail is what he got. Patrick Tarawa punched and killed a Northland granddad in a road rage incident. Charged with manslaughter. Got 10 months home detention and 400 hours community work. Now this is a small sample size, and there are factors we don't know that might've influenced the judge' thinking, but those are the example I found. What I didn't find online were examples of judges cracking on this crap. Compare it to Australia where they've handed sentences as long as 10 years for this.I'm not convinced we need a tougher law, simply because new laws don't really disincentives people when they're irrationally angry, and because we have existing laws to deal with it.But I think we would all like to see this taken seriously in the courts, because it is very serious for that young man's family right now.
