Understanding these distinctions is crucial, as the classification of a homicide directly impacts the charges, potential defenses, and sentences an individual may face.Homicide vs. Murder vs. ManslaughterIt's important to first clarify some key terms:Homicide is the broadest term, simply meaning the killing of a human being. It can also include killings caused by a person's reckless actions that demonstrate a depraved indifference to human life, even if there was no intent to kill. For example, shooting a gun into a crowd and killing someone, without a specific target in mind, would likely fall under second-degree murder.The Classifications of ManslaughterManslaughter is a less severe form of criminal homicide because it lacks the element of malice aforethought.Voluntary Manslaughter: This occurs when an intentional killing is committed in the "heat of passion". The key is that the killing was provoked by something that would cause a reasonable person to lose control, and there was no time for the person's emotions to cool down. An example might be finding your spouse in bed with another person and immediately killing one of them in a fit of rage.Involuntary Manslaughter: This is an unintentional killing resulting from recklessness or criminal negligence. This typically happens when a person's actions, while not intended to cause death, show a disregard for the safety of others. Driving drunk and causing a fatal accident is a common example of involuntary manslaughter.Non-Criminal Homicide: Justifiable and ExcusableNot all killings are criminal. The law recognizes certain situations where a homicide is considered justifiable or excusable.Justifiable Homicide is a killing that is legally sanctioned. In the ongoing battle against America's opioid epidemic, few cases have rocked the justice system as hard as the arrest and prosecution of Dr. Stan Xuhui Li, one of the deadliest pill-pushing doctors in U.S. history. At the heart of this historic case was former New York County Assistant District Attorney Charlotte Bismuth, whose relentless pursuit of justice helped bring down a man who had been exploiting the medical profession for profit, at the cost of human lives. The Start of a Historic Case In 2010, Bismuth, a young assistant district attorney, had just joined the Office of the Special Narcotics Prosecutor (OSNP) in New York City. That same year, a whistleblower's tip exposed suspicious activity at a Queens pain clinic run by Dr. S. Li. What followed was a sprawling investigation that would stretch over four years. According to investigators, Dr. Li was seeing over 70 patients a day, mostly on Saturdays, and trading prescriptions for cash. He routinely prescribed powerful opioids like oxycodone and anti-anxiety drugs like Xanax with little to no medical evaluation. Even when warned by emergency room doctors and families that his patients were dying, Dr. Li refused to stop. Over the next three years, Bismuth and her team built a case that would change legal precedent. In 2014, after a grueling four-month trial, a Manhattan jury found Dr. Li guilty on 198 counts, including Manslaughter in the Second Degree, Reckless Endangerment, and Criminal Sale of a Prescription for a Controlled Substance. He had even prescribed 24 different prescriptions to the man behind the infamous Medford pharmacy massacre. A 12-year-old boy who deliberately lit a house fire, in which a woman died, has been told his actions destroyed many lives, including his own. In the High Court at Palmerston North on Tuesday the boy, who is now 17, was sentenced for the woman's manslaughter. Reporter Jimmy Ellingham spoke to Lisa Owen.

Ricardo and Neusa Jones are from the Southern Brazilian city of Porto Alegre. Birth is their calling. But not just any birth. Home birth. Natural birth. Humanized birth. Ricardo Jones is an obstetrician. His wife, Neusa, is an obstetrics nurse. But they embrace the ancestral knowledge of midwives.But for their work, Ric and Neusa Jones are under attack. On March 27, 2025, Ric Jones was convicted of first-degree murder, 15 years after one of the thousands of babies he delivered died of congenital pneumonia in the hospital 24 hours shortly after the child was born at home.Ric Jones received a sentence of 14 years in prison. His wife, 11 years. Ric Jones spent three weeks in prison. He is now out while they await the decision over the appeal.But a movement has grown in their defense. Parents, midwives, doulas, and birth activists are standing up. They've denounced the case against them. They've denounced Ric Jones's imprisonment.
