In mid-December of 2023, the Texas Supreme Court resolved a high-profile abortion case in which a woman sought an emergency injunction to immunize her health-care providers from liability under Texas's strong anti-abortion laws. During the brief time that the matter was before that Court, it issued an “administrative stay” against further enforcement of the relevant court order. This episode considers the history of the “administrative stay” concept in federal court, where it originated and is reasonably well-developed, and then examines how well that federal-court concept transfers into the Texas state system. It concludes by urging cautious use of this tool, in order to properly balance the power of central and local courts as envisioned by Texas's highly decentralized constitution of 1876.

Trainer Vs. Subject Matter Expert #65 (2 of 2) Host Alpha Mike talks about two types of law enforcement training instructors. Trainer Vs. the Subject Matter Expert (SME), how agency use them. Trainer, a person who trains people (coach, instructor, teacher, tutor) Subject Matter Expert, also referred to as SME, is a person who has special skills or knowledge on a particular job or topic. SMEs are highly accessed by instructional designers to extract intelligence when developing courseware and learning programs. SMEs are frequently called upon to serve as guest lecturers or instructors for training. Three evaluations of Law Enforcement  (LE) training. 1. Adminstrative areas of instruction declared by the agency for the ranks. 2. State Objectives, area to be covered as mandated by State rules for LE officers. 3. Federal, areas of training with any condition indicated by the U.S. Department of Justice.  Examples (Oversight, Court Order, or Condition on funding) Trainer: Studies Mistakes  SME Studies the excellence of the evelution SME: Create an application method and study the results of the application.  SME, conduct empirical studies of training methods both quantitative and qualitative approaches. Hypotheses tested in an analytical study.  To become a SME one must have, experience, knowledge, lived experience, excellence in record, and educations. Maintains a general knowledge of all areas of law enforcement to provide assistance to other instructors in the presentation of their assigned areas of instruction. Minimum Qualifications A Bachelor's degree from an accredited college or university.* ? years law enforcement experience.  Must have included experience as an instructor, including experience in both classroom and practical scenario based training. Police Instructor Certification or equivalent.* Four (4) years of experience in the practical application of Constitutional and/or Criminal Law for Law Enforcement Officers.
