Mr. Ramirez was living with his sister and brother-in-law at Avalon Mobile Home Park. Avalon had experienced multiple crimes in the years before Israel's death. While home from work for lunch, Israel and his sister saw a thief stealing his car from his home. Israel reacted quickly and confronted the thief, who shot and killed him. Avalon failed to have reasonable security in place to protect its residents from foreseeable crimes. At trial, Avalon tried to blame Israel for his own death, claiming he should not have reacted to the theft of his vehicle. The defense claimed Israel acted unreasonably for defending his property. Our firm introduced evidence that the husband of Avalon's property manager had left his own home to confront trespassers with a loaded gun on a previous occasion, contrasting the defense's blaming Israel while celebrating a different resident who survived a similar encounter. After hearing from Israel's family members, including his children, the jury determined the value of his lost life, pain and suffering and awarded $31 million against Avalon Mobile Home Park." The Sixth Circuit Court of Appeals denied Enbridge Energy's request for the Line 5 lawsuit Nessel v. Enbridge to receive a rehearing in federal court, returning the case to state court. The court Enbridge had missed the 30-day deadline after Nessel filed the lawsuit in June 2019 to appeal moving the case to federal court, and that it relied on improper arguments when doing so. The Canadian company had proposed boring a tunnel under the Straits of Mackinac to house the pipeline more than five years ago. With a conservative majority on the U.S. Supreme Court, activists are increasingly looking at states to protect – and even expand – rights. But will this strategy work? We'll talk to legal experts about how state courts and constitutions are increasingly becoming battle grounds for preserving or expanding civil rights, and what the impact in California and neighboring states might be.

June 18th Court Leader's Advantage Podcast Episode Civil filings are falling.  They have been for some time.  In fact, most court filings have been on a slow decline.  In 2018, The National Center for State Courts put out a bulletin stating that nationally every major case category had declined from 2008 to 2016. There are indications that in some states (California for example), the decline in civil filings started as far back as 1980.  This gradual decline seems little affected by economics, court organization, the presence or absence of court self-help centers, the state of the local bar, the type of case management system the court uses, or the amount of filing fees charged.  With the possible exception of Texas, this decline appears widespread.  This inevitably leads to the critical yet unanswered question “Why is this happening?” This month we're talking about a new book just out by Alan Carlson and John Greacen called What is Happening to State Trial Court Civil Filings?  We will explore questions including: · Why didn't we court professionals see this coming a long time ago? · Are there changes in our society that are leading to changes in how people view the courts? · Do we have any idea how people are getting their disputes resolved if it is not by going through the courts? · Are courts actually ready to do the work to find out what is happening with filings?   Today's Panel  Alan Carlson: retired court administrator of the Superior Court in Orange County, California; John Greacen: nationally known consultant on courts and court administration; Marcus Reinkensmeyer: Deputy State Court Administrator for the Arizona Administrative Office of the Courts.

Today on the podcast, Robin and Lester interview Judge Alvin Wong, Georgia's first Asian American judge.   Guest Bio Judge Wong came to Richmond, Va. from Hong Kong when he was 14. His father enrolled him at Fishburne Military Academy in Waynesboro, Va., shook his hand and said he'd “see him next summer.” He followed a classmate from Fishburne to Auburn University without even knowing where it was. He graduated early and moved to Atlanta. He started taking night classes at John Marshal Law School and passed the Georgia Bar in 1976. He hung out a shingle and worked as a trial lawyer and then was a partner at Gambrell & Stolz (now Baker Donelson) for 20 years. Judge Wong was elected to the State Court of DeKalb County in 1999 and since his election in 1999, he's been reelected, unopposed, to six consecutive terms. With his election in 1999, he became the first Asian American judge in Georgia history. At that time, Asians made up less than two percent of registered voters in DeKalb County. In 2004, Judge Wong co-founded a DUI court to help people, calling it one of the most rewarding things he's done. He also sits on the board of the Lifeline Animal Project, a nonprofit that helps turn Atlanta animal shelters into no-kill shelters. He also brings to the courthouse Coco, a dachshund-chihuahua mix he rescued a decade ago. Jurors love to meet her after the trial is over. Judge Wong was elected by his peers in 2021 as president of the Georgia Council of State Court Judges, overseeing the entire state. His election marked the first time an Asian American served as president of any judicial council in Georgia. In 1993, Judge Wong and Professor Natsu Saito of Georgia State University Law School combed the State Bar Directory to find 10 attorneys to start an Asian American Bar Association. Today, the Georgia Asian Pacific Bar Association (GAPABA) has 750 members. In 2014, GAPABA named its top prize the “Judge Alvin T. Wong Pioneer Award”. It is given in his honor to a lawyer who demonstrates leadership to pave the way for the advancement of APA attorneys. He is the recipient of the 2017 Traditions of Excellence Award presented by the General Practice and Trial Section of the State Bar of Georgia. He received the 2022 Randolph Thrower Lifetime Achievement Award presented by the Committee to Promote Inclusion in the Profession of the State Bar of Georgia. Judge Wong serves the ABA Standing Committee on Ethics and Professional Responsibility – Judges Advisory Committee and as a Fernbank Museum of Natural History trustee and NAPABA (the National Asian Bar) Law Foundation board member, mentoring future leaders as co-director of its Thomas Tang National Moot Court Competition.

Last week, Colorado's Supreme Court ruled that former President Donald Trump will be disqualified from the 2024 primary ballot, arguing that his involvement on January 6th conflicted with the 14th Amendment's “insurrectionist ban.” Michigan's Supreme Court heard a similar case and ruled that Trump would remain on the ballot. Colorado's Secretary of State, Jena Griswold, says that the former president's name will appear on the ballot unless a move by the U.S. Supreme Court gives the state of Colorado the authority. Professor of Law at George Washington University, Jonathan Turley, joins to break down what the decision in Colorado means for the election and whether or not the states have the legal right to decide who will appear on the ballot. Alice Marie Johnson spent 21 years in prison after she was sentenced to life without parole in 1997 for cocaine trafficking in Memphis, Tennessee. In 2018, after some public advocacy on her behalf from celebrity Kim Kardashian, President Trump granted Alice clemency and had her released. Today we revisit our interview with Alice Marie Johnson, where she discussed her past, her time in prison, and how she is using her freedom to help advocate for criminal justice reform to aid other folks just like her. When you get to the part of the ballot that asks you to vote for a local judge, have you ever thought, “am I qualified to make this decision?” While federal court trial and appellate judges are appointed and enjoy lifetime tenures, state court judges often have to run for election or re-election, and most voters have scant information on the candidates. In California, you can run to be a judge if you have been a lawyer for ten years, no trial experience necessary. And while we expect judges to be neutral, can they be when they have to run for office and take campaign donations? In our next installment of our “Doing Democracy” series, we look at what it means when judges have to stand for election. Guests: Michael S Kang, professor, Northwestern School of Law. Kang is the co-author of "Free to Judge: The Power of Campaign Money in Judicial Elections."
