Rahimi, in which the Court will decide the constitutionality of a federal law that criminalizes the possession of firearms by individuals on whom state courts have imposed domestic violence protective orders. This case came to the Court following its June 2022 ruling in New York State Rifle & Pistol Association v. Bruen. In that case, the Court determined that whether a law violates the Second Amendment depends on whether there is a “representative historical analogue” for the contemporary law. Amanda Tyler, the Shannon Cecil Turner Professor of Law at the University of California, Berkeley School of Law, argued in a recent article in Lawfare that the many laws disarming loyalists that existed at the time of the Founding serve as a set of “historical analogues” required by Bruen to demonstrate the constitutionality of the statute at issue in Rahimi—a claim which has been disputed by Rahimi's lawyers. Jako malé dítě tak strávila asi rok na cestě – s nedostatkem vody i jídla. „Nejtěžší byla ta hrozná nejistota. Nemáte kontrolu nad vlastním životem. Všechno řídí někdo jiný a to jsou převaděči. Nevíte, kde skončíte a musíte jim věřit,“ popisuje novinářka afghánského původu, jak s rodinou museli často přespávat třeba i v chlívcích pro dobytek nebo bez dostatku zásob strávili třeba i dva týdny v lese. Cesta začala rozhodnutím, které podle ní nebylo volbou, jak si spousta lidí představuje. „Buď žijete, nebo nežijete. A člověk má tendenci přežít,“ popisuje nutnost opustit Afghánistán kvůli problémům s vládou Tálibánu. Po příchodu do Česka strávila s příbuznými skoro čtyři roky v uprchlických zařízeních, která svým režimem podle Rahimi často trochu připomínala vězení – pokoje s mřížemi, nárok pouze na deset minut denně na dvorku a žádné hračky pro děti, které si tak musely vystačit třeba jen s propiskou a papírem. Na tuhle dobu nemá přesto novinářka špatné vzpomínky, nejvíce si ale vybavuje stres svých rodičů a dalších dospělých – ze zákonných důvodů nemohli pracovat, takže neustále čekali, co s nimi bude. V rozhovoru s Čestmírem Strakatým mluví Rahimi ale i o tom, co jí v nové zemi chybělo – rodný jazyk, perská literatura, afghánské jídlo nebo babička. Vzpomíná na období, kdy si ji lidé pletli s Romkou a po roce 2015 začali klást otázky na islám a muslimy. „V tu chvíli jsem přemýšlela: Modlím se, nemodlím se? Mám se modlit, nemám se modlit?,“ vysvětluje Rahimi, jak se začala víc zajímat o sebe a hledat odpovědi, protože cítila, že by je měla umět dát. Novinářka mluví taky o fotbale, který ji fascinuje svou paradoxní povahou. „Je to jednoduchá hra – víte, co je cílem, a moc toho k ní nepotřebujete. Já si v dětství vyráběla míč z hadrů nebo plastu,“ vzpomíná, ale také dodává, že jde o strašně složitý svět, když sledujete, jak se skládají týmy, jakou roli hrají peníze a politika a jak se ovlivňují zápasy. Dnes se kromě novinařiny věnuje i studiu terapie, ke které má blízko nejen díky vlastní zkušenosti, ale i novinářské práci. Komu přesně chce pomoci a proč je takový rozdíl vést terapii v angličtině nebo perštině? Jak náročné je někdy debatovat o migraci a jak dnes vnímá náboženství, které ji provázelo dětstvím? Jak se žije jejím příbuzným v rodné zemi a proč si myslí, že změna musí přijít zevnitř – ať už v Íránu, nebo v Afghánistánu? Poslechněte si celý rozhovor.
