Attorney Julia Olson founded the nonprofit public interest law firm Our Children’s Trust in 2010 in Eugene. Five years later, she filed a lawsuit on behalf of Kelsey Juliana and 20 other youth activists in Oregon and elsewhere. Their contention was simple on its face: youth have a right to a stable climate, just as they have a right to clean water and clean air. It used the public trust doctrine in a novel way at the time. Since the suit was filed in 2015, Juliana v. U.S. has been in and out of district and appeals courts and was cleared to go to trial in 2023. But last year, the 9th Circuit Court of Appeals granted the federal government's motion to dismiss the case. The U.S. Supreme Court recently declined to intervene, but dismissed the case “without prejudice,” enabling the case to potentially be filed at a later time. Olson joins us to talk about what the last decade has shown her and the "Juliana 21" about the most effective ways to challenge climate change policy in the U.S. today.

Aaron Freiwald, Managing Partner of Freiwald Law and host of the weekly podcast series Good Law | Bad Law, is joined by Kelsey Juliana and Attorney Julia Olson to talk about a federal lawsuit they have brought against the United States Government regarding Climate Change.   Kelsey Juliana is a 21-year old college student and the lead plaintiff in the case that has been dubbed “Youth v. Gov” and that some are also calling the “biggest lawsuit on the planet.”  Kelsey, along with 20 other children, filed suit in federal court in Oregon claiming that U.S. energy policies over the last 50 years that have favored fossil fuel companies and fossil fuel use have contributed to the climate change crisis we now face.  As a result, Kelsey and the others claim, the U.S. has violated their fundamental constitutional rights.   Julia Olson is the lead attorney on this roller coaster of a case and certainly has had her work cut out for her. Since the start of litigation in 2015, there has been significant pushback from the U.S. government and the Trump Administration. But the Courts keep rejecting the Justice Department’s efforts to have the case thrown out.  Recently, Kelsey and Julia won again as the Court of Appeals for the Ninth Circuit rejected the Justice Department’s latest motion to derail the case.   Now the case may actually go to trial.   Kelsey is a passionate advocate and explains why the youth of our country need to stand up and take action.  Is this the beginning of a youth movement?  It just might be.  Listen in as Aaron, Julia, and Kelsey discuss this incredible lawsuit and the impact that young people can have if they put their hearts and minds into something they truly believe in. The very agencies created to protect our environment have been hijacked by the polluting industries they were meant to regulate. It may just turn out that the judicial system, our children and their children will save us from ourselves. The new legal framework for this crusade against global warming is called atmospheric trust litigation. It takes the fate of the Earth into the courts, arguing that the planet’s atmosphere – its air, water, land, plants and animals — are the responsibility of government, held in its trust to insure the survival of all generations to come. It’s the strategy being used by Bill’s recent guest, Kelsey Juliana, a co-plaintiff in a major lawsuit spearheaded by Our Children’s Trust, that could force the state of Oregon to take a more aggressive stance against the carbon emissions. It’s the brainchild of Mary Christina Wood, a legal scholar who wrote the book, Nature’s Trust, tracing this public trust doctrine all the way back to ancient Rome. Wood tells Bill: “If this nation relies on a stable climate system, and the very habitability of this nation and all of the liberties of young people and their survival interests are at stake, the courts need to force the agencies and the legislatures to simply do their job.”
