This Day in Legal History: Constitutional Convention AssemblesOn May 14, 1787, a pivotal moment unfolded in American history as delegates from each state began to gather in Philadelphia for what would be known as the Constitutional Convention. This assembly was critical in shaping the nation's future, aimed at addressing the deficiencies of the Articles of Confederation—the loose framework that initially bound the states together after independence.As the delegates arrived, the stakes were incredibly high. The existing government structure under the Articles was proving inadequate in managing various critical issues, such as interstate disputes and financial instability. The Philadelphia meeting was convened to create a more robust federal government while ensuring that individual liberties were not infringed upon.Notably, every state except Rhode Island sent representatives to the Convention. Among the attendees were some of the most distinguished figures of the era, including George Washington, who was unanimously elected as the president of the convention, and James Madison, now considered the "Father of the Constitution" due to his pivotal role in drafting the document.The convention sessions were held in strict secrecy, a decision made to foster open debate and prevent external influences. The result of the intense deliberations, which continued until September 17, was the creation of a new Constitution. This document established a stronger federal government with separate executive, legislative, and judicial branches, fundamentally changing the direction of the United States.The ratification process that followed was another intense debate, reflective of the diverse viewpoints within the states about the balance of power between state and federal authorities. The Federalist Papers, written by Alexander Hamilton, James Madison, and John Jay, played a crucial role in persuading the public and state legislatures to adopt the new Constitution.Today, the Constitution remains a living document, central to American law and governance, illustrating the enduring legacy of the decisions made during those historic months in Philadelphia. Menendez, a New Jersey Democrat, has denied wrongdoing, pleading not guilty to 16 charges, including bribery, fraud, acting as a foreign agent, and obstruction. The trial also involves two New Jersey businessmen, Wael Hana and Fred Daibes, and Menendez's wife, Nadine, who will be tried separately due to medical reasons.The accusations detail that Senator Menendez accepted substantial bribes, including cash, gold bars, and a luxury car, in return for political favors to the governments of Egypt and Qatar. The FBI discovered much of the cash hidden at the Menendezes' home. The court granted a February request from the Justice Department to dismiss the case, known as Juliana v. US, directing Judge Ann Aiken of the U.S. District Court for the District of Oregon to terminate it. This lawsuit, aiming for government accountability on climate action, has seen setbacks before, including a 2020 dismissal where the plaintiffs' demands for more aggressive government intervention against global warming were deemed beyond judicial capability to grant.The plaintiffs, represented by Our Children's Trust, are now considering limited options, such as requesting a full panel rehearing at the Ninth Circuit or potentially escalating the matter to the U.S. Supreme Court. On this week's episode of Lever Time, Julia Rock and Frank Cappello speak with environmental lawyer Julia Olson to discuss a recent historic win for young climate activists who she represents in Montana. This past Monday, a judge in Montana ruled that young people are entitled to a “clean and healthful” environment. The case, known as Held v. Montana, included 16 plaintiffs ages 5 to 22, who testified that the state government's pro-fossil fuel policies were unconstitutional. Held v. Montana was the first of several youth-led U.S. climate lawsuits to make it to trial. Olson is the executive director and lead counsel for Our Children's Trust, a nonprofit public interest law firm that represents plaintiffs in a number of these youth-led state climate cases as well as in a federal lawsuit, Juliana v. Youth-Led Climate LitigationWorldwide, litigants are turning to the courts as a forum for fighting climate change, filing lawsuits against governments in an attempt to force climate action. Plaintiffs in these lawsuits are often children and young adults, who represent those most affected by government climate inaction. A notable early example of youth-led litigation related to climate change was in the Philippines in the 1990s, where forty-three students sued the Philippine government to protect their village's forest. Though the case was initially dismissed in lower courts on the ground that the students were children and did not have legal standing to sue, the students ultimately won their case and deforestation was halted. In the United States in 2015, twenty-one young people, the organization Earth Guardians, and climate scientist James Hansen (collectively, “plaintiffs”), represented by lawyers from the organization Our Children's Trust, sued the U.S. government in a case called Juliana v. United States of America. The plaintiffs alleged that the U.S. government, in not taking sufficient action to fight climate change, knowingly violated their Fifth Amendment due process rights to life, liberty and property, and knowingly violated its commitment to protect public lands. In 2020, the Ninth Circuit Court of Appeals dismissed the case on the ground that the legislative and executive branches have the power to address climate change, not the judicial system. Still, despite the ruling, Juliana v. United States catalyzed a climate litigation movement across the country and world, and a documentary film about the case increased its impact. The Ninth Circuit's ruling did not end the case, which was sent back to the district court for further proceedings. In June 2023, the district court granted the plaintiffs' motion for leave to amend their complaint. Plaintiffs are hoping to survive additional motions to dismiss so that the case can proceed to trial.   Our Children's Trust has sued state governments on behalf of young people in all fifty states. Although most of those cases have been dismissed, the first of these cases to go to trial was Held v. Montana in June 2023. Additionally, in September 2023, Navahine F. v. Hawaii Department of Transportation is set to go to trial. These trials are the first in the United States involving youth-led constitutional climate cases, with the plaintiffs both using language from Montana's and Hawaii's constitutions to make their case. Is Climate Change a Question for the Courts?This is an ongoing debate. The Ninth Circuit Court of Appeals rejected the Juliana v. United States case in 2020, with the majority opinion concluding that climate change is an issue for Congress and the Executive Branch to handle, rather than the judicial system. But Hawaii's First Circuit Judge Jeffrey Crabtree argued, in response to lawyers for the Hawaii Department of Transportation who made a similar argument, that Navahine F. v. Hawaii Department of Transportation should be allowed to go to trial. Judge Crabtree wrote that “the courts unequivocally have an important and long-recognized role in interpreting and defending constitutional guarantees.” A separate and difficult legal question concerns the nature and extent of the public trust doctrine and what duty might apply to the government. The courts will need to wrestle with that set of issues if the cases reach the trial stage. Who is Julia Olson?Julia Olson is Executive Director and Chief Legal Counsel of Our Children's Trust, the organization representing the youth plaintiffs in the climate change litigation discussed in this article. She earned her law degree (JD) from the University of California College of Law, San Francisco (then known as UC Hastings) in 1997 and began her legal career representing grassroots conservation groups working to protect the environment, organic agriculture, and human health. Though the case was initially dismissed in lower courts on the ground that the students were children and did not have legal standing to sue, the students ultimately won their case and deforestation was halted. In the United States in 2015, twenty-one young people, the organization Earth Guardians, and climate scientist James Hansen (collectively, “plaintiffs”), represented by lawyers from the organization Our Children's Trust, sued the U.S. government in a case called Juliana v. United States of America. The plaintiffs alleged that the U.S. government, in not taking sufficient action to fight climate change, knowingly violated their Fifth Amendment due process rights to life, liberty and property, and knowingly violated its commitment to protect public lands. In 2020, the Ninth Circuit Court of Appeals dismissed the case on the ground that the legislative and executive branches have the power to address climate change, not the judicial system. Still, despite the ruling, Juliana v. United States catalyzed a climate litigation movement across the country and world, and a documentary film about the case increased its impact. The Ninth Circuit's ruling did not end the case, which was sent back to the district court for further proceedings. In June 2023, the district court granted the plaintiffs' motion for leave to amend their complaint. Plaintiffs are hoping to survive additional motions to dismiss so that the case can proceed to trial.   Our Children's Trust has sued state governments on behalf of young people in all fifty states. Although most of those cases have been dismissed, the first of these cases to go to trial was Held v. Montana in June 2023. Additionally, in September 2023, Navahine F. v. Hawaii Department of Transportation is set to go to trial. These trials are the first in the United States involving youth-led constitutional climate cases, with the plaintiffs both using language from Montana's and Hawaii's constitutions to make their case. Is Climate Change a Question for the Courts?This is an ongoing debate. The Ninth Circuit Court of Appeals rejected the Juliana v. United States case in 2020, with the majority opinion concluding that climate change is an issue for Congress and the Executive Branch to handle, rather than the judicial system. But Hawaii's First Circuit Judge Jeffrey Crabtree argued, in response to lawyers for the Hawaii Department of Transportation who made a similar argument, that Navahine F. v. Hawaii Department of Transportation should be allowed to go to trial. Judge Crabtree wrote that “the courts unequivocally have an important and long-recognized role in interpreting and defending constitutional guarantees.” A separate and difficult legal question concerns the nature and extent of the public trust doctrine and what duty might apply to the government. The courts will need to wrestle with that set of issues if the cases reach the trial stage. Who is Julia Olson?Julia Olson is Executive Director and Chief Legal Counsel of Our Children's Trust, the organization representing the youth plaintiffs in the climate change litigation discussed in this article. She earned her law degree (JD) from the University of California College of Law, San Francisco (then known as UC Hastings) in 1997 and began her legal career representing grassroots conservation groups working to protect the environment, organic agriculture, and human health. My guest this week recently posted a before and after transformation picture on Instagram, and wrote this in the caption: “From day one I skipped over feelings of disgust with my body, lack of self-love, negative self-talk, and went straight to being the Queenager in my heart and soul.  I loved myself, I was healthy, vibrant, disciplined, committed, and had already shapeshifted inside.  The outside had to catch up. It would take time.  Years! I accepted the way reality manifests, slowly.  Waiting for the chess pieces on my life board to be strategically placed by Universal Laws that exist whether I saw them or not.  On Day One, I radically altered my thoughts.  I am healthy, strong, and lean no matter what my before picture showed.  My reality inside mattered.  Mindset. Although many climate conversations talk about impacts on future generations, all too often those younger generations are not at the table or in the room. So how are young people taking charge of their climate future? For Isha Clarke, a high school student and activist from Oakland, California, by speaking truth to the senior U.S. Senator from her state. “I think that truth is respectful and that you can speak truth in a way that is compassionate and authentic,” says Clarke, who recently gained fame for a viral video in which she confronts Democratic Senator Dianne Feinstein over the Green New Deal. “I think the conversation now isn’t really about Senator Feinstein anymore,” Clarke says as she reflects on that experience and the ensuing coverage, “it's really about politicians in general and power holders in general, who aren’t and haven't been taking the necessary steps to reverse this climate crisis. Feeling a similar frustration at her elders’ failure to act more urgently, 14-year old Sarah Goody organized a climate strike in San Francisco. “Why study for a future that’s not gonna exist?” says Sarah in response to passers-by who question why she’s sitting on a sidewalk rather than in a classroom, “I need to be here now and fighting now for my future.” Sitting alone outside iconic buildings can be a lonely endeavor, so other slightly-less young activists have found their climate calling by getting involved in more organized movements. “I see [it] as a civic duty to be involve to be socially engaged in whatever way I can,” says Morrisa Zuckerman, Bay Area chapter coordinator for the Sunrise Movement, the grassroots organization behind the Green New Deal. She and her colleagues have been pressing lawmakers and candidates to make climate action a top priority – and it’s working. “This Democratic presidential primary is talking about climate change in a way that I don't think any of us necessarily expected,” enthuses Ben Wessel, Youth Vote Director at NextGen America, the environmental advocacy organization founded by billionaire activist Tom Steyer. Wessel has been impressed by the diversity of motivations that have recently been drawing young people to climate politics. “This is one intersectional movement that has to address our racial injustices our climate injustices and our economic injustices,” Wessel says, “I actually think the Democratic primary electorate is recognizing that more than ever before.” Elections have consequences; but without more fundamental changes, shifting political winds can erase hard-fought carbon reductions. That’s why for Julia Olson, Executive Director of Our Children's Trust, the most effective climate solution lies in judicial rather than legislative action. Olson is chief legal counsel for plaintiffs in Juliana versus United States, the lawsuit brought by 21 young people accusing the federal government of violating their fundamental rights under the Fifth Amendment to life, liberty and property by knowingly promoting and subsidizing an energy system that damages climate. “What we hope to do through our case in lifting up the voice of youth in the Judiciary,” Olson explains, “is to secure the binding constitutional mandate that forces the people in the presidency and in the legislature to actually adopt laws and policies that comply with its constitutional obligation.” Guests: Isha Clarke, Student Activist Sarah Goody, Student Activist Julia Olson, Executive Director at Our Children's Trust; Chief Legal Counsel for plaintiffs in Juliana v. Aaron Freiwald, Managing Partner of Freiwald Law and host of the weekly podcast series Good Law | Bad Law, is joined by Kelsey Juliana and Attorney Julia Olson to talk about a federal lawsuit they have brought against the United States Government regarding Climate Change.   Kelsey Juliana is a 21-year old college student and the lead plaintiff in the case that has been dubbed “Youth v. Gov” and that some are also calling the “biggest lawsuit on the planet.”  Kelsey, along with 20 other children, filed suit in federal court in Oregon claiming that U.S. energy policies over the last 50 years that have favored fossil fuel companies and fossil fuel use have contributed to the climate change crisis we now face.  As a result, Kelsey and the others claim, the U.S. has violated their fundamental constitutional rights.   Julia Olson is the lead attorney on this roller coaster of a case and certainly has had her work cut out for her. Since the start of litigation in 2015, there has been significant pushback from the U.S. government and the Trump Administration. But the Courts keep rejecting the Justice Department’s efforts to have the case thrown out.  Recently, Kelsey and Julia won again as the Court of Appeals for the Ninth Circuit rejected the Justice Department’s latest motion to derail the case.   Now the case may actually go to trial.   Kelsey is a passionate advocate and explains why the youth of our country need to stand up and take action.  Is this the beginning of a youth movement?  It just might be.  Listen in as Aaron, Julia, and Kelsey discuss this incredible lawsuit and the impact that young people can have if they put their hearts and minds into something they truly believe in.
