Send us a textTodd Zwicky, professor at George Mason's Scalia Law School, challenges some conventional legal doctrine, taking up the views of Bruno Leone and Friedrich Hayek. What if the legal world has underestimated the power of spontaneous order? Todd's intellectual journey sheds light on how these groundbreaking ideas contrast sharply with the dominant constructivist views shaping contemporary legal thought. Todd offers perspectives on the role of intuition and reasonableness in the courtroom, inspired by the legacies of Leone and Hayek. Uncover the hidden parallels between market dynamics and legal systems, emphasizing the fluidity of Roman law as a process of discovery. https://youtu.be/OrMnU-xyz1Y A country club or a night club not only provide a physical space for leisure, but they also have rules of entry and conduct. The same is true of places of business or living like shopping malls, apartment complexes, stock exchanges, and financial intermediaries. eBay, for example, is a club that facilitates trade with reputation mechanisms and dispute resolution services. It evaluates the marginal benefits and marginal costs of having various rules or dispute resolution mechanisms and seeks to make its market as attractive as possible. American Express is another type of club that helps ensure that consumers get what they pay for and merchants get paid. Most people don't think of their credit card as a rule enforcing club, but it is. A merchant that overcharges customers or a customer who does not pay his bills gets kicked out of the club and that encourages honest behavior. - Edward Stringham, How Private Governance Made the Modern World Possible
Can law, order, and defense be provided on the market? Why can't they be normal goods? We are joined by economist Edward Stringham to discuss his fascinating work on free market anarchism and private governance. Stringham examines the economic of government from an Austrian perspective, and clearly shows how the world is increasingly relying on private voluntary legal and defense services rather than inefficient monopolies. We also apply these ideas to examine the concept of public health, and Stringham's work at the American Institute for Economic Research on the Great Barrington Declaration.ReferencesBook: Private Governance: Creating Order in Economic and Social Life - https://www.amazon.com/Private-Governance-Creating-Economic-Social/dp/0199365164 Book: Anarchy and The Law: The Political Economy of Choice - https://www.amazon.com/Anarchy-Law-Political-Economy-Independent/dp/1412805791 Great Barrington Declaration - https://gbdeclaration.org/ SSRN papers - https://papers.ssrn.com/sol3/cf_dev/AbsByAuth.cfm?per_id=685664 Coronavirus and Economic Crisis, AIER - https://www.aier.org/product/coronavirus-and-economic-crisis/ Private Policing in San Francisco - https://www.independent.org/publications/article.asp?id=2672 Edward's Twitter - https://twitter.com/edstringham Edward's Website - https://edwardpeterstringham.wordpress.com/ Edward's Profile on AIER - https://www.aier.org/people/edward-peter-stringham/ Enjoyed this episode? Michael is joined by Edward Stringham, President of the American Institute for Economic Research and the Davis Professor of Economic Innovation at Trinity College, for a relevant revelation on how the current state of social distancing was birthed through a school science fair project. Edward effectively breaks down the faulty logic of popular social simulations, by humanizing the hypothetical "agents" used in models with both problems and choices we currently face in the real world, demonstrating just how economically irresponsible the collective response to a pandemic has been.Edward Stringhamhttps://twitter.com/edstringhamhttps://www.aier.org/staff/edward-peter-stringham/Anarchy and the Law: https://www.amazon.com/dp/1412805791/Private Governance: https://www.amazon.com/dp/0199365164/Michael MaliceOrder THE NEW RIGHT: https://amzn.to/2IFFCCuOrder DEAR READER: https://t.co/vZfTVkK6qf?amp=1https://twitter.com/michaelmalicehttps://instagram.com/michaelmalicehttps://malice.locals.com https://youtube.com/michaelmaliceofficialIntro song: "Out of Reach" by Legendary House Catshttps://thelegendaryhousecats.bandcamp.com/PLEASE VISIT OUR SPONSORSDo you like sex but have trouble performing? Post by Skyler J. Collins (Editor). This episode features an interview of economics professor Edward Stringham from 2015 by Jeff Diest, host of the Human Action podcast (formerly Mises Weekends). Edward is the author of a book called Private Governance: Creating Order in Economic and Social Life, where he looks back at the history of private legal systems, and in so doing demolishes the idea that only the state can manage and adjudicate human conflicts. Today, Edward gives some concrete, real-world examples of how private governance operates in our statist world. If you're interested in Rothbardian and Hoppean anarcho-capitalism, you'll find Edward's book a great addition to your library, and you'll enjoy hearing this interview.

Today Todd is joined by the President of the American Institute for Economic Research, Edward Stringham. In this introductory interview, he details his mission at AIER and describes, for example, why "price gouging" amid the coronavirus pandemic is actually important and necessary to make sure the supply of goods reaches the people in most need.

Do we even need the Federal Reserve? Whether on the political left, right, or in the middle, virtually everybody thinks we do. After all, without the Fed, we'll have wild economic swings and crashes. Economist Edward Stringham disagrees. In this It's Your Dime Interview, he talks about it with host Mike Maharrey and makes the case that the economy would function just fine without a central bank pulling strings. In fact, as he explains, the Fed actually stirs up economic chaos. TOPICS DISCUSSED How the Fed messes up our money. Are all of the rules and regulations governing economic activity a product of central planning or legislation? To what extent does privately produced and enforced governance play a role? On this throwback episode of the Hayek Program Podcast, Edward Stringham argues in a panel discussion of his book "Private Governance" that much of what is orderly in the economy can actually be attributed to governing mechanisms devised and enforced by private groups and individuals. Hayek Program director Peter Boettke moderates the discussion as Edward Stringham is joined on the panel by Jason Brennan and Bruce Benson. CC Music: Twisterium
