For decades, he's exposed the horrific genocide of Indigenous children in church-run Indian Residential Schools, uncovering a dark campaign of abuse, murder, and cultural annihilation with a staggering 50% death rate. At great personal cost - his career, family, and reputation - Kevin sparked a global movement, becoming a beacon for survivors and a thorn in the side of the powerful.In the 1990s, his discoveries in Port Alberni, British Columbia, shattered his world and ignited his mission. He convened the first independent Tribunal into residential school crimes in 1998, founded The Truth Commission into Genocide in Canada in 2000, authored ‘Hidden from History: The Canadian Holocaust in 2001', and released the award-winning documentary ‘Unrepentant' in 2007. His work forced Canada's 2008 apology, though his name was erased from the narrative.Undaunted, Kevin co-founded the International Tribunal into Crimes of Church and State (ITCCS) in 2010, uniting survivors across 26 countries. His efforts led to the 2011 excavation of children's bones in Brantford, Ontario, and the 2012 prosecution of Pope Benedict, contributing to the pontiff's historic resignation. Despite blacklisting, smear campaigns, and state persecution - including a fraudulent 2021 COVID order targeting him - Kevin persists. He's authored over a dozen books, founded the Republic of Kanata in 2015, and earned two Nobel Peace Prize nominations. Prof. Prest discusses Blackstone's formative years in mid-18th-century London and at Pembroke College, Oxford, where a classical education, Enlightenment thought, and legal scholarship shaped his intellectual path. He describes Blackstone's early legal and academic career, including his role as the first Vinerian Professor of English Law and author of An Analysis of the Laws of England. Prest explores how Blackstone's Commentaries on the Laws of England brought clarity and coherence to England's centuries old legal tradition, drawing from foundational documents like Magna Carta and formative figures such as Bracton, Fortescue, and Coke. It also discusses various defenses that can affect the enforceability of contracts, providing a comprehensive overview for those preparing for law school exams or practicing in the field.TakeawaysContract formation is critical for law students and practitioners.Mutual assent is essential for a valid contract.An offer must be clear and definite to be valid.Consideration must involve a bargain for exchange.Capacity to contract is necessary for enforceability.Legality of the contract's purpose is crucial.Defenses like misrepresentation can void a contract.The UCC provides flexibility in contract formation.Common law and UCC differ in their approach to contracts.Understanding these elements is foundational for contract analysis.A contract is a legally enforceable agreement between two or more parties that creates mutual obligations. It governs how these obligations are created, modified, enforced, and extinguished.The two principal sources are Common Law, governing service agreements and real estate, and Article Two of the U.C.C., governing contracts for the sale of goods.Mutual assent means the parties agree to the same thing in the same sense. The objective theory means this is determined by a party's outward expressions and conduct, not their secret intentions.A valid offer requires intent, reasonably definite terms, and communication to the offeree.An offer can be terminated by revocation, rejection, counteroffer, lapse of time, or death/incapacity of a party.The Mirror Image Rule states that an acceptance must exactly match the terms of the offer. If it introduces different or additional terms, it is a counteroffer.Yes, under U.C.C. § 2-207, an acceptance with additional or different terms can still form a contract unless it is expressly conditional on assent to the new terms.Consideration is the legal term for what each party gives or promises to give in exchange for the other party's promise; it is a bargained-for exchange of something of legal value.Past consideration and the preexisting duty rule are two doctrines that limit what qualifies as consideration.The Statute of Frauds requires certain contracts to be in writing to be enforceable. Here's a summary: Performance and Obligations: Conditions are events that must occur before a party's performance is due. Express conditions are explicitly stated in the contract. Failure to meet these discharges the obligation, unless waived. Implied conditions are supplied by courts for fairness. Substantial performance often suffices for implied conditions, with compensation for minor defects. Common Law vs UCC: Common law contracts (e.g., service agreements, real estate) use a substantial performance standard. Lecture 2 I. Performance and Breach Welcome back! Our second lecture will focus on how contracts are carried out, what constitutes breach, and how courts determine whether a party's performance is adequate. A. Performance Standards Parol Evidence Rule When a written contract is intended as a final expression, prior or contemporaneous statements that contradict the writing are generally inadmissible. Exceptions: Clarifying ambiguities, showing fraud or duress, or establishing a separate oral agreement. Conditions Express Conditions: Must be strictly performed (e.g., “payment upon receipt of goods”). Implied/Constructive Conditions: Courts may excuse minor deviations if there is substantial performance. B. Performance under Common Law vs. UCC Common Law Substantial Performance: Minor deviations do not necessarily excuse the other party's performance, but may allow for damages. UCC Perfect Tender Rule Under UCC Article 2, sellers must deliver goods exactly as specified; any deviation can be rejected (unless seller has time to cure). II. Breach of Contract Material vs. Minor Breach Material Breach: Excuses the non-breaching party from performance and may allow them to sue for total breach. I've analyzed White Guilt as a self-serving status game that white would-be elitists play to outrank other white people — with zero actual regard for the dignity or lives of non-white people, much less for their immortal souls. Now I must reluctantly return to this grim subject as the cascading scandal of Pakistani rape gangs in Britain gets exposed in lurid, soul-crushing detail. Elon Musk and former British Prime Minister Liz Truss have now weighed in on this, so the British establishment knows it can't imprison everyone who complains about the estimated 250,000 native British girls who've been gang-raped and trafficked in just 10 years, disproportionately by Pakistani immigrants. “Your Daughters Are Already Whores” What drove these Muslim imports to think they were entitled to sexually enslave Christians, apart from the long Muslim tradition of sexually enslaving Christians? (By the millions, via the Muslim white slave trade that continued for centuries.) This X post explains the phenomenon in light of Pakistan's inbred, intensely patriarchal culture: These hundreds of thousands of rapes — many inflicted on minors — were committed with total impunity, with local police and Labour politicians winking at the abuse, rejecting the pleas of victims and even in some cases arresting the hapless parents who tried to rescue their daughters. How and why could this happen? It was supposedly to prevent the rise of racism and avoid helping right-wing politicians who warned — correctly — that mass Third World Muslim immigration was ruining Britain. As a Catholic, hearing that brings back nauseating memories of bishops shuffling pedophile priests from parish to parish instead of calling in the police — supposedly to avoid the danger of “scandal” harming the Church and losing souls. Of course, these leftist politicians in Britain were serving their own religious cause: the post-Civil Rights movement cult of Diversity, Equity, and Inclusion. That infernal trinity, a three-headed golden calf, is now the idol worshiped by elites throughout the West. Those who refuse to prostrate themselves before this fetish face all the force of a secular inquisition. Britons are now sitting in prison cells for mildly complaining about immigration policy — cells which, not coincidentally, have been emptied of rapists and other assailants to make room for political dissidents. Should We Tell “Noble” Lies? This is happening right now in Britain — the nation that gave us the Magna Carta, parliaments, Common Law, and trial by jury. I was sickened even further when one of my favorite living writers, historian Tom Holland, doubled down on his comment from 10 years ago (before his conversion to Christianity): How noble is a goal that rests on secrecy and lies? Was it noble for Catholic bishops to protect the good name of the priesthood at the price of altar boys who were molested and damaged for life? Why is it any more noble than that to save the good name of deeply dysfunctional foreign communities that are infamous for child marriages and “honor killings”? If Pakistani culture really does accept such practices, it richly deserves contempt — and mass deportations to follow. The bishops who covered up for pedophile priests have been mostly disgraced for it now. They paid out some $3 billion in damages in the U.S. alone (though they made all that money back, dollar for dollar, trafficking immigrants via their taxpayer-funded nonprofits such as Catholic Charities). Will the vast, almost unthinkable scale of child rape in Britain discredit its authoritarian, censorship-happy Labour government and the mute, useless Tory party that only expanded immigration, as if to punish its voters? If We Don't Fight, the Pagans Will It's hard to say. You can't beat something with nothing, and antiracism remains the established church of most of the West. Maybe like the Aztec cult it can go on demanding human sacrifices for centuries because there is no live alternative. Christian churches that have dethroned Jesus Christ and replaced Him with canonized victims such as George Floyd won't fill the void. They're not even really Christian, except as cargo cults that use the borrowed imagery and symbols of a religion they've become at once too primitive and decadent to understand. If the Church won't provide an alternative to civilizational suicide, enraged neopagans will. Instead of shaping fetishes out of non-whites, they'll make whiteness an idol. The result will be ugly and violent, and the pasty-faced churchmen who willingly lived by lies will watch it all helplessly from their fainting couches, without even the decency to despise themselves for causing it. Please Support The Stream: Equipping Christians to Think Clearly About the Political, Economic, and Moral Issues of Our Day. Tom Holland, of all people, should know better. His brilliant book Dominion showed how Western notions of equality, fairness, and tolerance all emerged from the Gospel, not Greece or Rome. He even acknowledged that the woke movement was Christianity's illegitimate child. But he's too comfortably ensconced in British intellectual circles to recognize that this post-Christian bastard is trying to murder its father. And, frankly, he lives in a nice, safe neighborhood where no Pakistani gangs are likely to abduct and gang rape his children. Perhaps every British academic and politician should be forcibly relocated to more “diverse” parts of the country. Let's see how long it takes them to start sending checks to Tommy Robinson. Rene Girard, in his books such as I See Satan Fall Like Lightning, warned that the post-Christian substitute religion of Victimism is actually crueler, more perverse, and more opposed to the Gospel than any ancient pagan religion. It's also so frankly absurd and suicidal that it will burn out and destroy itself. If we misunderstand God's law we end up engaging in legalism like the Pharisees. They used God's law in a wooden fashion to try to earn God's favor. But God's law is a common law system that requires the exercise of wisdom grounded in moral principles.
