The President has an excellent legal team, and their strategy is good and interesting. My main aims are to explain why and how Ramaphosa's legal strategy is not unanswerable, firstly, and why there are both political and legal complexities here, secondly, that result from design flaws when it comes to the impeachment process itself- an originating reality neither the President's lawyers nor the section 89 panel are responsible for. Sizwe Mpofu-Walsh and I jointly hosted each other in a fun, experimental set-up where I appeared on his fantastic YouTube channel, and that in turn served also as the recording of this episode of In The Ring. We explored two framing questions about the constitution: first, is the vision for the country that is contained in the constitution the right vision for an ideal South Africa? Secondly, would changes to the constitutional text make any difference in helping us achieve a more just South Africa?These proved to be complex questions that gave rise to some consensus but also much disagreement, which we teased out. We have different views about how to read the constitution, and different views about the actual vision as expressed within the constitution.Along the way we debated whether the drafters of the constitutional text were bold and explicit enough about what a racially just society looks like.The discussion about modifying the constitutional text also gave rise to interesting dialogue. I am deeply sceptical about the extent to which a differently crafted constitution - or a modified version of the current text - could help us overcome our governance weaknesses within the state. Sizwe in turn tried to persuade me that there could be some important causal effects that may flow from radically rethinking what the constitution says. Who was more persuasive? Sizwe Mpofu-Walsh argues in his latest book that apartheid did not die in 1994 but had, instead, been privatised. In a substantive, theoretically rich, introduction chapter, he puzzles through conceptual analysis to justify his resuscitation of the dreaded apartheid-framework. Mindful of the fact that life before 1994 was, in obvious respects, uniquely evil under apartheid, the philosphical work in the introduction is important to avoid any hasty criticism about the work's main thesis. The subsequent middle chapters are empirically rich premises spanning many themes: space, law, wealth, technology, punishment. These chapters constitute the thick factual basis of the claim that apartheid has been privatised.The book ends with an admirable set of reflections on the limitations of the work, possibilities for future research, and a more expansive,and at times literary summary of the author's feelings, to complement the introduction.In this episode of In The Ring With Eusebius McKaiser, I engaged Sizwe in very close detail about this work. Where we agree (often deeply), I honoured and underscored what, in my view, is wonderfully provocative and cogent about the arguments. And, at other times, I went after some of the weaknesses, in my view, of aspects of the middle chapters in particular. I hope listeners of the podcast enjoy this dialogue between us, and rush out to buy a copy of this excellent second book by one of our most thoughtful early career scholars and commentators to have emerged in recent years.

He holds an DPhil in International Relations from the University of Oxford.
