When you think of the Beach Boys, what comes to mind? We're betting it's not a complicated conservatorship case. Unfortunately, that's what's happening with the Beach Boys Founder, Brian Wilson. Mr. Wilson's long-time wife had been his healthcare directive, but with her recent passing, it was discovered that no one was ever named as a backup. Now, the question is not only who will pick up her role as Mr. Wilson's healthcare directive, but how. With Brian Wilson being considered unable to make these decisions for himself due to dementia, the solution is not a simple one. Tune in to learn more about the conservator process and how to avoid these complications yourself. Time-stamped Show Notes: 0:00 Introduction 2:07 To start, Madison gives us an overview of the case with Brian Wilson, who now has to file for conservatorship because he never named a backup healthcare directive. 3:47 Now, we dive deeper into the more complex details of Mr. Wilson's situation and the possibilities we see with the petition process. 5:26 Unfortunately, these issues are not new for Mr. Wilson, who seemed to have been taken advantage of in the past. 06:08 Here's the big takeaway from this episode: Name backups on your estate planning documents. Hey Collectors! On this episode I ask expert Madison Gunn from Absolute Trust Counsel several questions about estate planning and wills. This is a follow up to the last few episodes where we discuss preparing for death. This episode includes incapacitation which is a state I hadn't considered before recording this. What happens if you get in a car accident? What happens to you, your stuff and your family? Are they protected if you get incapacitated somehow? What about if you die? These are questions we don't like to face. I face them daily with families who are searching their loved ones homes and belongings to see if there are any documents that can help them determine their loved ones requests. While we are sifting through all of their belongings, we save every usb stick, every laptop, every device. What if there's a will on there? How do we open the files? So much time an energy being spent on searching for something that most likely was never created. Lots of extra resources spent looking through every document file. I have seen people spend hundreds to have safe's cracked open only to find nothing relevant inside. It's time to take your life back Collectors. It's time to get your affairs in order. Don't leave your family members frantic in an emergency because they can't find your important documents. The month of May is Mental Health Awareness Month and this month's theme is dedicated to taking the #maskoff (figuratively). In this episode, we invited special guest Lauren N. Peebles, ESQ to discuss estate planning (wills, trusts, advanced healthcare directives, power of attorney, etc) and the importance of "preparation in a pandemic" ! #CoronaChronicles If something happened to you, have you made the appropriate provisions for you and your family? If you became unable to make decisions on your own behalf, who can? If you unexpectantly passed away (or your parent), will your family be able to properly grieve, or will they be too busy trying to put the financial, and legal pieces together? Will they be fighting with each other over who gets, or handles what? Especially with the way Covid-19 has been effecting the Black community, it’s time to get our house in order. Today is an extremely important topic, not just for those of us involved in agriculture, but for everyone. My colleague, Andy Crocker, is an Extension Program Specialist in Gerontology and Health with Texas A&M Agrilife Extension. We talk about the importance of having conversations and thinking through our plans and desires concerning our end of life planning. From determining who will serve as an agent under a Power of Attorney, to ensuring that everyone understands your wishes in an Advanced Healthcare Directive, there are a number of considerations and conversations that need to be had. We also talk through several key documents that people should consider drafting, including the Advanced Healthcare Directive, medical Power of Attorney, Power of Attorney, and, depending on the circumstances, an Out-of-Hospital Do Not Resuscitate Order. We discuss the difference in these documents and the requirements to draft them in Texas. Finally, we focus on issues surrounding long-term care planning, including medicare qualification, the look-back period, and the estate recovery program.
