Amanda Troxler has been practicing family formation law since 2013. She represents hundreds of Intended Parents, Donors, and Surrogates a year. Additionally, Amanda has personal experience in third party assisted reproduction, having been an egg donor. In today's show we are going to explain what family formation law is. As a fertility patient, it's important that you understand some of the basic legal pieces that you might want to have in place for your journey, whether that be for IVF, or if you're going to be using donor eggs, donor sperm, or using a gestational carrier. This week, we're busting out the slammer and potentially wishing we were back in it depending on who you ask, as we team up with the canary-clad copper to take down a star-studded mob in a wildly stylish and outlandishly conceived blockbuster starring a charming old man incapable of doing action scenes, that's been seemingly buried in the Disney vault in the years since. It's 1990's Dick Tracy, directed and produced by Warren Beatty, and starring Beatty, Madonna, Al Pacino, Glenne Headly, Charlie Korsmo, Mandy Patinkin, Dustin Hoffman, Seymour Cassel, William Forsythe, Charles Durning, Dick Van Dyke, Paul Sorvino, James Caan, Kathy Bates and Catherine O'Hara. Most of these stars are unrecognizeable under the monstrous makeup required to make them look like their vintage crime comic strip counterparts, but Pacino made enough of an impression with a wildly comedic take on his typical mobster persona that he netted an Oscar nom for Best Supporting Actor, losing to Joe Pesci for GoodFellas. While Beatty is at least a decade too old to be proper fit as the movie's lead, it's his ambition behind the camera that makes the movie such a curiosity all these years later, as the film is either an enchanting dreamscape filled with unsolvable How Did They Do That movie magic puzzles, or a steaming pile of neon-drenched puke depending on which of our two hosts you ask. But that's okay, as we have some heated disagreement this week that is maybe the closest we've yet come to vintage Siskel & Ebert kinda stuff. Plus: We've both been to the theater and are happy to sound off on Ryan Coogler's latest as JMo and Hayley both greatly enjoyed Sinners in the cinema, and Justin's got a bonus theatrical field report on Drop, the latest from Happy Death Day director Christopher Landon. If you'd like to watch Dick Tracy before listening along to our conversation, good luck finding a physical copy, and Disney will seemingly never stream this thing on Disney+ -- possibly for rights reasons to avoid paying anything more to Warren Beatty, or possibly because they are cowards who are ashamed of the fun movie they made. Then: what makes The Peaches laugh? Oh, kid quotes, for sure. And also forcing loved ones to try things that are unreasonable bad-tasting. Later: social media skews our perception of reality. Surrogate decision making has some issues. Surrogates often either don't know what patients would want, or think they know but are wrong, or make choices that align with their own preferences rather than the patients. After making decisions, many surrogates experience regret, PTSD, and depressive symptoms. Can we do better? Or, to phrase the question for 2024, “Can AI do better?” Follow that path and you arrive at a potentially terrifying scenario: using AI for surrogate decision making. What?!? When Teva Brender and Brian Block first approached me about writing a thought piece about this idea, my initial response was, “Hell no.” You may be thinking the same. But…stay with us here…might AI help to address some of the major issues present in surrogate decision making? Or does it raise more issues than it solves? Today we talk with Teva, Dave Wendler, and Jenny Blumenthal-Barby about: Current clinical and ethical issues with surrogate decision making The Patient Preferences Predictor (developed by Dave Wendler) or Personalized Patient Preferences Predictor (updated idea by Brian Earp) and commentary by Jenny Using AI to comb through prior recorded clinical conversations with patients to play back pertinent discussions; to predict functional outcomes; and to predict patient preferences based on prior spending patterns, emails, and social media posts (Teva's thought piece) A whole host of ethical issues raised by these ideas including the black box nature, the motivations of private AI algorithms run by for profit healthcare systems, turning an “is” into an “ought”, defaults and nudges, and privacy. I'll end this intro with a quote from Deb Grady in an editor's commentary to our thought piece in JAMA Internal Medicine about this topic: “Voice technology that creates a searchable database of patients' every encounter with a health care professional? Using data from wearable devices, internet searches, and purchasing history? Algorithms using millions of direct observations of a person's behavior to provide an authentic portrait of the way a person lived? Yikes! The authors discuss the practical, ethical, and accuracy issues related to this scenario. Episode after episode, McClam promised to deliver proof that LaDonna's critics were lying. But instead of delivering proof, McClam brought Alecia Lockhart's alleged sexual abuser on air to dismiss her claims, issued personal threats to show up at my doorstep and attack me, and even threatened to send the anti-gay hate group Westboro Baptist Church to Anthony Christopher's gay club for a "blood bath." Former President Donald Trump's criminal hush money trial hit a new level of chaos Tuesday as Michael Cohen, Trump's former self-described ‘fixer,' continued his testimony for a second day. Trump's defense team also began cross-examination, trying to paint Cohen as a bitter former employee out for revenge and publicity. Outside the Manhattan courtroom, an entourage of MAGA Republicans, including House Speaker Mike Johnson, took turns railing against the trial and bashing the American justice system.
