Those looking to pick up a pair of the brand's Air Jordan 1 High sneakers could shell out an extra $18 on top of their current $180 price tag after the new tariff goes into effect April 9, industry sources told The Post. The 46% tariff on Vietnam would add another $8.28 to the total cost per pair, which adds up when its multiplied by 8,000 – or the number of sneakers that can fit in to a shipping container. But Nike is likely to negotiate deals with its factories to mitigate these costs — or as many industry experts believe, the tariffs will change as the countries negotiate deals. Peter Navarro refers to the use of non-tariff barriers (NTBs) that restrict or distort trade without directly imposing tariffs (taxes on imports). These are indirect methods countries employ to protect their domestic industries, limit foreign competition, or gain an unfair trade advantage, often bypassing international trade rules like those of the World Trade Organization (WTO).
The NTSB issued more than two dozen recommendations Tuesday in East Palestine concerning the toxic train derailment and vent and burn of the vinyl chloride that began nearly a year and a half ago. These recommendations found that the rail industry had no standards in place for overheating wheel bearings and detectors and that the chemicals' vent and burn were unnecessary.21 News anchor Lindsay McCoy sat down with Steven Ditmeyer, a retired executive of the Federal Railroad Administration who has had extensive careers in rail spanning decades, including the research and development of rail safety standards, to discuss the NTSB's findings.
NTBs can have more of a negative impact on trade than tariffs, and new EU packaging regulations might have that impact. Listen for more details on today's Two Minutes in Trade.
On May 3, 2019, Miami Air Flight 293, a Boeing 737 that took off from Guantanamo Bay, Cuba, attempted to land at Naval Air Station Jacksonville. The jet overshot the runway and eventually settled in a shallow part of the St. Johns River. There were seven crew members and 136 passengers on board the plane at the time of the crash. Of that, 21 people received minor injuries and three pets were trapped inside the plane's cargo hold. On Wednesday, the National Transportation Safety Board released its full report on the crash. The report cites weather as a big factor but cited other factors as well. In the moments before the flight was set to land at Naval Air Station Jacksonville, the flight suddenly changed its path due to the inclement weather, according to the NTBS report. However, the change led the flight through the center of the storm cell. At the time of the crash, there was heavy rain, thunderstorms and wind at about 8 knots, or around 9 mph. Wind gusts reached as high as 16 knots, or about 18 mph, according to the report. These factors also caused low visibility of about three miles. Captain Gabriel Cosentino, 55, was at the controls and had worked for Miami Air since March 2008, the report says. He had 7,500 hours of flying time prior to the crash. In an interview with investigators, he said he had flown into NAS Jax between five to ten times. Cosentino also told investigators, "There was no concern about the weather, as the flight route took them west of it," the report says. He added he, "...did not remember the weather report received from the approach control," and called the landing, "pretty smooth," according to the report. Cosentino has not been involved in any other accidents or incidents with Miami Air and was never disciplined for his prior job performance, according to the report. First Officer Claudio Marcelo Jose La Franca, 47, and was fairly new to the company. He was hired in October 2018 and began training in January 2019, according to the report. He also had about 7,500 hours of flight experience prior to the crash. In his interview, he told investigators, "...that there were thunderstorms developing," and he, "...recalled last seeing the airspeed at 100 knots and they were getting close to the end of the runway and not slowing," the report says. It was his first flight to NAS Jax. The report also reveals one of the two evacuation door slides failed to inflate as did one 46-person life raft. There were four life rafts on board. The investigation finds the life raft's inflation hoses were not connected and states a review of the maintenance procedures where the parts were last tested is needed for a risk assessment.

It is shared wisdom that trade is a motor of global economic growth, so it is puzzling that no attention is paid to the continuingly proliferating thicket of non-tariff barriers (NTBs) planted to impede and curtail this growth. The World Trade Organization maintains a database of who is raising NTBs, but as far as I can tell, it is ignored in mainstream economic coverage. But I have the freedom to watch and comment, so I check it on the first Friday of every month. In September, the four major economic powers (US, China, EU, Japan) added a further 66 NTBs designed to impede and slow trade. Over the year to September, they added a further 380, taking the total to 13,704 - up 4.9%yoy. US added 11 in September, taking the total to 6,234, up 4.0% yoy China added 27 in September, taking its total to 2959, up 4.7% yoy EU added 20 in September, taking its total to 2544, up 5.6% yoy Japan added 8 in September, taking its total to 1967, up 7.5% yoy The rise is relentless, with the obstacles in place up 86% since 3Q 2010. Erect enough obstacles and eventually trade will be impeded. That point has probably already been reached: on a 12m basis the imports of these four giant economies peaked in 2018, well before the world had heard of coronavirus. The pandemic accelerated the decline, it did not initiate it. By August, 12m imports from these countries was down 7.9% yoy, and was down 9.5% from the 2018 peak. Although the world's trade warriors are plainly winning their war against trade, there is no sign that their efforts will flag or abate.

Lecture summary: The WTO Agreement on TBT (Technical Barriers to Trade) aims at taming NTBs (nontariff barriers), the main instrument segmenting markets nowadays. Some of the terms used in TBT to flesh out the commitments undertaken are borrowed from the GATT, and some originate in the modern regulatory reality as expressed through SDOs (standard-development organizations). The TBT does not share a copy-cat function with the GATT, though. Alas, the WTO Appellate Body, by understanding words as ‘invariances’, e.g., interpreting them out of context (without asking what is the purpose for the TBT?), has not only exported its GATT case law, but also misapplied it into the realm of TBT, and ended up with significant errors. In what follows, we explain why the current approach is erroneous, and advance an alternative understanding, which could help implement the TBT in a manner faithful to its negotiating intent, and objective function.
