There's a video online of a room full of exhausted diplomats breaking into applause after nearly 20 years of work. One woman brings down the gavel and says, "the ship has reached the shore." That moment, in March 2023, closed out a negotiation that had already failed once in public. It became binding international law this year, and the fight over what it actually protects is happening right now. In this episode, Andrew traces the full history of the High Seas Treaty, formally the BBNJ Agreement (Biodiversity Beyond National Jurisdiction): from the idea first raised at a UN Oceans working session in 2004, through nine years of debating whether a treaty was even needed, to the failed 2022 negotiating session, to the breakthrough text agreed in March 2023. He breaks down the treaty's four pillars, benefit-sharing from marine genetic resources, marine protected areas in international waters, environmental impact assessments for new high seas activity, and capacity building for coastal nations that can't afford their own deep-sea research fleets, and explains why each one was a genuine sticking point between countries. The treaty entered into force on January 17, 2026, making it binding law rather than a symbolic milestone. Roughly two thirds of the ocean lies beyond any single country's jurisdiction, and before this treaty, less than one percent of that area had any form of protection. Ratifications are still climbing, the first Conference of the Parties is expected in January 2027, and a long list of unresolved questions, from secretariat hosting to how marine protected areas actually get designated, will get fought out there. It's not a perfect treaty. It's a beginning. Takeaways: The High Seas Treaty (BBNJ) took roughly 20 years to negotiate, including a public failure at the fifth negotiating session in August 2022. Agreement on the treaty text was reached March 4, 2023, after a marathon final session; it was formally adopted June 19, 2023. The treaty rests on four pillars: marine genetic resource benefit-sharing, marine protected areas in international waters, environmental impact assessments, and capacity building/technology transfer. It needed 60 ratifications to take effect. Morocco became the 60th ratifying country on September 19, 2025. The treaty entered into force January 17, 2026, and now covers roughly two thirds of the ocean that previously had almost no protection. The first Conference of the Parties (COP1) is expected in January 2027, where major unresolved issues get decided. This will come as a total surprise, but I really like James Baldwin. I know, it's shocking. I always kept it subtle, like how I named this podcast after his book The Fire Next Time, and how I have been bringing him up every other episode for years, and how I have a shelf that is just for books by him and about him. The reason I like James Baldwin is that I've found something for me in his work, something that I can not just relate to but also use to understand the wider world, including my own world. This is a curious thing in the context of Baldwin because he was, ultimately, an American writer. An African-American writer, to be exact of course, but his Americanness is something which he took to heart. Not in a weird nationalist way but rather in a sort of matter-of-factly kind of way. So how did I come to relate to him? That's one of the questions we explored here, but to be honest it's not even the main one. What I wanted to know, and what my guest John E. Drabinski has explored in his book So Unimaginable a Price: Baldwin and the Black Atlantic, is why did Baldwin, a man clearly concerned with the fate of the world, rarely engage with the Black Atlantic and might even be described as an ‘anti-diaspora' thinker, at least to some extent. This is a conversation about Baldwin, yes, but ultimately it is a conversation about shifting identities and perspectives in a rapidly changing world, one which seems to be changing even faster now than it did during Baldwin's time.John E. Drabinski is Professor in the Department of African American and Africana Studies, with a joint appointment in the Department of English. Along with Ashley Newby and Brie Gorrell, he co-hosts The Black Studies Podcast, which documents the history and future of the field of Black Studies from the perspective of students, professors, artists, and activists. These days, the apocalypse has been on my mind a lot. Maybe that's not surprising, given the state of the world. This can easily descend into dread and hopelessness, which is something I try and avoid for my own sake. When I picked up Moon of the Crusted Snow and Moon of the Turning Leaves, written by my guest Waubgeshig Rice, in a bookshop in Ottawa, I didn't know what to expect. I've always been into 'post-apocalyptic' stories, but I soon found out that there was something different about this cast of characters: their people, the Anishinaabe, had already survived multiple apocalypses at the hands of the Canadian state. Forensic psychologist Dr. Kris Mohandie argued that the plea agreement that spared Bryan Kohberger from the death penalty was fundamentally flawed because prosecutors never required him to give a detailed account of how or why he killed Madison Mogen, Kaylee Goncalves, Xana Kernodle and Ethan Chapin. Kohberger pleaded guilty in July 2025 and received four consecutive life sentences without parole, plus an additional 10 years, but in July 2026 he filed for post-conviction relief claiming ineffective assistance of counsel, alleging that he had been misled and again asserting his innocence. Mohandie said prosecutors should have forced Kohberger to commit to a complete version of events before accepting the plea, even if they suspected he would lie. Without that confession, Mohandie argued, Kohberger was left with room to later claim that he had been coerced, poorly represented or never truly admitted to the underlying facts of the murders. In his view, the plea deal gave prosecutors finality on paper but failed to extract the kind of detailed admission that could now be used to confront Kohberger's changing claims.Mohandie also criticized the deal for the renewed emotional toll it was placing on the victims' families, arguing that the post-conviction proceedings were forcing them back into a case they had been told was effectively over. He characterized Kohberger's latest legal maneuvering as consistent with what he viewed as a desire to outsmart the system, maintain notoriety and continue controlling the narrative around himself. Peter Huessy provides a historical overview of nuclear arms control, starting with the 1972 SALT I agreement, which actually codified a buildup of weapons while banning missile defenses. He describes the "window of vulnerability" in the 1980s when Soviet SS-18 missiles threatened a first strike. The START I and START II treaties in the 1990s achieved the first real reductions, with START II aiming to ban destabilizing multiple-warhead (MIRV) land-based missiles. However, START II unraveled when Russia demanded limits on U.S. missile defenses. Following the Moscow Treatyand the 2010 New START, the arms control regime has effectively collapsed. Huessy emphasizes that today, there is no active treaty governing nuclear weapons between the U.S. and Russia. He underscores the importance of past verification measures, like "portal monitoring" in missile factories, which are no longer in place. (6)
