The Rooker-Feldman doctrine is a regularly used legal precept often asserted as a defense in bankruptcy courts to characterize actions as appeals or reconsideration of state court judgments. This is exactly what happened after a Massachusetts based con-man manipulated 'Tess', a wealthy woman at a crossroads out of approximately $6M and then convinced her to dismiss, with prejudice, a pending state court action against him. After overcoming this legal struggle, the litigation team was able to track down and collect many of the assets acquired by the con-man with Tess's money for the benefit of her creditors. Judge Gunn is joined by Stephen Huggard, Scott Magee, and Chris Condon to discuss Rooker-Feldman, its limitations, and how a chapter 11 bankruptcy allowed her to claw back $2+ million, and granted 'Tess' a fresh start.

Scott Magee, Race Director of Twisted Branch 100k joins. We chat about what it's like to not be on the internet, taking unintentional breaks (ahem cough, cough) and of course Twisted and Frozen Branches. There was a time when Scott didn't run a lot. Then he did run a lot. And as often happens to many of us in the trail running community, the desire to give back and contribute to community became so overwhelming that Scott up and created a 100k race. Starting with a map of the Bristol Hills Branch and stoked by a love of running, community and the Finger Lakes Trail (and of course, the prodding of others), Scott created Twisted Branch as a contribution to the running community. I created Running Inside Out in much the same manner. Hearing so many stories out on group runs and at races, thinking those stories should be saved and shared (and of course, the prodding of others.), Running Inside Out Podcast was a way to have our stories be shared and celebrated. But lo, these 8 years later, what's it like to shepherd these things along while feeling somewhat disconnected? Also, why does Frozen Branch exist? What even is it? And after 7 iterations, does Twisted Branch still have any tricks up its sleeve (it does.) How do you make changes to something so familiar that everyone has come to love? Building Value is back! Our second season starts today with a special appearance of Scott Magee, VP of Sales and Marketing at Cougar USA. He shared with us how he started in the industry, how he met Mike Zacharias and what new plans they have for Cougar USA in 2021.

Scott Magee cancelled the biggest family reunion on the east coast. The call to drop Twisted Branch 100k nearly broke him who was ready to hold the 6th running of the event. He wonders if he could have been more creative. Could they have made the race happen? Possibly, but it wouldn't have been Twisted Branch. Once you run the event, you'll understand. It's the volunteers, the environment, the community, the course that makes this 100k special. Changing anything would undermine the spirit of the foundations of the race. Scott the runner is someone who loves a good trail race. He has run Muddy Sneaker 10 times, that often being his only race of the year. It was his first race and he showed up in swimming trunks. Needless to say, the gear has changed but the race lives on for him. Muddy Sneaker actually runs through a section of the Twisted Branch course, which sparked Scotts interest and love for the trails in Naples, NY. In this episode, Scott explains how he mapped out the TB100K course and how long it took. He did the race by himself the first two years, forgetting a headlamp the first year. He was motivated by the incredible views but also the responsibility to improve the trail. He speaks to the beauty of being able to hike and just keep going. Making the race happen was a combination of navigation and building trail from washed out wilderness. Thankfully the race is very well marked, and headlamps are encouraged. The first year, Scott felt TB was a failure. Two runners were lost and he didn't know what to do. He took off down the trail to look for the runners, only he knew where those runners were. Luckily, they were found but Scott still felt like the event went terribly. The next morning, Scott woke up to all runners thanking him for the best race they'd ever run. Four other people approached him to join the race directing team. He was completely baffled, but newly inspired to make the next year a success. Well Scott, we're glad you did! Preferring long adventures outside to races, that will never keep him away from Muddy Sneaker and he also talks about running the Georgia Death Race and his experiences with the RD who must not be named.
