In this episode, Judge Gunn discusses the case of Steven and Lori Palladino with Mark DeGiacomo, who served as the Chapter 7 trustee in their case. Mr. DeGiacomo was tasked with administering the fallout resulting from the debtors' Ponzi scheme run through an entity called Viking Financial Group, Inc. Mr. Palladino used Viking to promise “investors” a guaranteed 12% return on their investments, initially meeting with family and friends at Dunkin Donuts or at his kitchen table, and paying out their “dividends” in cash-stuffed envelopes. Mr. Palladino was ultimately convicted of numerous crimes and sentenced to more than 10 years in prison after it was revealed that he had bilked his victims out of more than $10 million. Mr. DeGiacomo winded up conducting at least two dozen Rule 2004 examinations as part of his investigation into the assets and financial affairs of the debtors and used this information to prosecute numerous avoidance actions and liquidate assets of the debtors to repay their creditors and victims. Mr. DeGiacomo recovered numerous lavish gifts Mr. Palladino had given to his wife as well as to his 20-year-old girlfriend, including jewelry, designer handbags, shoes, and dresses which the trustee sold at auction for the benefit of creditors. He also prosecuted an adversary proceeding against Sacred Heart University to recover nearly $65,000 in tuition Mr. Palladino had paid on his adult daughter's behalf, resulting in a decision by the U.S. Court of Appeals for the First Circuit that Mr. Palladino had not received “reasonably equivalent value” in exchange for the tuition payments, because emotional, intangible, or non-economic benefits did not satisfy the standard, and thus the university was required to return the funds to the estate for the benefit of creditors. Mr. DeGiacomo ultimately recovered approximately $2.5 million for distribution to the estate. Mr. Palladino ultimately died in state prison in 2020 before he ever began to serve his 2-year federal prison term for criminal contempt due to his failure to obey orders imposed in a civil action brought against him by the SEC related to the Ponzi scheme.

But their subsequent attempt to make a movie together was anything but blissful. A wild film shoot in China would lead to even wilder things, like the time Sean dangled a photographer upside-down from a ninth-story balcony. Or the time he escaped a prison in Macau and had to have a pardon from the government negotiated by a former member of the Beatles. Or the time he spent in an American prison, where he found himself passing notes with a fellow inmate down the hall…one who happened to be one of the most notorious serial killers in history. It's possible that Aerosmith is the greatest American rock band of all time. And in our opinion, their best album was 1975's Toys In The Attic which is still their biggest selling original record with over 9 million sold in the US. As it turns 50 we decided to dive deep into what makes this album so great and why it endures to this day as a hard rock classic. Yes, it has singles that were popular in their day and are still staples on classic rock radio in Sweet Emotion and Walk This Way. But the title track is a killer way to start a rockin album and is an Aerosmith signature. You See Me Cryin' allows the Bad Boys from Boston to show their tender side (and incorporate strings), Round And Round shows a harder Aerosmith, and Big Ten Inch Record shows off the tongue-in-cheek lyrics that have made the band famous (though that one is a cover, it's classic Steven Tyler). The boys had been touring hard and were really firing on all cylinders. The previous year's Get Your Wings had been well received and had a killer cover of Train Kept A Rollin which was one of their live staples. But what made this album different from the previous two is that when they went to the Record Plant in New York City to record Toys, they didn't have any songs ready. They'd honed the songs from the previous albums live before heading into record them but this time they started from scratch with a few ideas they'd been noodling on. Joe Perry came up with the riff to Walk This Way on stage in Hawaii. Tom Hamilton had the Sweet Emotion bits for years before he worked with Steven Tyler to mold them into an all time classic. Brad Whitford got a co-write on Round And Round and Joe Perry really established himself as one of the killer guitar slingers of his generation.
