El tribunal civil de Nanterre en los suburbios de París falló en favor de 605 víctimas de las prótesis mamarias PIP. Esta condena se suma a las muchas ya emitidas contra la empresa TÜV Rheinland. Este organismo certificador en Europa aprobó la comercialización desde 2001 de cientos de miles de implantes mamarios PIP fabricados con gel de silicona no homologado para uso médico, una estafa a escala internacional que ha afectado a al menos 400.000 mujeres en el mundo. El tribunal de Nanterre, muy cerca de París, decretó este jueves una indemnización histórica para 605 víctimas de las PIP por un total de 10 millones de euros (unos 11 millones de dólares). Estas siglas, por Poly Implant Prothèse, son tristemente célebres en todo el mundo: de ser una de las prótesis mamarias más utilizadas, pasó al epicentro de un escándalo médico judicial de talla internacional.Los problemas para estas prótesis de fabricación francesa comenzaron en 2011, cuando una mujer falleció en Marsella de un linfoma. Tras la explosión de esta prótesis en su cuerpo, rápidamente las autoridades francesas lanzaron una recomendación de retiro de estos implantes de forma preventiva y se determinó que el gel de silicona de las PIP no estaba homologado para el uso médico, sino para equipos electrónicos.En poco tiempo, los casos de cáncer y muerte por ruptura o complicaciones ligadas a las prótesis PIP se multiplicaron en el mundo. En total, casi un millón de estas prótesis fueron implantadas entre 2001 y 2010, principalmente en tres países latinoamericanos: Argentina, Brasil y Venezuela."Maximizar beneficios minimizando costes""En el Tribunal Civil en Nanterre, son unas 600 afectadas que han recibido una sentencia como las que venimos recibiendo en los últimos meses, lo que viene a confirmar la responsabilidad del certificador internacional TÜV Rheinland. Todas las fases de fabricación de un producto, en este caso sanitario, tienen que estar supervisadas por el organismo notificado. ¿Qué significa? Que si tu trabajo de vigilancia y supervisión no lo haces bien, te arriesgas, que es lo que pasó, que en vez de colocar por ejemplo en el relleno un gel médico que vale, ponte el caso, a 1.000 € el litro, pusieron un gel industrial que igual vale a 50 € el litro", explica a RFI Francisco Boronat, abogado del bufete Gaudon-Partagas, que defiende a miles de víctimas."Lo que hicieron es certificar con el marcado CE de la Unión Europea unas prótesis que llegaron a todos los lugares del mundo, sobre todo Europa y sobre todo Iberoamérica: Venezuela, Colombia y también Argentina. El empresario Jean-Claude Mas lo que hizo fue maximizar beneficios minimizando costes. Vendía PIP muy baratas o aparentemente más baratas que la competencia, pero porque también lo que estaba colocando dentro del producto era basura", prosigue."Cualquier afectada a nivel mundial"En cuanto a saber si estas indemnizaciones son suficientes, contesta el abogado que "siempre a uno le gustaría que fuera más porque la problemática es brutal en este asunto. Es decir, hay señoras que a día de hoy siguen teniendo silicona extravasada, o sea, por tránsito por su organismo. También es cierto que Francia ha dado una respuesta que no han dado ni España, ni Venezuela, ni Colombia".Francisco Boronat afirma por otra parte que las víctimas latinoamericanas pueden pasar frente a los tribunales europeos: "Por ejemplo, nosotros llevaremos como un 10% o 15% de esas afectadas de Venezuela y Colombia, y un par de casos puntuales de Cuba. Al final cualquier afectada a nivel mundial es susceptible de poder reclamar en la jurisdicción francesa", asegura.El fallecimiento en 2019 de Jean-Claude Mas, fundador de PIP, puso fin a los procedimientos contra la compañía francesa, pero los procesos contra el certificador alemán TÜV, que proveía el gel para estos implantes y no señaló las fallas, continuaron. En mayo, la Corte de Casación de Francia confirmó la responsabilidad de TÜV en el escándalo y abrió la vía a la indemnización de ciertas víctimas.

His initial memory of wine came when he was three-years-old, defiantly escaping his Mother’s watch to run two miles into the countryside to meet his grandfather in the vineyard (!!!) during harvest.From that point forward it was game on.As a young man, Jean-Claude went about creating Domaine Paul Mas in 2000 using the family’s existing 86 acres of holdings. Leading Languedoc producer Jean-Claude Mas gives us an overview of Languedoc, its geography and appelations.

French company producing the PIP implants came under fire when it emerged they had been making breast implants with an industrial grade silicone not suitable for medical devices. It appears owner Jean Claude Mas was going to great lengths to cover up what he was doing. He is currently serving a 4 years prison sentences which he is appealing through the courts now. The German firm Rhein-land TUV who were in charge of testing the products seemed to have avoided all responsibility for passing the implants as safe, when a French courst ruled that they were not to blame and compensation paid to victims to help them explant their implants, might have to be paid back. The PIP scandal has now also exposed potential dangers within medical devices – not only breast implants but contraceptive devices and even pacemakers.  I am joined by PIP ACTION founder Jan Spivey and PIP Campaigner Tracey Ahmet. PIP Action is a international campaign group for justice. Fighting in the courts, but also at the heart of the European Commission and nationally against the governments and departments of health.  Both ladies have been deeply effected by the PIP implants they had put in after they started making both women extremely sick and needing further surgeries. They are now helping countless other women through their support group and also campaigning for changes. I will be discussing all this plus how unregulated the industry is, including in the UK and more, so lets welcome the ladies onto the show..
