Thanks!I've had several current and former federal judges on this podcast (with more in the pipeline), but I have not yet had a state judge as a guest—even though around 95 percent of cases are filed in state court. So I was delighted to interview Justice Rolando Acosta, who during more than 25 years on the bench was one of the most prominent and respected judges in the country. He served as a trial and appellate judge in New York from 1997 until earlier this year, when he stepped down after six years as Presiding Justice of the Appellate Division, First Department. In March 2023, he joined the New York office of Pillsbury Winthrop as a litigation partner.In our conversation, Justice Acosta and I discussed his childhood growing up in the Dominican Republic, where living under a dictatorship instilled in him a deep appreciation for democracy; his time in college as a star pitcher for Columbia, which led him to seriously consider a career in professional baseball; his community organizing and work as a Legal Aid lawyer, public service that culminated in his judicial career; and threats to judicial independence—including his candid comments on the failed nomination of Justice Hector LaSalle to the New York Court of Appeals.My thanks to Justice Acosta—or Rolando, as he asked me to call him—for joining me. Justice Rolando Acosta shares his story of growing up in the Dominican Republic and coming to New York at 14, finding opportunities by excelling academically and on the baseball field, and choosing the law and going to work at Legal Aid as a way of paying back the help that had been given to his family. Justice Acosta and his daughter Zila Acosta-Grimes compare notes on their upbringing and their privileges, and how they have learned to use privilege as power. Justice Acosta remembers for us his time building the Dominican community in Washington Heights and Inwood by building up social service infrastructure like Alianza Dominicana and Community Association of Progressive Dominicans alongside other community leaders like Adriano Espaillat and Dr. Raphael Lantigua. Justice Acosta also shares insights about the challenges of making change happen at the institutional level, delving into his own efforts to modernize the Appellate Division First Department while he was Presiding Justice. Lisa discloses the shocking statistics around diversity and representation in the sector and we discuss the changes that need to occur to ensure the safety of all of us.  Join her to look at life through a different lens. KEY TAKEAWAYS Currently, only 8% of door staff are women. Yet, they are very good at spotting problems and handling things in a non-confrontational way. Most people will not kick off if someone calmly explains why they cannot come in. People do not need to fear door staff for them to be able to keep control. Justice Lee Smalley Edmon is the Presiding Justice of the Second District, Division Three of the California Courts of Appeal. She previously served as a judge of the Los Angeles County Superior Court from 2000 to 2015, and was that court's first female presiding judge from 2011 to 2012. Before joining the bench, she practiced civil litigation at Adams, Duque & Hazeltine and Dewey Ballentine, and served in leadership positions in numerous bar associations and legal nonprofit boards, including as President of the Los Angeles County Bar Association.

Hello beautiful people On today's podcast we have the lovely Sue Clarke. Sue has such a deep and vast experience of life. She worked in Customs for 28 years and was involved in task forces such as Counter Terrorism, Air Border Security, People Smuggling and Joint Target Ops. She was in the reserve army for 10 years and a Presiding Justice of Peace in the Magistrate Court for Violence Restraining Orders. She is a Personal Trainer and a Marriage Celebrant. She was a participant on Season 1 of Australian Survivor where we first met and a former Ambassador for the Australian Charity Act for Kids where she collaboratively fundraised over $300,000 through her adventures trekking the Kokoda Track and walking the Great Wall of China. What I personally loved about this conversation is to come to better understand Sue's incredible life experience and how this has resulted in what she is so passionate about. From people smuggling to refugees to domestic violence, Sue has worked first hand in these areas and it is insightful to hear the stories that are not always available through mainstream media. Recorded in February 2017 - Hon. Betty Weinberg Ellerin ’52 is senior counsel in the firm’s Litigation & Trial Practice Group in the New York office. Prior to joining Alston & Bird, Justice Weinberg Ellerin served more than 20 years as an Appellate Division jurist. She was the first woman appointed as Deputy Chief Administrative Judge of the State of New York for the New York City Courts, where she was responsible for the operation of all the trial courts within the city. Following that position, she became the first woman appointed as Associate Justice of the Appellate Division of the Supreme Court of the State of New York (First Department). Additional positions include Presiding Justice and Additional Justice of the Appellate Division of the Supreme Court of the State of New York (First Department). Prior to her tenure on the bench, she served as Law Clerk to various State Supreme Court judges. Justice Weinberg Ellerin received her LL.B. in 1952 from New York University, where she was awarded the Florence Allen Scholarship. She received her B.A., cum laude, in 1950 from Washington Square College under the combined college-law program, where she was elected to Justinian, the Pre-Law Honor Society.

Demarest (Ret.) decided some of the most important and challenging business divorce matters including the Mizrahi case which established equitable buy-out as an available remedy in LLC dissolution cases, and the Natanel case in which after trial she ordered dissolution of a 50/50 real estate LLC that had no operating agreement based on conflicting testimony as to its purpose. In this episode of the Business Divorce Roundtable, Justice Demarest shares her judicial perspective on those cases and a variety of other issues in business divorce litigation. The interview also features a discussion with Justice Demarest, who joined JAMS as a neutral after leaving the bench last year, about the benefits of mediating business divorce disputes.
