Jennifer is a 3L at Albany Law School. It works as a Law Clerk at Lippes Mathias and as the Executive Director of the Albany Law School Anthony V. Cardona '70 Moot Court Program. Jenn's journey is full of self-discovery, and amazing insights about the Law School experience, while they are fresh in the mind. Jennifer and I started at Cazenovia College, where she graduated with degrees in Psychology and Criminal Justice. With no family in the legal industry, Jennifer had to DIY her way through the admissions process, using Google and any online resources she could get her hands on. This would lead her to Albany Law the following fall. Jennifer would then speak about her First-year experience, as a great struggle, and an ego check. She would gain tremendous amounts of resiliency through this, as well as gain new study habits. Through this first-year experience, she advised others to give themselves more time to study, focus intently on the work in front of them, write out their notes, and find those all-important study groups to leverage the knowledge of others. We then spoke about the various legal internships she has had, describing them as eye-opening experiences, as well as the utilization of LinkedIn to find said opportunities. Through these experiences, she would learn the differences between the practice of law and the study of law, and the overlapping utility of them both. Finally we spoke about Jennifer's position as the Executive Director of the Albany Law School Anthony V. Cardona '70 Moot Court Program. Amanda is a 3L at the University of Baltimore and currently works as a Law Clerk at Selzer Gurvitch. From dropping out of High School to a current third year Law Student, Amanda offers a journey that is uniquely hers, and illustrious from start to finish. Amanda and I started a full decade before going to Law School. Amanda always wanted to be a Lawyer but life threw some curveballs her way that had to put off that dream for some time. After an ankle injury in high school, Amanda dropped out of high school, later receiving her GED. She went on to work at American Airlines throughout her 20s and eventually began at Community College. She would do so well at Community College, to then be offered an opportunity to go to Harvard extension school, gaining a plethora of knowledge, and a great foundation for Law School. After the Covid Pandemic, hundreds of airline employees, later including her husband, were laid off, Amanda realized that her time in the airline industry was never certain, and needed something to fall back on. Inspired early in life by Atticus Finch of To Kill a Mockingbird, Amanda would embark on her Law School journey, at the University of Baltimore School of Law. Amanda would speak on her first year, which was full of struggle, not only dealing with law school, but the loss of her husband's job, her mother being diagnosed with Breast Cancer, as well as being a mother herself. Amanda would learn a great lesson in perseverance, learning how important it was to have such a strong support system around her and to ask for help when she needed it. Amanda would finish the year strong, and go on to hold clerkship and internships in multiple different domains. Amanda's advice to everyone? Imagine what life would be if you quit. This question would drive her to continue her success in Law School and secure her place at a job post-law school. The life of Jo Cooling is like living in a theme park: one minute, it's like riding a roller coaster, baking cupcakes, cookies, and slices. With a kitchen covered with chocolate, flour, and cooking utensils. Also trying to develop new tastes and ideas for her growing baking business. Sometimes, she feels like she travels through life in a Dodge 'em car. All the while, she works to complete two novels while caring for two Cavoodles, who believe their mother was placed on this earth purely to play with them 24 hours a day. But no matter how out of control her life can be at times, eventually, she ends up sailing around on the Walt Disney teacup ride on top of the world. However, when she relaxes, the Cavoodles see this as an opportunity to snuggle on Mum's lap. Jo's work career has been just as colorful as her current life. She has worked in horse and car racing, sold lingerie, designed websites, been a Personal Assistant, and worked as a Law Clerk. Jo looks at life like a box of chocolates: each day unwraps a new layer, revealing unexpected flavors and textures. On March 28, 2023, the Supreme Court handed down its decision in Wilkins v. United States. The case involves a suit by neighbors to quiet title over a road easement that the United States interprets as allowing for public use. The United States argued the claim was jurisdictionally barred by the the Federal Quiet Title Act's 12-year time limit. The Court held that the Act's statute of limitations is a nonjurisdictional claims-processing rule because a procedural requirement is only jurisdictional if Congress clearly states that it is. Justice Clarence Thomas, joined by Chief Justice Roberts and Justice Alito, dissented and would have held the time-bar jurisdictional because it is a waiver of sovereign immunity.Jeffrey W. In 2022, the US Supreme Court overturned precedent established by Roe v Wade, eliminating the constitutional right to abortion. Family planning decisions can be difficult and complex for kidney patients. On today's episode, we'll discuss how this impacts kidney patients and disadvantaged patients with limited access to healthcare.   On this episode we spoke with,  Harriett Oppenheim Born and raised in Jackson, Mississippi, Harriett Oppenheim has over fifteen years of experience working in the public sector. Harriett graduated from Jackson State University in May 2005 in Jackson, Mississippi where she received her Bachelors Degree in English. Before beginning law school Harriett served as the Project Organizer for the Mississippi Women's Health Project with the ACLU of Mississippi. Harriett attended the University Of Mississippi School Of Law where she received her Jurist Doctorate in May 2008.  After graduating law school Harriett then served as Law Clerk for the Honorable Lillie Blackmon Sanders of the Sixteenth Judicial Circuit Court in Natchez, Mississippi. She also served as Advocacy Coordinator/Attorney for the ACLU of Mississippi's Juvenile Justice Program. Harriett is now a Senior Trial Attorney for the Equal Employment Opportunity Commission in the Jackson Area Office. Litigation Update: Apache Stronghold v. United States Goes En Banc at the Ninth Circuit

This case presents an intersection between Native Americans’ free exercise rights and the Government’s power to regulate its territories. In 2014, Congress enacted the Southeast Arizona Land Exchange and Conservation Act. The Act effectuated a trade of land between Resolution Copper, a mining company, and the federal government. Resolution Copper gave the government 5,300 acres of environmentally sensitive and culturally important lands. In exchange, the Government gave Resolution Copper 2,400 acres containing the third largest copper deposit in the world. Within the 2,400-acre tract of land is Chi’chil Bildagoteel, or “Oak Flat”, a place of central spiritual importance to the Western Apache. It is the direct corridor to their Creator and the site of numerous religious ceremonies. If Resolution Copper is given the land, the religious site will be destroyed and turned into a mine. Apache Stronghold sued to prohibit the land trade under the Religious Freedom Restoration Act (RFRA), the Free Exercise Clause, and under a theory that the trade violates the Government’s trust obligation to the Apaches. The United States argued that pursuant to its constitutional authority over the territories and existing caselaw that the trade was lawful. The District Court rejected a preliminary injunction and the Ninth Circuit Court of Appeals affirmed that judgment by a 2–1 vote. Judge Patrick Bumatay dissented. And the Ninth Circuit agreed to rehear the case en banc this month. Apache Stronghold again presses its three claims. Centrally, it argues that the United States has substantially burdened the Apaches’ religious exercise by authorizing the transfer and destruction of Oak Flat—rendering their religious exercise impossible. The United States argues a line of precedent—culminating in Employment Division v. Smith—bar Apache Stronghold’s claims. The Government particularly relies on Lyng v. Northwest Cemetery Protective Association, which permitted the U.S. Forest Service to develop a road through government land that would traverse a tribal holy site, stating, “Whatever rights the Indians may have to the use of the area, however, those rights do not divest the Government of its right to use what is, after all, its land.” The United States argues that RFRA and the remainder of Apache Stronghold’s claims do not undermine the holding in Lyng. Tonight's guest is Jugnoo Kazmi, a lawyer who has been working for litigation set in Islamabad and briefly as a Legal Consultant in-house. She joined the Supreme Court of Pakistan as a Law Clerk to an Honourable Judge. At present, she is working for Justice Project Pakistan which fights for the rights of vulnerable prisoners facing the harshest punishments. She has also been appointed as state counsel and defense counsel on state expense in jail appeals by an Honourable Judge of the Islamabad High Court. She leads the Women in Law Initiative's Islamabad chapter which works towards ensuring fair representation and equality of opportunity for female lawyers in the legal profession. We have discussed the importance of working hard, her experiences while studying abroad, being independent, the problems faced by female lawyers, law as a profession, working with the government, women's rights, Pakistan's justice system and What is “Women In Law Islamabad Chapter”? On this episode I chatted with Larry Nichols, an Oklahoman who has made quite the impact on our state. Oklahoma native J. Larry Nichols was born and raised in Oklahoma City and graduated from Casady School (1960) before receiving his geology degree from Princeton University (1964) and his Juris Doctorate degree from the University of Michigan (1967). Nichols served as a Special Assistant to Assistant Attorney General William Rehnquist in the U.S. Department of Justice in Washington, D.C. and was a Law Clerk to Chief Justice Earl Warren and Justice Tom Clark of the U.S. Supreme Court. He co-founded Devon Energy Corporation with his father, John, in 1970 and was named president of the company in 1976 and chief executive officer in 1980. He has served on many community boards including the OKC Chamber of Commerce, Allied Arts, Oklahoma Foundation for the Humanities, Casady School, and Mercy Health Center. Among his honors are the Dean A. McGee Award (1997) and the Independent Petroleum Association's Leadership Award (1997). In 2017, ATF agents placed a surveillance camera on a pole across the street from Daphne Moore's home in Massachusetts. They suspected Moore's daughter of dealing drugs and guns.They watched the house for eight months until they obtained enough evidence to get a warrant. The warrant led to a prosecution. Moore and her daughter moved to suppress the evidence. The district court granted this motion but the First Circuit later reversed.Now, Moore and her daughter are asking the Supreme Court to decide “[w]hether long-term police use of a surveillance camera targeted at a person's home and curtilage is a Fourth Amendment search.” A nearly identical certiorari petition arose from the Seventh Circuit a year ago but was denied. The Federalist Society covered that petition on a previous teleforum featuring a debate about whether the word “search” in the Fourth Amendment should be interpreted in accord with the reasonable-expectation-of-privacy test or in accord with the word's plain meaning.In this program, Institute for Justice Senior Attorney, Robert Frommer, provides a litigation update on this interesting Fourth Amendment question and the petition before the Court. In Tiwari v. Friedlander, the Petitioners ask the Supreme Court to grant certiorari to address whether the Fourteenth Amendment requires meaningful review of restrictions on the right to engage in a common occupation. The petition argues that the right to engage in a common occupation is deeply rooted in the nation’s history and tradition, but its protection has been inconsistent, sometimes leading to conflicting results across the lower courts. The petition also contends this inconsistency is caused by the standard under which courts review economic-liberty challenges— the rational basis test.The Petitioners, Dipendra Tiwari and Kishor Sapkota, challenge Kentucky’s Certificate-of-Need (CON) Law as an unconstitutional infringement on their right to earn an honest living. The CON law prevents them from opening a healthcare agency they designed to provide home services to the large community of Nepali-speaking refugees and immigrants in Louisville. By contrast, Kentucky contends that the CON law is necessary for lowering competitive pressure and increasing profits for incumbents who can pass their gains to the public.The petition raises questions about the proper articulation of the rational basis test and whether the right to engage in a common occupation is deeply rooted in history and tradition under the Court’s recent landmark decision Dobbs v. Jackson Women’s Health Organization. Which Rational Basis Test is it anyway?
