    For Cal Harris, the fourth time was a charm. Harris was found not guilty of the murder of his wife, Michele Harris in a bench trial (no jury) before Judge Richard Mott on May 24.  Harris had been convicted twice before, with those convictions overturned on appeal.  His third trial ended in a hung jury.  It's only now that Harris can finally relax, knowing that he can no longer be tried for Michele's murder. Wiehl of Justice caught up with Harris and his attorney, Bruce Barket to discuss his long ordeal and how it has impacted his family.     The Adeline Wilford Murder – Episode 4

    Palm prints and polygraphs! Yes - those are the subjects of Episode 4 of the Adeline Wilford murder case. The plot most assuredly thickens in this episode, as three new characters come into play. Is it possible that these individuals are the ones actually responsible for the Wilford murder? In the last episode, we learned about the concept of "false confessions" that may explain why the men originally convicted fessed up to a crime they now claim they did not commit. But now we learn that palm prints found at the scene of the crime might not implicate the convicted men at all, but rather one or more different individuals.     Here we are at Episode 3 of the Adeline Wilford murder case. Thanks for staying with me as we try to ascertain exactly what happened to Adeline Wilford, and who was involved. In this episode we will delve into the fascinating topic of false confessions. Why would a suspect (or multiple suspects) confess to something they didn't do? It turns out that this is not unprecedented. Both Jonathan Smith and Ray Andrews each confessed to their parts in the Wilford murder, but later either recanted or had their confessions called into question due to other facts and circumstances. Dr. Saul Kassin is one of the nation's experts on the study of false confessions. She could swear like a sailor, and didn't mince words when she wanted to express her opinion. Haddaway became integral to this erstwhile cold case because she was willing to implicate one of her own relatives - her nephew - in the murder of Adeline Wilford. But Beverly didn't do things altruistically. As you'll find out in Episode 2, she certainly had her motives for going to the authorities.     Hi, Lis Wiehl here, and we're back with another very intriguing murder case! In this Wiehl of Justice podcast series, we're going to investigate the twists and turns of the Adeline Wilford murder. Investigators were baffled for years over the brutal killing of 64-year old Easton, MD resident Adeline Wilford. There just weren't enough solid leads to make any arrests. A break in the case came after over a dozen years had passed, which resulted in three men being arrested, tried and convicted. Two of the three were sentenced to life in prison. Recently, however, some new evidence has come to light that could possibly exonerate the incarcerated men. That's where The Innocence Project has gotten involved, with its mission of trying to get the convictions of these men overturned. So are the imprisoned men the actual murderers?     Cal Harris Story Update: Defense Attorney Bruce Barket on Fourth Trial

    A couple of months ago, I wrapped up the Cal Harris story on Wiehl of Justice. I left you with the knowledge that Cal's third trial ended in a mistrial, and that I had learned from sources close to the trial that they jury was split 6-6 on whether or not Cal was guilty. I also told you that it wasn't yet known if there would be a fourth trial. Well, now I know that there will be a fourth time that Cal Harris will be tried for the murder of his wife, Michele Harris, who disappeared on September 11th, 2001. On August 26th, a conference was held at the Schoharie County Court where it was determined that on March 2nd, 2016, a jury will once again be tasked with determining whether or not Cal murdered his wife.     At this point, you may be as sure as Angela Prosinski, the juror from the first trial that I spoke with in episode 4, that Cal murdered his wife. After all, there are a lot of things that, taken as a whole, could equate to Cal being a murderer. You have people who say Cal threatened Michele and was angry and controlling. You have the prosecution telling you that Michele and Cal were in the midst of a bitter divorce, a divorce that Cal did not want. And you have a small amount of blood found in the Harris' estate. Conversely, you may be just as certain that he didn't do it. As Bruce Barket points out, the small amount of blood found in the Harris' estate does not equate to a crime scene - much less, the place where Cal killed Michele. And what about all of the resources dedicated to investigating Cal as the murderer.     Ep. 7 – Bruce Barket, Cal Harris’ Defense Attorney, Joins #WiehlOfJustice

    Based on district attorney Kirk Martin's comments after the third trial it seems like there will be a fourth trial. A "not guilty" verdict is still a possibility for Cal Harris. However, so far this is the best outcome he has had. In both of the first two trials, he was found guilty. Twelve people in the first trial and twelve in the second were able to agree that Cal Harris killed Michele. But, in the latest trial, only six of the jurors were sure of Cal's guilt. That says a lot about Cal's new legal team which is lead by Bruce Barket. The evidence is not really changing and the witnesses are remaining almost exactly the same from trial to trial. You would have to figure that Mr. Barket, the one arguing on Cal's behalf, is at least partially responsible for the deadlocked jury. Mr. Barket specializes in criminal defense cases. He is no stranger to high profile cases and success. Mr. Barket secured the release of Amy Fisher, also known as the "Long Island Lolita," who was convicted of shooting her lover's wife. He was also part of the legal team that overturned the double murder conviction and secured the release from prison of Martin Tankleff, who was wrongfully convicted of killing his parents and spent 18 years in prison. Mr. Barket spent countless hours pouring over this case and has spent a lot of time with Cal. So if there's anyone with a good grip on what might have happened to Michele, it'd be Bruce Barket.     Ep. 6 – The Jury is Deadlocked in the Third Trial

    Going into the third trial, Cal is making an effort to uncover the truth. The third trial began on February 5, 2015. Once again, the prosecution's theory is that Michele was murdered and that Cal was the one with the motive and the opportunity to do it. The evidence will show this to the jury. The Defense argued that investigators have spent years looking at the wrong man. The marriage wasn't perfect, but it was not unlike any other strained marriage. A major difference between this third trial and the first and second is what the jurors did. After 11 weeks of testimony, on April 30th, Cal Harris' fate was once again in the hands of twelve jurors. On May 5th, the jurors delivered a note to Judge Bartlett, saying they were deadlocked. What this means is that they were unable to come to a unanimous verdict. Judge Bartlett issued what's called an Allen charge, which is an instruction given to a deadlocked jury, encouraging them to continue deliberating until they reach a verdict. He asked the jurors to keep an open mind and to not hesitate to change their opinions if they feel they initially came to the wrong conclusion.     On July 13, 2009 - A little more than two years after Cal was found guilty in the first trial - the second trial begins. You see, despite the fact that the first conviction was thrown out, the indictment against Cal still stood, so if the prosecution wanted to try again, they could. And, they did. A lot of the same characters from the first trial testify in the second trial. But, there are two new important players to testify: Cal Harris and Kevin Tubbs.     This first trial is the foundation for all of the subsequent trials. When I started pouring over all the information related to this case, I may have had a preconceived idea about what happened and whether or not Cal was involved. The more involved I get, though, the more I go back and forth on whether I think Cal had motive enough to kill the mother of his kids. One thing I know for sure is that the evidence against him is a tad thin. There's a lot of info about him being a bad husband. But none of that really tells me beyond a reasonable doubt that he's a murderer. In the end, though, what really matters is how the jury felt about the evidence. On June 6, 2007, after closing arguments by both sides, judge smith begins his instructions to the jurors. So I spoke with Angela pro-sin-ski, who was a juror in the first trial. she was one of the twelve who listened to both sides of the story and sat in the courtroom with Cal Harris.     New York state police investigator Steven Andersen examined the harris residence between the 12th and the 19th of September. He talks about how there were no signs of forced entry into the Harris home. And there was no blood found in any of the Harris' vehicles, boats, and ATVs. what was found on Michele's van - the van left at the end of the driveway - were eleven fingerprints. Here’s a very quick backdrop: Michele Harris was a beautiful young woman when she married Calvin Harris – a funny and outgoing man of means. Cal Harris grew up in a prominent business family and owned several car dealerships. If you look at early photos of this family, you'd be looking at what appears to be the perfect family: a happy couple with four beautiful kids. And according to a former nanny for the Harris', it really was a fairy tale complete with the 252-acre estate that the family lived on. But it’s clear that this was not always a perfect or happy marriage. And Michele Harris wanted out. Michele went missing on September 11, 2001 (yes, that September 11), and one of the first persons of interest was Calvin Harris. But despite all the years and extensive searching, neither a body nor a weapon has ever been found, which has left people close to Michele and authorities with questions as to what happened to her.
