Suspicion turns towards Michele's estranged husband, Cal Harris, as the couple are in the midst of a heated divorce and tiny specks of blood are soon found inside their residence. Years later, Cal is charged with Michele's murder and found guilty, but the case would undergo four trials and two overturned convictions while the defence points the finger at alternate suspects. Cal is finally acquitted of the crime in 2016, but Michele's body is never found. Was Cal Harris actually responsible for his wife's disappearance, or did someone else murder Michele? They declare a guilty verdict. Before sentencing can be pronounced, a key witness steps up who places a young man confronting a crying Michelle at the end of her driveway early on the morning of Sept 12th. This should have blown up the prosecutions theory that Michelle reached the garage at home at midnight and that Cal killed here there- but that doesn't stop the prosecutors from deep sixing Cal Harris.. Another witness calls the defense to alert them that two steel mill workers have been bragging about being with Michelle late on the night of the 11th. That should have blown up the prosecutors theory that Michelle drove home after leaving her boyfriend's residence. Desperate to convict Cal, they stick to their theory.. The prosecution does their best to destroy the first witnesses credibility and hides the interviews they did with the steel mill workers from the defense, relying on a second trial held locally to put Cal Harris behind bars. Four years after she went missing, her husband Cal Harris was arrested and charged with murder. With neither a body or a murder weapon, the verdict surprised many. New evidence emerged that shifted attention to another possible suspect within hours after his first trial, yet his prosecution downplayed the new evidence, not wanting to give up on their shaky theory that Cal killed his wife. Last week’s episode concerning the disappearance of Sneha Philip right on the cusp of the World Trade Center attacks on 9/11/2001 got Melissa to thinking about other cases revolving around major national emergency events. And so this week’s episode is about someone else whose disappearance – this one occurring just the day after 9/11 – is still a mystery and whose killer has never been convicted – although the authorities thought for sure they had identified that person…and arrested him…and tried him…FOUR TIMES… Michele Harris was splitting with her husband, Calvin (“Cal”) Harris, and the split was not going well. Both living together in separate wings of the Harris estate in rural upstate New York pending a drawn out finalization of their divorce, things had gotten nasty between Michele and Cal by the time the summer of 2001 had rolled around. The main issue appeared to be money – how much of a settlement would Michele accept from her multimillionaire soon-to-be-ex husband? If you asked Cal, he’d say way too much. If you asked Michele, she’d say all she wanted was an appraisal of all of Cal’s holdings so that she could walk away with a fair amount. Turns out the issue never had to be resolved. That’s because the morning after the WTC attacks, Michele was nowhere to be found anywhere in the house. Cal, who had to leave for work, called the babysitter to come over to take care of the kids until Michele got home. It’s when the babysitter showed up that things got strange. Driving into the property, she saw Michele’s minivan parked at th end of the long driveway, keys still in the ignition. It was when the police showed up to investigate that Cal Harris began to engage in a series of behaviors that led the authorities to make him the prime suspect. Which got him arrested. Which resulted in one tossed indictment, three mistrials and finally an acquittal – fourteen years after Michele’s disappearance. The problem with Cal, you see – setting aside the question of whether he was responsible for Michele’s ultimate fate or not – is that he can’t seem to stop himself from being a giant jerk. He never seemed concerned about Michele; sold her stuff just weeks after she disappeared, took up with an old flame not long after that and just generally acted like a dee eye see kay, if y’know what we’re saying. So was Cal Harris righteously accused of Michele Harris’ murder? Or is he an innocent man wrongfully brought to trial simply because he was such an unpleasant dude (oh, almost forgot, as soon as he was acquitted he sued the County and every single witness who testified against him – nice!)? For Cal Harris, the fourth time was a charm. Harris was found not guilty of the murder of his wife, Michele Harris in a bench trial (no jury) before Judge Richard Mott on May 24. Harris had been convicted twice before, with those convictions overturned on appeal. His third trial ended in a hung jury. It's only now that Harris can finally relax, knowing that he can no longer be tried for Michele's murder. Wiehl of Justice caught up with Harris and his attorney, Bruce Barket to discuss his long ordeal and how it has impacted his family. A couple of months ago, I wrapped up the Cal Harris story on Wiehl of Justice. I left you with the knowledge that Cal's third trial ended in a mistrial, and that I had learned from sources close to the trial that they jury was split 6-6 on whether or not Cal was guilty. I also told you that it wasn't yet known if there would be a fourth trial. Well, now I know that there will be a fourth time that Cal Harris will be tried for the murder of his wife, Michele Harris, who disappeared on September 11th, 2001. On August 26th, a conference was held at the Schoharie County Court where it was determined that on March 2nd, 2016, a jury will once again be tasked with determining whether or not Cal murdered his wife. Bruce Barket, Cal's Defense Attorney, is back and will tell us why he thinks the prosecutors want a fourth trial, and whether or not his strategy will change. Based on district attorney Kirk Martin's comments after the third trial it seems like there will be a fourth trial. A "not guilty" verdict is still a possibility for Cal Harris. However, so far this is the best outcome he has had. In both of the first two trials, he was found guilty. Twelve people in the first trial and twelve in the second were able to agree that Cal Harris killed Michele. But, in the latest trial, only six of the jurors were sure of Cal's guilt. That says a lot about Cal's new legal team which is lead by Bruce Barket. The evidence is not really changing and the witnesses are remaining almost exactly the same from trial to trial. You would have to figure that Mr. Barket, the one arguing on Cal's behalf, is at least partially responsible for the deadlocked jury. Mr. Barket specializes in criminal defense cases. He is no stranger to high profile cases and success. Mr. Barket secured the release of Amy Fisher, also known as the "Long Island Lolita," who was convicted of shooting her lover's wife. He was also part of the legal team that overturned the double murder conviction and secured the release from prison of Martin Tankleff, who was wrongfully convicted of killing his parents and spent 18 years in prison. Mr. Barket spent countless hours pouring over this case and has spent a lot of time with Cal. So if there's anyone with a good grip on what might have happened to Michele, it'd be Bruce Barket. On July 13, 2009 - A little more than two years after Cal was found guilty in the first trial - the second trial begins. You see, despite the fact that the first conviction was thrown out, the indictment against Cal still stood, so if the prosecution wanted to try again, they could. And, they did. A lot of the same characters from the first trial testify in the second trial. But, there are two new important players to testify: Cal Harris and Kevin Tubbs. This first trial is the foundation for all of the subsequent trials. When I started pouring over all the information related to this case, I may have had a preconceived idea about what happened and whether or not Cal was involved. The more involved I get, though, the more I go back and forth on whether I think Cal had motive enough to kill the mother of his kids. One thing I know for sure is that the evidence against him is a tad thin. There's a lot of info about him being a bad husband. But none of that really tells me beyond a reasonable doubt that he's a murderer. In the end, though, what really matters is how the jury felt about the evidence. On June 6, 2007, after closing arguments by both sides, judge smith begins his instructions to the jurors. So I spoke with Angela pro-sin-ski, who was a juror in the first trial. she was one of the twelve who listened to both sides of the story and sat in the courtroom with Cal Harris.
