Growing With Fishes Podcast. A podcast dedicated to growing aquaponic & cannabis and spreading information to the masses about sustainable cannabis and veggie production! Washington v Barr, which sued the federal government, the DEA, the DOJ and then attorney Jeff Sessions (now Barr) on the basis that criminalizing cannabis by listing it is a schedule I substances violates the constitutional rights of medical cannabis patients that need cannabis to survive. For some more background and context, here are a few articles on the case, which you may have seen bits and pieces of over the last 3 years. Plaintiffs in the case include former superbowl champ Marvin Washington, Alexis Bortell, the now 15 year old medical cannabis refugee in CO from TX that has started a regenerative farm (one luv organics) with her family and has been seizure free for 4 years, Jagger Cotte, Iraq War Vet Jose Belen, and the Cannabis Cultural Association. You may have also seen some organizations (Last Prisoner Project, Minority Cannabis Business Association, ASA, NORML,etc) posting about briefs written in support of a case over the last few weeks, including several members of congress - that was for this same case. Just this Monday, Rep Earl Blumenauer issued a press release urging the Supreme Court to hear this appeal, as there is no legislative solution in sight for legalizing cannabis, which is why our legal team has taken this decision to the highest court. Luckily for us, the people playing by the rules to break down the rules from within are Lauren, her law partner Michael, and a team dedicated to social justice that all have a respect for and a relationship with the plant. In Michael’s own words from the Honeysuckle article: “Every time a person of color is treated differently under the Controlled Substances Act, and that’s every day, it constitutes a violation of the Equal Protection Clause. In my view, it violates the Civil Rights Act as well. So, if we can declassify cannabis and remove it from the schedule by obtaining a declaration that it is unconstitutional, that would essentially void the law—and if it’s voided, all of those criminal convictions, I hope, can be vacated. All of those lives that have been destroyed can go on a pathway towards restoration. That, to me, is so important to what we’re doing; it’s one of the reasons why when we took this case on pro bono. What kind of society would we have if we could take this tool out of their arsenal? It wouldn’t resolve all racism… Racism is so important to those in charge that they’re willing to fire on American citizens to perpetuate it. We have to take the wall of racism down brick by brick. The suit involves a motley crew of plaintiffs: Alexis Bortell and Jagger Cotte, both pediatric medical marijuana patients; Jose Belen, an Army combat veteran who uses cannabis to treat his PTSD; Marvin Washington, a former New York Jet turned cannabis entrepreneur; and the Cannabis Cultural Association, a nonprofit dedicated to ending the war on drugs and promoting people of color in the cannabis industry.

Today on Hempire our host Eileen Karpfinger is joined by 12-year-olds Alexis Bortell. She’s written a book, takes cannabis oil daily and is challenging the U.S. Controlled Substance Act by suing Attorney General Jeff Sessions. Approximately three years ago Alexis had to leave her home in Texas in order to treat her severe form of epilepsy — known as intractable epilepsy — with cannabis. Now she’s suing Sessions so that others like her won’t have to leave home in fear of retribution from the federal government if they, too, use medical marijuana. The suit aims to prove that the Controlled Substances Act, the statute governing federal drug policy, is unconstitutional as it relates to marijuana, according to Alexis’ attorney, Michael S. Hiller. Joining in on the suit with Alexis are plaintiffs Marvin Washington, a former NFL lineman; Jose Belen, an Army veteran; and Jagger Cotte, a 6-year-old Georgia boy with Leigh syndrome, all of whom use medicinal cannabis. The Cannabis Cultural Association is also named as a plaintiff, according to court documents.

An exclusive interview with Tami Wahl and Saphira Galoob, the two top cannabis lobbyists in Washington. It’s obviously worrying, what’s going on in Washington under the Cheeto-in-Chief. Trying to predict where his administration is heading on most issues, including on cannabis policy, is a fool’s errand.While 29 states have legalized some form of marijuana Attorney General Jeff Beauregard Sessions seems intent on stamping it out or at least keeping the prohibition firmly in place. His Justice Department has sent signals that they want to reverse the Cole memo, the Obama administration directive that warned the Justice Department off from prosecuting businesses and operations in legal states. And he has threatened to enforce Federal marijuana laws -- even for medical patients -- in states where voters have made cannabis legal. (On November 11, 2017 a 12-year-old Texan, Alexis Bortell, filed a suit against Sessions over the nation’s federal ban. Her family was forced to move from Texas to Colorado to get treatment for her epileptic treatment).Meanwhile, there’s a flurry of legislative activity that provides hope that the war is not lost. New Jersey Senator Cory Booker unveiled a proposal to legalize marijuana at the federal level -- a Quixotic long shot to say the least, but one that 64% of Americans say they favor, according to recent polls. Another senator is trying to attach measures to bills that would allow Veterans Affairs doctors to counsel patients on the use of medical marijuana, which advocates have been arguing for decades. In the House, Republican Matt Gaetz of Florida proposed legislation that would remove cannabis from its Schedule I classification so that US research on its medical uses could get underway.It’s a schizophrenic but important moment for the cannabis movement. To get a reading on where things stand in Congress, I turned to Tami Wahl and Saphira Galoob, two powerhouse lawyers who run The Liaison Group, the only lobbying firm in the capitol exclusively devoted to shaping the legislative and policy landscape for this much-maligned plant. In big brother news, The House Judiciary Committee has approved (27 to 8) the USA Liberty Act, which reforms as it reauthorizes Sec. 702 of the Foreign Intelligence Surveillance Act, which authorizes the surveillance of communications from non-U.S. residents. Next stop is a vote on the House floor. The US Senate proposed a similar USA Liberty Act as well. Senator Mike Lee (R-Utah) and Senator Patrick Leahy (D-Vermont) introduced the Liberty Act bill which will reauthorize the controversial Section 702 of the Foreign Intelligence Surveillance Act. In not-cannabis news, Audrey and Edward Cramer, of Buffalo Township, Pennsylvania, were reported to police by their Nationwide insurance agent for allegedly having marijuana plants on their property. The couple says that on Sept. 20 police stormed their house, harassed them, took their plants and arrested them, while Audrey Cramer was still in her underwear. The problem for police is that the plants they confiscated were Kenaf hibiscus plants, not marijuana.
