Marvin Washington is a former NFL player who played a total of eleven years with three teams: the New York Jets, Denver Broncos, and San Francisco 49ers. He was a member of the Denver Broncos 1998 Super Bowl-winning team and was voted by Sports Illustrated as the 36th best N.Y. JET of all time. A voice for former NFL players in the NFL's concussion lawsuit, Washington addressed the truth about the outcome as well as the effects of chronic traumatic encephalopathy (CTE). Washington v Barr, which sued the federal government, the DEA, the DOJ and then attorney Jeff Sessions (now Barr) on the basis that criminalizing cannabis by listing it is a schedule I substances violates the constitutional rights of medical cannabis patients that need cannabis to survive. For some more background and context, here are a few articles on the case, which you may have seen bits and pieces of over the last 3 years. Plaintiffs in the case include former superbowl champ Marvin Washington, Alexis Bortell, the now 15 year old medical cannabis refugee in CO from TX that has started a regenerative farm (one luv organics) with her family and has been seizure free for 4 years, Jagger Cotte, Iraq War Vet Jose Belen, and the Cannabis Cultural Association. You may have also seen some organizations (Last Prisoner Project, Minority Cannabis Business Association, ASA, NORML,etc) posting about briefs written in support of a case over the last few weeks, including several members of congress - that was for this same case. Just this Monday, Rep Earl Blumenauer issued a press release urging the Supreme Court to hear this appeal, as there is no legislative solution in sight for legalizing cannabis, which is why our legal team has taken this decision to the highest court. Luckily for us, the people playing by the rules to break down the rules from within are Lauren, her law partner Michael, and a team dedicated to social justice that all have a respect for and a relationship with the plant. In Michael’s own words from the Honeysuckle article: “Every time a person of color is treated differently under the Controlled Substances Act, and that’s every day, it constitutes a violation of the Equal Protection Clause. In my view, it violates the Civil Rights Act as well. So, if we can declassify cannabis and remove it from the schedule by obtaining a declaration that it is unconstitutional, that would essentially void the law—and if it’s voided, all of those criminal convictions, I hope, can be vacated. All of those lives that have been destroyed can go on a pathway towards restoration. That, to me, is so important to what we’re doing; it’s one of the reasons why when we took this case on pro bono. What kind of society would we have if we could take this tool out of their arsenal? It wouldn’t resolve all racism… Racism is so important to those in charge that they’re willing to fire on American citizens to perpetuate it. We have to take the wall of racism down brick by brick. From the original blog, found here: https://dumbbellsanddragons.com/877/ Like many of us, I spent the last two weekends watching football. It was exciting, surprising, and, above all, entertaining. I followed the games along with my fantasy stats, cheered when my players scored, cursed when my opponents did. Then the injuries happened. Tony Romo out with a fractured clavicle, Alshon Jeffrey with a hurt hammy. And Luke Kuechly with a concussion. These days, it seems at least one player all 32 teams is going through the “concussion protocol,” a series of tests to protect players’ health. There are many sides to this debate, whether the onus is on the players or league to protect the players’ health. In a time where former NFL player Chris Borland retired after a single year citing the health risks as his reason. He had a bright future and could have made a lot of money as an NFL player. He chose his health. In a recent study, 76 of 79 deceased players’ brains were shown to have some sort of degenerative disease[1]. It’s really hard not to understand why Chris made the decision he did. A new development in treating brain injuries is on the horizon. Kannalife, a bio-pharmaceutical and phyto-medical company, has been studying Cannabinoids (CBD) for use in treatment[2]. We were lucky enough to sit down with former NFL defensive end and Super Bowl XXXIII champion, Marvin Washington to talk about CBD, Kannalife, NFL player safety, and a controversial new movie, Concussion, starring Will Smith as Dr. Bennet Omalu[3]. Highlights of the conversation will be discussed. To expand on the conversation with Marvin, CTE stands for chronic traumatic encephalopathy. If you are interested in learning more about the specifics of this, check out the CTE Wikipedia, here . In brief, its slang is NFL Concussion Syndrome, and in one study, 96% of former NFL players have it[4]. That’s a very scary number, especially when you see how popular the sport is. It’s essentially saying, if you play football at a professional level, you will get this disease and it will affect your life when you retire. How many of us have had to deal with a parent or grandparent with a cognitive disability? It’s painful. And there is no reason for it. Marvin mentioned that the numbers of young children and high school students playing football is down, but millions and millions of people are still playing this sport[5]. Whether or not to play the game is a conversation that needs to happen within families. As Marvin said, families and players are more educated about the risks. Marvin and I love football. And we want to see it grow, but safely, without a 96% likelihood of getting CTE. Hopefully, these issues will be brought to light this December when Concussion starring Will Smith is released on Christmas Day. Concussion is the story of Dr. Bennet Omalu, the forensic pathologist that discovered CTE. From the trailer (see below), it has Will Smith’s Oscar nom written all over it. This movie has the NFL running scared. They already are planning a rebuttal to the film[6]. This isn’t the first time the NFL has been involved in some concussion related scandal. Late in 2013, there were rumors the NFL pressured ESPN to distance itself from a PBS Frontline documentary, League of Denial: The NFL’s Concussion Crisis[7]. Regardless of whether or not the NFL pressured anyone, and regardless on the success of Will Smith’s movie. Concussions and CTE are problems. They warrant solutions, wherever they may be found. I met Marvin through contacts at the Cannabis World Congress and Business Expo in Los Angeles. Marvin spoke about the work of Kannalife, a company doing R&D on the medical benefits of CBD, of which he serves on the advisory board. Kannalife holds the exclusive license for the commercialization of CBD as an antioxidant and neuroprotectant. There is limited research showing the benefits of CBD to reduce short term brain damage[8]. For more on Kannalife, check them out here. CBD is a non-psychoactive aspect of marijuana. Meaning, it doesn’t get you high[9]. This gives CBD many positive medical aspects. Mostly because this limits the side effects. It isn’t used for recreational purposes like THC (the psychoactive ingredient in marijuana.). Even in states where medical and recreational marijuana use is legal, it doesn’t change the fact that marijuana is a banned substance in every sport! A UFC fighter just got suspended for five years because of it[10]! We are on the verge of some very exciting discoveries. In time, not only will CTE be a thing of the past, but very possibly dementia, Alzheimer’s, and ALS. What are your thoughts? Currently he is a professor in the Alberta School of Business, and Chair of the Strategic Management and Organization Department. His research, consulting, and teaching focus is on the processes of organizational and institutional change. Dr. Washington is the author of two books on leadership and organizational change: Pack Leadership: Lessons from the Wild Dogs of Africa, and Successful Organizational Transformation: The Five Critical Elements. He has published many academic and practitioner articles and presented his research at conferences all over the world. He has taught undergraduates, graduates, and executives during his 12 years as a University Professor. Today on Hempire our host Eileen Karpfinger is joined by Jacob Plowden and Nelson Guerrero are co-founders of the Cannabis Cultural Association in NYC which is suing Jeff Sessions to legalize cannabis. They, along with other advocates and professionals in the cannabis industry, descended on a federal court in New York last month to watch Justice Department lawyers try to dismiss a case against Attorney General Jeff Sessions. The suit involves a motley crew of plaintiffs: Alexis Bortell and Jagger Cotte, both pediatric medical marijuana patients; Jose Belen, an Army combat veteran who uses cannabis to treat his PTSD; Marvin Washington, a former New York Jet turned cannabis entrepreneur; and the Cannabis Cultural Association, a nonprofit dedicated to ending the war on drugs and promoting people of color in the cannabis industry.
In 2011, David Conley’s life blew up. He was working in a job he hated as a Technology Executive for the Government. Today on Hempire our host Eileen Karpfinger is joined by 12-year-olds Alexis Bortell. She’s written a book, takes cannabis oil daily and is challenging the U.S. Controlled Substance Act by suing Attorney General Jeff Sessions. Approximately three years ago Alexis had to leave her home in Texas in order to treat her severe form of epilepsy — known as intractable epilepsy — with cannabis. Now she’s suing Sessions so that others like her won’t have to leave home in fear of retribution from the federal government if they, too, use medical marijuana. The suit aims to prove that the Controlled Substances Act, the statute governing federal drug policy, is unconstitutional as it relates to marijuana, according to Alexis’ attorney, Michael S. Hiller. Joining in on the suit with Alexis are plaintiffs Marvin Washington, a former NFL lineman; Jose Belen, an Army veteran; and Jagger Cotte, a 6-year-old Georgia boy with Leigh syndrome, all of whom use medicinal cannabis. The Cannabis Cultural Association is also named as a plaintiff, according to court documents.
Marvin had an 11 year NFL career, 7.8 years longer than the average NFL career (3.2 years). Now a successful businessman in the cannabis space, Marvin says that his work ethic and self reflection is what separates himself from the average NFL career and entrepreneur. We're back with a timely new episode. This week we sat down with Marvin Washington, former NFL player and Super Bowl champion, to talk about the war on drugs, marijuana policies in sports, socially conscious athletes, and this past week’s display of solidarity across the NFL in response to Donald Trump’s comments calling players who kneel during the national anthem “sons of bitches.”

In 2013, 8,000 retired players sued the NFL for $1 billion in damages because of the brain injuries they sustained during their careers. They accused the league of hiding the dangers of repeated concussions and the harrowing degenerative brain diseases that resulted from them. Repeated head blows leave 1 in 3 football players 8 to 14 times more vulnerable to early onset Alzheimer’s and dementia, and symptoms set in as early as age 40. One brain injured player was discovered Super-gluing his rotten teeth to his gums to hold them in place. Another was found urinating into an oven thinking it was a toilet. Another was zapping his back with a taser gun to staunch his relentless pain. The issue was thrust into the spotlight when former Chicago Bear defensive back Dave Duerson committed suicide by shooting himself in the chest so he could leave his addled brain to science to dissect. His goal was to force the NFL to recant its long-standing denial about this illness.Concerned coaches have called for more protective helmet design, but this is no more effective than wearing high socks to prevent a broken leg. The league also toyed with fining players who play too rough, but that caused a backlash among fans who enjoy watching their heroes going head to head. Cosmetic fixes won’t solve the problem. Nothing can repair a brain that has turned to mush.Marvin Washington, cannabis and player advocate, thinks some change is in the offing. “There’s going to be a less prohibitive cannabis policy,” he tells us on this podcast. “Parents are seeing guys killing themselves that’s not good for the league, that’s not good for football.”

Photo from Howard Stern.com I remember being a junior in high school and my buddy on the football team had some of us over to hang out one night in the off-season. After eating some dinner and probably playing some Halo on Xbox, we went to one of his neighbor’s houses to meet up with some other friends. When we got there I remember a few of the kids bringing out some marijuana to smoke. This was the first time I had ever even seen marijuana or a bong. After a pretty successful junior campaign, my dream of playing college football was at an all-time high (no pun intended) and I was about as straight-edged as they come. I was so laser focused and obsessed with this goal that I refused to be put in any situation that might jeopardize the achievement of that goal. So naturally, I called my mom to pick me up. To my friends credit, they waited to smoke until after I left. People often ask the question, “where do you think you’ll be in ten years?” If you told me in the car-ride home from that gathering that I would be attending the World Medical Cannabis Conference (pictures below) in ten years I would have said, “are you f***ing high?!” (Pun intended). I was significantly influenced by the stigma associated with cannabis from a young age, particularly because of the D.A.R.E. program at school which told us our brain’s were going to turn to mush if we ever smoked marijuana and the only thing we would be great at in life would be collecting Dorito dust on our parent’s couch. To this day, I have never consumed even an ounce of cannabis (well…maybe some second-hand). It’s funny how worried I was about what a plant would do to deteriorate my brain and not about what smashing my skull into everything with a different colored jersey was doing to it. I certainly learned the hard way that running people over and making big hits probably isn’t the best way to conserve brain cells. To be honest, I worry about my brain health as I get older and so are a lot of other former football players and NFLers. Believe it or not, the very plant that we have been told was going to ruin our lives might be the remedy for preserving brain health and saving the game of football and this week’s guest Eben Britton teaches us why. The first four seasons were with the Jacksonville Jaguars and the last two with the Chicago Bears. Prior to the NFL, Eben was an All American at the University of Arizona where he studied creative writing. I drove out to Pittsburgh to meet Eben where he was speaking at the World Medical Cannabis Conference (as mentioned earlier in this post) where he and three other retired NFL players (Todd Herremans, Marvin Washington and Nate Jackson) spoke on behalf of an organization called Athletes For Care. Athletes For Care is a non-profit organization founded by a group of pro athletes who are uniting as one voice to advocate for research, education, and compassion when addressing important health issues facing athletes and the public at large. In the steel city, Eben and the rest of the Athletes For Care team were advocating for the removal of cannabis from the list of banned substances in the NFL. Each athlete spoke about the ways they have been able to use marijuana to alleviate the pain that inevitably comes when playing football both during and after their career’s. Many NFL players become addicted to the opiate pain killers they are prescribed when in the league (like previous guest David Vobora) and after attending the conference and listening to Eben’s story, I am a true believer in this cause. I was blown away by the countless benefits cannabis offers to the world. After speaking on the Athlete Panel during the conference, Eben generously took time to share his story and teach us about the benefits of cannabis on the podcast. Photo Courtesy of Eben Britton Eben was raised in a family that was holistically minded. Natural remedies were always the first go-to medicines and he frequently went to yoga classes as a kid. He didn’t start playing football until he was a freshman in high school and that was after a lot of convincing to his mom who was always terrified he was going to get hurt. Even before he suited up and walked out on to the field for the first time, he was focused and determined to be the best football player he could possibly be and everything he did went towards achieving that mission. Fortunately, Eben didn’t deal with a lot of injuries in high school or college besides a chronically subluxating shoulder. However, while playing the Chiefs during his 2nd season in league, his shoulder fully dislocated for the first time. He was also dealing with a herniated disc in his back and was on a handful of medications including Adderall, Toradol and Vicodin. Eben says that he and most of his teammates would get a shot of Toradol before each game, which is extremely destructive on the human body considering an NFL football season can last up to 6 months. Standard recommendations for Toradol are as follows: “Toradol should not be used for longer than 5 days, including both injection plus tablets. Long-term use of this medicine can damage your kidneys or cause bleeding.” Eben described how these opiates mask your pain through the central nervous system by basically telling your brain you're not in pain. However, Eben believes this isn't necessarily a beneficial quality of the drugs because pain serves a purpose. In addition, Eben talked about some other negative effects of the drugs most frequently prescribed for NFL players which includes an increased frequency of the negative and dark thoughts that would pop up while on injured reserved, along with the mood swings that caused him to be angry and irrational. Not to mention waking up at 3am with the withdrawal symptoms of chills and cold sweats. Juxtapose this experience with the effects of cannabis and the differences are glaring. During the interview, Eben discusses the science behind the medicinal herb, cannabis, and how it affects the body naturally. Fortunately, Eben stayed relatively injury free in high school or college so he didn't need to take a whole lot of pain killers. The first time Eben tried marijuana he was in high school after football season and had an intense experience, but because of that he didn’t use it again until he got to the NFL. You might be saying to yourself, "but isn't that illegal?" Eben talks about the structure of drug testing in the NFL and how to not got caught. Cannabis is considered a street drug in the NFL and these drugs are only tested once a year. The testing for street drugs occurs anytime between the start of OTA’s to the end of training camp. Performance enhancing drug tests are conducted at random throughout the whole year. As mentioned earlier, I have never used cannabis, so I asked Eben what cannabis does to the pain football players and athletes deal with on a regular basis. Eben said that cannabis doesn't kill your pain, it just reframes it. He went on to describe cannabis as a comfort blanket. Eben said that every football player is so overly adrenalized because they spend all day everyday in a super extreme environment and constantly running on adrenaline and cortisol. In other words, they are in a constant state of fight or flight. Cannabis, according to Eben, fosters an environment of healing in your body. Eben also went on the drop some knowledge bombs on some of Dr. Mechoulam's research who is considered the godfather of cannabinoid. Specifically, mice studies have shown when someone or something gets a concussion, receptors in the brain initiate the healing process by releasing the neurotransmitter glutamate, which is toxic to the brain over a period of time, especially in football players who are constantly knocking heads. Glutamate starts to destroy brain matter over an extended period of time and is thought to be one of the causes of chronic traumatic encephalopathy, CTE. Cannabinoids cross the blood brain barrier and are able to shut off the receptors pumping glutamate, neutralize the glutamate and actually trigger neurogenesis to form new brain cells. Eben also went on to tell me that cannabis is actually a bronchodilator, which means that it actually improves lung function. We finished the episode by talking about Eben's transition to life after football and debunking the stigma associated with cannabis. NFL is often thought to stand for "Not For Long" by many of the athletes who played in the league, but while you're in it, no one is thinking about their inevitable demise. Guys who reach the upper echelons of the sport have had to sacrifice a lot to get to that point. Eben says that his transition to life after football has been one of the biggest struggles of his life, but also one of the most rewarding. He advises that athletes need to be gentle to themselves during their transitions, appreciate the work you have done and have gratitude for that experience. Eben's advice for current athletes is to give yourself some distance from your sport at times. He believes all athletes have an element of creativity inherently inside them and it is important for them to have an outlet outside of the game. For Eben, that outlet has often been writing. Eben is passionate about helping other athletes during their transition to life after sports and has helped start The Athletes Afterlife program through Athletes For Care. This program is intended to serve as a support group for athletes to share their struggle and help translate sports skills to other areas. These groups are for athletes of any level and sport. I was a guy who fed into the stigma associated with cannabis my whole life. To be completely honest, I judged guys who used it. The judgement stemmed from my lack of knowledge about the plant and from living in a society that demonizes it. Eben says that we need to shift the paradigm of our thinking when it comes to cannabis. We need to think of the pills that are made in a laboratory as the stuff that we want to stay away from and view the medicine that grows from the earth and is naturally occurring in our bodies as the stuff that will help us. I hope this episode will help de-stigmatize the drug and prevent athletes from becoming addicted to pain killers in the future.
