To be honest, we haven't had a typical election in years. This cycle included a debate that ended with Democrats swapping out candidates, an assassination attempt, multiple Zoom calls, and coordinated efforts by both parties to make the other seem like the worst possible choice; the people have spoken. Donald J. Trump is our president again. So, we are heading into a second Trump administration. I wasn't expecting it, and neither were many others. Since we are here, let's talk about it. What does a new Trump administration mean for the black community? What about cannabis? What's the future of the plant under his admin? What about Amendment 3 in Florida and Governor Ron Desantis's role in helping it fail? There was a lot to unpack after November 5th. I spoke about these topics with the Executive chair for the Minority Cannabis Business Association, Mike Lomuto, Executive Director of the Marijuana Project, Chelsea Higgs-Wise, Kevin Ford Jr. with the Uplife Maryland and Budding Solutions Shanita Penny. Shaleen Title is an Indian-American attorney and longtime drug policy activist. She currently serves as Distinguished Cannabis Policy Practitioner in Residence at The Ohio State University Moritz College of Law's Drug Enforcement and Policy Center and as vice-chair of the Cannabis Regulators of Color Coalition. She is a frequent keynote speaker and consultant on cannabis policy and has testified in front of governmental bodies around the world about restorative justice in marijuana laws. As CEO of the crowdfunded policy project Parabola Center, she co-authored 2021 model federal amendments focusing on people rather than corporate profits. In 2017, she was appointed by the Massachusetts governor, attorney general, and treasurer to serve as one of five inaugural commissioners of the Cannabis Control Commission, the agency tasked with regulating legal and medical marijuana in the commonwealth. Her three-year term was extended to December 31, 2020. Described as “the people's weed watchdog” in Boston Magazine's 2019 Power List, she was widely recognized during her term for her focus on racial justice and her efforts to make the cannabis industry more fair and inclusive. Previously, in her role as a founding board member of the Minority Cannabis Business Association, she led the creation of the MCBA Model Bill, the first state-level model bill created to give states guidance to implement a process of reinvestment and reconciliation. She also served as a trustee for Students for Sensible Drug Policy and a board member of the National Lawyers Guild. She was a co-founder of THC Staffing, the first recruiting firm focused on inclusion in the cannabis industry, and was part of the multistate tax group at Deloitte Tax. Shaleen's interviews have been featured in outlets including PBS NewsHour, Politico, Rolling Stone, Newsweek, The Guardian, Vice News, and many NPR stations, and she has written guest op-eds for The Boston Globe, Philadelphia Inquirer, Commonwealth Magazine, Marijuana Moment, and Boston Business Journal. As a Chemist, she has worked for private industry; government, at the Food and Drug Administration and within the pharmaceutical industry, at a top pharmaceutical company in the Research and Development Department. Jamila has had significant experience working with controlled substances and understands the care and compliance with dispensing such medicines. Jamila has recently started formulating her very own hemp/CBD tinctures, using high-quality, Colorado-grown hemp. Washington v Barr, which sued the federal government, the DEA, the DOJ and then attorney Jeff Sessions (now Barr) on the basis that criminalizing cannabis by listing it is a schedule I substances violates the constitutional rights of medical cannabis patients that need cannabis to survive. For some more background and context, here are a few articles on the case, which you may have seen bits and pieces of over the last 3 years. Plaintiffs in the case include former superbowl champ Marvin Washington, Alexis Bortell, the now 15 year old medical cannabis refugee in CO from TX that has started a regenerative farm (one luv organics) with her family and has been seizure free for 4 years, Jagger Cotte, Iraq War Vet Jose Belen, and the Cannabis Cultural Association. You may have also seen some organizations (Last Prisoner Project, Minority Cannabis Business Association, ASA, NORML,etc) posting about briefs written in support of a case over the last few weeks, including several members of congress - that was for this same case. Just this Monday, Rep Earl Blumenauer issued a press release urging the Supreme Court to hear this appeal, as there is no legislative solution in sight for legalizing cannabis, which is why our legal team has taken this decision to the highest court. Luckily for us, the people playing by the rules to break down the rules from within are Lauren, her law partner Michael, and a team dedicated to social justice that all have a respect for and a relationship with the plant. In Michael’s own words from the Honeysuckle article: “Every time a person of color is treated differently under the Controlled Substances Act, and that’s every day, it constitutes a violation of the Equal Protection Clause. In my view, it violates the Civil Rights Act as well. So, if we can declassify cannabis and remove it from the schedule by obtaining a declaration that it is unconstitutional, that would essentially void the law—and if it’s voided, all of those criminal convictions, I hope, can be vacated. All of those lives that have been destroyed can go on a pathway towards restoration. That, to me, is so important to what we’re doing; it’s one of the reasons why when we took this case on pro bono. What kind of society would we have if we could take this tool out of their arsenal? It wouldn’t resolve all racism… Racism is so important to those in charge that they’re willing to fire on American citizens to perpetuate it. We have to take the wall of racism down brick by brick. Shanita Penny, of the Minority Cannabis Business Association, shares with us that the MCBA is currently pushing for as much equitable cannabis legislation as possible. For Penny, equity means "ensuring that we address the social justice and criminal justice reform aspects, that we make sure small businesses and minority-owned businesses have a place in this industry, and that we also create patient access that is real and true." Penny notes that by removing certain barriers to entry, we are then improving communities that have been most affected by the war on drugs. She reminds us that, as long as we're making enough noise, a legislative loss may actually be progress in disguise.

This week’s regulatory compliance updates are from April 16th to April 22nd and contain information for Arkansas, California, Colorado, Georgia, Maine, Michigan, Missouri, Oregon, and Washington dispensaries. In Federal news, the U.S. Citizenship and Immigration Services issued a memo saying that using marijuana or working in the cannabis industry, even if it is legal under state law, makes immigrants ineligible for citizenship because it means they don’t have “good moral character.” The memo says that “violation of federal controlled substance law, including for marijuana, established by a conviction or admission, is generally a bar to establishing good moral character for naturalization even where the conduct would not be a violation of state law.” Proposals such as the STATES act do not address these deeper issues related to federal prohibition. “Considering the devastating effects our war on drugs had on Latin America, immigration reform must be a necessary component of any comprehensive cannabis legalization policy,” stated Jason Ortiz, vice president of the Minority Cannabis Business Association. Lewis is recognized nationally and internationally as an expert in formative marijuana policy. He is among a small group of government executives who have been intimately involved in the development and implementation of marijuana policy from the infancy of medical marijuana through the realization of legalization. Lewis' leadership contributions and devotion to implementing marijuana policy thoughtfully played an important role achieving what has become one of the most fully developed marijuana regulatory frameworks in the world. Lewis is currently a co founder and senior director at Freedman and Koski, Inc. where he works with government clients across the United States tasked with developing and implementing cannabis policy. He also works with ancillary companies and investment firms that are focused on helping government successfully implement cannabis policy. Lewis holds a Master of Business Administration with an emphasis on International Business and is a Doctoral Candidate in Public Administration with a focus on policy analysis and public participation in rulemaking. He also teaches a graduate level course called. The Marijuana Policy Frontier at the University of Colorado Denver. Commissioner Shaleen Title was jointly appointed by the Massachusetts governor, treasurer, and attorney general to the Cannabis Control Commission in September 2017. In this episode, we sit down with Jesce Horton. You may know him as the founder of the growing facility/edibles manufacturer Panacea Valley Gardens, proudly at home in the state of Oregon, but he is equally well known as the founder of the Minority Cannabis Business Association, an association dedicated to supporting minorities in the cannabis industry. Horton tells us how, after a car accident, growing his own medicine helped him manage his own pain, and how that eventually led to him growing for other patients in his community. Encouraged by this, a year and a half ago he felt ready to leave the corporate world he had spent most of his professional life in to focus solely on cannabis. He offers enlightening perspectives on how the cannabis industry should be focusing on energy efficiency, and how minority empowerment lies at the core of cannabis's overarching message of social justice, economic opportunity, and universal patient access.
