In this episode, I discuss the congressional politics of the court vacancy. Here are the relevant links from each point. Point #1- There’s no chance a Justice won’t be confirmed if there are 50 votes for the justice. You almost certainly can’t stop this procedurally if you are the Democrats. James Wallner discussing the procedures for confirming a judicial nomination. My tweetstorm on the Senate rules regarding the requirement of holding an impeachment trial. My tweetstorm on the problems with denying a quorum. My tweetstorm on shaping understandings rather than preventing actions. Point #2 – And there’s almost certainly going to be 50 votes. Electorally vulnerable Senators just aren’t going to break with the party here. My old post on how opinion polls about policy don’t translate to votes. Point #3 – Parties don’t simply have a goal of maximizing their seats in Congress. Anthony Downs’ theory of party competition. Point #4 – Hardball politics is both new and not new. Josh Chafetz’s on unprecedented things in judicial nominations. Me on hardball politics and what’s new and not new. Mark Tushnet on Constitutional hardball. Francis Lee on insecure majorities and party competition. Matt Green on hardball politics in Congress, then and now. The Washington Post […]

How do the Red Taped bros tackle a classic academic tome on bureaucracy? We have a simple three-step approach. Step 1: Take an unplanned three-month sabbatical to get your head right. Step 2: Reach for your top-shelf scotch. Step 3: Attempt a serious conversation for approximately 20 minutes before traversing a downward spiral of somewhat pertinent pop-culture references. This week we discuss Inside Bureaucracy by Anthony Downs. 22 minutes in, we drop our academic pretense and travel to Indiana, Westeros, and a faraway galaxy to trap, identify, and tag endangered bureaucrats—just in case you want to skip ahead to the usual drunken banter. As always, you can reach on Twitter @RedTapedPodcast or drop us an email at redtaped@outlook.com. We are currently working on our reading list for 2019. Q. What pairs best with cheap cheese? A. Apparently, bureaucrat tears. This week we drink several bottles of wine, get emotional, regret major life decisions, opine on the wonders of guava paste, and think deeply about change. We also get a visit from 50’s dad, who is still trying to make friends and influence them. It is time to quit your hemming-and-hawing and join us for our review of Who Moved My Cheese? by Spencer Johnson, M.D. Please consider sniffing and scurrying over to our twitter (@RedTapedPodcast) or dropping us an email (redtaped@outlook.com). This week Peter Van Doren joins us to explain the economics of decision making in politics. What is public choice theory and how does it explain what happens in a majority rules democracy? Is public choice a type of macroeconomic theory? How does ordering a series of votes change their outcome? What’s rent-seeking? What does the phrase “concentrated benefits and diffuse costs” mean?
