Can Your Employer Stop You From Getting Your Next Job?

Is That Even Legal?

Restrictive covenants. Non-competes. Some states allow their enforcement. Some states don't. In an increasingly mobile employment environment and in a time when the "Great Resignation," is sweeping the country, the Federal Government is paying a lot of attention to trying to "promote competitive labor markets and worker mobility."  This effort is in response an Executive Order by President Biden in July, urging the Federal Trade Commission to "curtail the unfair use of non-compete clauses...that may unfairly limit worker mobility."On December 6th and 7th, the FTC and the DOJ will host a virtual workshop to inform the rulemaking process.  This episode tees up the issue looking at restrictive covenants from all sides, with guest litigation attorney David Williams.Have you ever been laid off only to find that you can't get a job in your field due to a non-compete? Have you ever had an employee walk off with your customer list or your "secret sauce?  As an employee, are you free to leave for a competitor?  As an employer, are your trade secrets protected.? If you aren't sure, this episode of Is That Even Legal is for you.More on the December Workshop. See also https://www.justice.gov/atr/events/public-workshop-promoting-competition-labor-markets#informationAccording to the FTC, Over the two days (12/6 and 12/7) a series of panels, presentations, and remarks will address competition issues affecting labor markets and the welfare of workers, including: labor monopsony; the increased use of restrictive contractual clauses in labor agreements, including non-competes and non-disclosure agreements; information sharing and benchmarking activity among competing employers; the role of other federal agencies in ensuring fair competition in labor markets; and the relationship between antitrust law and collective bargaining efforts in the “gig economy.”  Panelists will be invited to discuss potential steps antitrust enforcers can take to better target enforcement resources, improve public guidance, and pursue a “whole of government” approach to ensuring fair competition for workers and consumers by leveraging interagency resources. The FTC and the DOJ Antitrust Division invite comments from the public on the topics covered by this workshop. Interested parties may submit public comments online now through Dec. 20, 2021, at Regulations.gov.

LIVE on KPFT 90.1 FM: Allison Gaines discusses her group Writers & Editor of Color #WEOC. Message on Democrats, economics, & more Panelists inadvertently inferred that our mythical free market is a fraud. Did you hear it?: As we discuss supply chain and inflation issues, it is clear that the government is not the problem, but a fraudulent mythical market is. We are all brainwashed from birth in our familial, economic, and citizenry culture. All brainwashing or indoctrination is not wrong. Bombarding one's psyche in many cases can maintain a certain degree of order that is otherwise near unattainable. But when said indoctrination causes permanent economic, social, or mental damage, they must be disengaged. Did you just call the Democrats weenies: Donny Deutsch great advice to Democrats to win 2022: A broken clock is correct twice a day and so is Donny Deutsch with his latest advice for Democrats, They should heed his sound advice. Big Pharma uses the patent system to rip us off. Example: Insulin costs $6 to make. We pay $300.: Big Pharma is at it again. They are fighting with misleading ads against any attempt to negotiate drug prices. Ironically, most of these drugs are initially researched with taxpayer dollars. So ultimately, we pay twice for the same medication. Allison Gaines, co-founder of #WEOC on dedication to writing & more: Allison Gaines is the co-founder of Writers and Editors of Color (#WEOC). The need for digital transformation in the connectivity space is increasing at a staggering pace. Enterprises are on a fast track to evolving their networks so they can support burgeoning technologies such as SD-WAN and IoT-oriented applications, etc. Residentially, some 18 to 36 million Americans currently lack broadband, creating a troubling digital divide. All of these truths possess a common challenge: connectivity. Without it, there is no digital transformation; no next-gen applications or factory floor data processing and optimization; no bridging the rural broadband gap; no virtual office; no virtual anything.Yet the act of network discovery, procurement and physical connection is rife with inefficiencies, inaccuracies and antiquated manual processes. And the companies tasked with helping their customers digitally transform through connectivity – namely, network operators and managed service providers – aren't immune to these same types of challenges. It begs the question: how far along are the transformers on their own path to transformation?Moderated by George Lawton, a journalist with VentureBeat and TechTarget, this virtual roundtable will address the long-standing challenges faced by network buyers and sellers, and new ones brought on by the rise in trends such as SD-WAN and 5G. Panelists will offer actionable solutions, including steps toward process automation, accurate and easily accessible location insights, digital twin analyses, ecosystem engagement and more, as a means to transform the transformers.Follow Jaymie at @jscotto and Evan at @evankirstelSUBSCRIBE to JaymieScottoTV for the latest Telecom News: https://www.youtube.com/JaymieScottoTVHOMEPAGE: http://www.jsa.netLIKE JaymieScottoTV on FACEBOOK:  https://www.facebook.com/JaymieScottoandAssociatesFOLLOW JaymieScottoTV on TWITTER: https://twitter.com/jsatv

State legislatures across the country thus responded by considering legislation to increase the number of charter schools, offer additional scholarship and tax credit programs, and create education savings account options to increase choice in education. This panel surveyed proposed education reforms to expand school choice and discussed the responses of unions, school boards, and parents to these proposals. The Citizen Redistricting Committee has wrapped up its work and the focus now shifts to the state legislature. The Committee approved a series of maps for lawmakers to consider on how to redraw election districts for the next ten years. That decision will likely happen sometime in December. Much of the conversation among the Redistricting Committee focused on communities of interest and how the new maps should represent those communities. Correspondent Gwyneth Doland sits down with representatives from the Native American and Black communities to get their reactions to the work of the Committee and what happens next. The Line opinion panel also discusses the recent work of New Mexico's Independent Redistricting Committee. The group has endorsed new maps to send to the state legislature for final approval, but with no obligation attached, will lawmakers give full consideration to the suggestions or simply go their own way? Our panelists give their take and weigh in on the possibility of an Albuquerque neighborhood joining the state's southern congressional district. Residents in two downtown Albuquerque neighborhoods share their thoughts on the possibility of a new soccer stadium coming into their area. They tell us their concerns, their frustrations with the process and the possibilities the project could bring new dialogue with the city. The Line opinion panel also talks about the Bond Proposal to build a new soccer stadium in the city of Albuquerque. Panelists discuss the apprehensions of residents, the potential benefits for the city's downtown area and the breaking news that there are inaccuracies in the actual ballot wording. The Line opinion panel shares legal perspective on the Governor's power to unilaterally allocate federal COVID-19 relief funds. The state Treasurer says the Governor must consult the Legislature, but the Governor's Office says legal precedent is on its side. On October 20, the Center for Universal Education (CUE) hosted a lively discussion to address all of these issues in what will be the first in a series of three events centered around assessment. This first discussion focused on the assessment goals that are most helpful in supporting high-quality learning for all children, and particularly for children in low- and middle-income countries. CUE shared its insights from collaborative work with six countries across Africa and Asia on assessment strategies that help foster deeper learning and engaging pedagogy in challenging contexts, while also highlighting the complexities of assessment in the era of the pandemic. Panelists debated the merits and trade-offs of different approaches, and discussed how the pandemic is shaping the debate on assessing learning.   Subscribe to Brookings Events on iTunes, send feedback email to events@brookings.edu, and follow us and tweet us at @policypodcasts on Twitter. Tens of thousands of members of the International Association of Theatrical Stage Employees (IATSE) just voted overwhelmingly to authorize a strike. With 89.66% of eligible members participating and 98% voting to authorize the strike, the vote could lead 60,000 workers to walk off the job and bring the entertainment industry to a halt.As consumers, we tend to associate the entertainment industry with acting stars, elite directors and producers, and big studio executives, but hundreds and and even thousands of workers make every production possible, and many of them are grossly underpaid, overworked, and denied basic necessities like breaks and time to sleep between shifts. Combined with the explosion of streaming services and ever-increasing demands for studio-quality productions, workers in the entertainment industry are being run into the ground, and they have reached a breaking point.IATSE represents over 150,000 technicians, artisans, and craftspersons in the entertainment industry, including live theatre, motion picture and television production, broadcast, and trade shows in the United States and Canada. The union is composed of many different locals, not all of which are currently voting to authorize a strike. According to Deadline, "there are actually two separate strike authorization votes going on—one among the union's 13 Hollywood production locals covered by the Basic Agreement, and the other covering 23 different locals outside Los Angeles who work under the Area Standards Agreement." In this urgent Working People episode, recorded on Oct. 1, while the strike authorization vote was taking place, we talk to a panel of IATSE members and hear firsthand about the work they do, the unfair working conditions they're fighting against, and the significance of the strike vote. We received a relatively low amount of questions that tagged @jackgreenstalk or @cheaphomegrow and so we dove deep into one of the first questions which asked what breeders look for in a good seed tester, and what are some common faux pas to avoid. Most panelist who grow seeds and have tested weigh in and share their thoughts on their own experiences and speculate on what might be best way to do it, and why some may be motivated to do things one way or another. We also then go into talking about saponins in response to a question. at roughly the 1 hour mark, Jack shares the zoom link with the live chat, and sour diesel tangie joins the conversation, shows off his garden and lights a bit and then we have some discussion about c02 and ppfd levels. This goes on into some organic vs synthetic conversations related to that topic and also in relation to implications for the planet. after sour diesel tangie left, brandon comes back and we field a question on crop cover. once we cover the crop cover topic for a bit, we have a few other special surprise panelist join, for the first time ever @chetterbob13 joins the panel and shows off his garden with a few great SCROGs and discusses his thoughts on living soil bed grows he runs compared with his sea of green (SOG) grows in similar/the same sized grow spaces, using very different plant count and management techniques.
