When we're feeling overwhelmed and stressed about the idea of divorce, we want to get it over with really quickly. And what a fair share of the assets would look like? If you have, you're not alone. Recognise that divorce is a marathon and not a sprint. You can ease into it, ensure that you have enough energy to get you through from start to finish recognising there'll be times when you do need to put your foot down and excel the pace a little bit. One of the reasons why I started my Get Divorce Ready group programme is that I realised that it would help people reduce their divorce stress, that overwhelm of not knowing. Feeling uncertain about not understanding what was required of them and what would happen next while getting divorced. So I designed Get Divorce Ready, and that's an eight week group program that we run over 10 weeks in The Absolute Academy. We go through how to prepare for divorce, whether you're petitioning, whether you're the respondent, understanding your future income needs, understanding financial disclosure, dealing with high conflict personalities, understanding how to communicate both with your soon to be exposed and your lawyer and having a plan for the future. This getting organised helps reduce stress. Why? Because when you understand the process, you feel more confident and you feel more in control. It's something that you're part of rather than it being something that's happening to you. In this episode we share details of how you can deal with the stress of the divorce process. In my years, as a divorce coach, one of the biggest sources of stress that I notice is at the start of the divorce process itself. It could be that you've just made the decision to leave, or perhaps your spouse has left you. Either way you're at the start of the process. You probably haven't been through it before. And even if you have, you may have forgotten exactly how it works. All you can remember is that it caused you sleepless nights and lots of worry, the stress is there right from the start. So recognizing that the divorce process is going to be stressful is the first step to managing that process with as much ease and as confidence as possible. It doesn't matter what stage of the divorce process you're at right now. If you're feeling stressed, you need to do something about it. Take ownership and responsibility. In this episode I encourage you to identify the source of the stress, then identify who can help you with my pragmatic suggestions. In October 2020 NEST did some research, it found that 75% of women said they didn't know what they needed as a retirement nest egg for their pension. In the The Guide To The Treatment of Pensions On Divorce the Pensions Advisory Group found out of a list of 369 divorces where 80% of them had pensions, pension sharing orders were only made in 14% of cases. This goes back to the comment I made on the previous podcast episode. Many women in particular, walk away from the ability to share pension in favour of keeping the former matrimonial home. Now, in some cases, as we looked at, this can be the right and proper thing to do, but for many it's a bad decision. Go back and listen to that episode to ensure that you're making the right decision. In my experience as a divorce coach many women often are tempted to fall into this trap: foregoing a share of their husband's pension to stay in the family home. This is known as offsetting. In the last episode (61 Fairness and Divorce Finances), we talked about fairness and divorce finances. We talked about how the starting point is a 50:50 split of all the marital assets. If a 50:50 split of your finances doesn't lead to fairness, you may have a needs-based case. A needs-based case means that it is justified to depart from an equal division of the assets in order to reach fairness. In this episode, we're going to be talking about your divorce finances and the concept of fairness. As far as the court's concerned, it wants to be fair. Now, as we've talked about on previous episodes, the idea of fairness is often subjective. What you feel is fair and what your soon to be ex feels is fair can often be poles apart. So in this episode we consider how the court handles this and the factors that come into play. Perhaps you're listening to this episode and you're the parent who has the majority of care for the children. And the idea that you have to share more of your parenting with the other parent feels unfair because up until now, it feels like the other parent hasn't really cared. Perhaps you're listening to this episode, being the parent who hasn't done the majority of the parenting, because you've been out to work every day, providing for the family financially and this has been your contribution. And you're now worried because of separation and divorce, that your time with the children is going to be restricted. Whatever your position, these feelings are completely normal. And felt by thousands of couples and parents every day. So how do you create fairness in the parenting relationship when you're separating and divorcing? If you're getting divorced, you may or may not find yourself in Children Act proceedings. In this episode I share details of the court's child-centred approach to fairness. Remember from previous podcast episodes that if you and your soon to be ex partner can reach agreements in relation to your children, it may be that you never actually need to have any Children Act proceedings.
