Send Us a Message (include your contact info if you'd like a reply)We're taking a detour from our planned topic today because we think it's time critical to talk about the implications of eliminating no-fault divorce. Based on this week's election results, as divorce professionals we need to be thinking about, discussing, and preparing for another potential shift in the landscape of divorce.No-fault divorce has been around for decades, but there's been a growing push in some places to repeal it. But what would happen if we eliminated no-fault divorce? How would it change the dynamics of marriages, families, and even the legal system? Well, that's what we're exploring today.Tracy and Debra talk through the potential implications of reinstating fault divorce including the impact on conflict, cost, our court systems and children. The debate is complex, and there are no easy answers. But it's important to keep discussing it and to think critically about the consequences—for the individuals and families involved, for you as a divorce professional, and for society as a whole. Susan Guthrie welcomes special guest Marcia Zug, a family law expert and professor, to discuss the move to repeal no-fault divorce laws. As reform proposals emerge across several states, this conversation explores what a shift back to fault-based divorce could mean for individuals, families, and the legal system. Marcia offers insights into the history of no-fault divorce, the forces behind this legislative push, and the potential impacts on personal freedom, safety, and family dynamics. Tune in for an eye-opening look at the fight to preserve no-fault divorce and the disastrous implications for your rights and future. Featured Topics: Understanding the difference between fault divorce and no-fault divorce and what each requires The origins of no-fault divorce laws and how California became the first state to pass them in 1969 The impact of repealing no-fault divorce, including its wider social and political implications The future of no-fault divorce, the momentum behind repeal efforts, and whether there are movements to protect or expand these laws Golden nuggets: “If we want more people to get married, I think they need to understand both what marriage does for them and how it might be beneficial, but also not scare them by locking them into a marriage that they could never get out of.” “By forcing people to rehash all of the horrible things that have gone on in the marriage, it brings a lot of animosity to the divorce and makes negotiation and compromises much, much harder.” “ Even though cruelty was grounds for divorce, it wasn't protecting victims of violence in marriages. No-fault was seen as a solution to that. States reluctantly accepted it, not because they liked divorce, but because they recognized that it was needed because divorce to fault grounds was deadly, particularly to women.” **************************************** About this week's special guest: Marcia Zug Marcia Zug is a Family Law professor at the Jospeh F. Rhodesia had a reputation of being "more British than Britain" — and that was its undoing. Instead of giving up the proud aristocratic British tradition that reigned for centuries in England and the United States, Rhodesia held fast to it. And so, in the 1960s, the USSR and America and England conspired to destroy it. And they succeeded. Prosperous free Rhodesia disappeared, and backwards murderous Zimbabwe took its place. It's a fascinating — and very disturbing — story. Will Tanner, co-founder of The American Tribune, also offers his thoughts on Donald Trump, noblesse oblige, and no-fault divorce. I'm chatting with Erin Levine, the founder and CEO of Hello Divorce, about why the push to get rid of no-fault divorce is seriously bad news—especially for women. No-fault divorce has enabled people to leave marriages without having to prove things like abuse or cheating and it makes women safer. The GOP wants to repeal or restrict no-fault divorce. We're here to break down why that's a huge problem. Erin, a lawyer-turned-CEO, has been shaking up the divorce world with Hello Divorce, a platform that makes the whole process smoother, easier, and less stressful. In this episode, we discuss what no-fault divorce is, why it matters, and what could happen if it's taken away. Spoiler alert: it's not good. Featured topics: No-fault divorce: What it is, and how it differs from fault-based divorce (4:55) How no-fault laws help victims leave unsafe marriages (6:55) Why the rollback of no-fault divorce would be disastrous (32:17) What you can do to ensure no-fault divorce protections remain in place (34:16) Learn more about Erin Levine: Erin Levine is not your typical attorney. With over a decade of experience in litigating complex family matters, she saw the need for a kinder, easier and more affordable pathway out of marriage and into the next chapter of life. To achieve this, Erin set out to revolutionize the broken divorce system and founded Hello Divorce, a venture capital backed, tech-enabled platform, that combines self-service online tools with integrated expert advice, making it easier for everyone to navigate their lives and finances with less stress and mess. Erin's innovative approach to the divorce process has earned her media mentions from the legal industry and beyond, with recent features in Vice, Forbes, American Bar Association Journal, Business Insider and TechCrunch. Ultimately, Erin is on a mission to help separating couples empower a better life ahead and has helped thousands of Americans reorganize their lives and families through a framework that levels the playing field between spouses so they can sort things out fairly, avoid missteps and reimagine their next (best) chapter. Whitney Shanahan is a national pro choice advocate and former Democratic Congressional candidate in California. However Whitney grew up conservative Christian in the Bible Belt. She left the Republican Party and her conservative upbringing after Trump won the presidency. While pregnant with her son in 2019 Whitney was questioned about what she had done to cause possible pregnancy complications - while seeking help in the ER. No-fault divorce, or unilateral divorce, became a thing in 1969. Before that, to have a divorce approved by a court one party had to prove the other had committed some kind of fault, like adultery, alcoholism, or desertion. After no-fault divorce passed (initiated by Ronny Reagan of all people), coinciding with more rights for women passed in the '70s, female suicide rates went down! Female homicide rates went down! Wowowow. Making it easier for women to get out of potentially dangerous or abusive partnerships was a good thing all around, but now there are a few states trying to *overturn it* -- which is pretty damn scary.Patreon ~ patreon.com/sadgapMerch ~ sadgap-podcast.com/merchig: @sadgap.podcast / @misandristmemes / @txgothgf / music producer @iamjonnibrooks.eth Source List: https://bit.ly/4dSrL6Y

Right now, couples in all 50 states who want to end their marriage can get what's called a no-fault divorce, where neither side has to prove that the other did something wrong. But some Republican lawmakers in a handful of red states want to get rid of it, saying it's unfair to men and makes divorce "too easy." Law professor Joanna Grossman joins John Yang to discuss. In 1969 California became the first state to adopt no-fault divorce – allowing people to end their marriages without proving spousal wrongdoing. Other states quickly followed suit. For a half-century, couples haven't had to endure protracted legal battles for every split, nor do they need to allege adultery or force their children to go to court, just to get a divorce. Now, some conservative activists – following their attacks on reproductive rights and IVF – are denouncing no-fault divorce, saying it makes splitting up families too easy. Advocates for no-fault say the data show that restricting divorce leads to increased death and injury within families, especially for women and people experiencing domestic violence. We'll talk about the threats to no-fault divorce and analyze the history and future of divorce, in California and nationwide. Guests: Joanna Grossman, Chair in Women and the Law, Southern Methodist University's Dedman School of Law; visiting professor, Stanford Law School

To see our latest episodes, head to the YouTube link below. ***Also, for those of you on Spotify, there are videos attached to these episodes!*** So you should be able to watch the video as well. THE right-wing podcaster, is getting a divorce. “No, this was not my choice,” Crowder told his online audience last week. “My then-wife decided that she didn't want to be married anymore — and in the state of Texas, that is completely permitted.” Crowder's emphasis on “the state of Texas” makes it sound like the Lone Star State is an outlier, but all 50 states and the District of Columbia have no-fault divorce laws on the books — laws that allow either party to walk away from an unhappy marriage without having to prove abuse, infidelity, or other misconduct in court. It was a hard-fought journey to get there. It took more than four decades to end fault-based divorce in America: California was the first state to eliminate it, in 1969; New York didn't come around until 2010. (And there are caveats: Mississippi and South Dakota still only allow no-fault divorce if both parties agree to dissolve the marriage, for example.) Researchers who tracked the emergence of no-fault divorce laws state by state over that period found that reform led to dramatic drops in the rates of female suicide and domestic violence, as well as decreases in spousal homicide of women. The decreases, one researcher explained, were “not just because abused women (and men) could more easily divorce their abusers, but also because potential abusers knew that they were more likely to be left.” Follow - The Left Wing: YOUTUBE: https://www.youtube.com/@TheLeftWingPod Follow - Counterpoint Politics: INSTAGRAM: https://www.instagram.com/counterpoint_politics/ Follow - Cocktails & Capitalism: INSTAGRAM: https://www.instagram.com/cocktailsandcapitalism/ Follow - Independent Thought: INSTAGRAM: https://www.instagram.com/independentthought/?hl=en

This week on Divorce & Beyond, Susan Guthrie, Esq, welcomes Rosemarie Ferrante to discuss what a “no-fault divorce” means and why it's a good thing! Topics and Golden Nuggets include: The benefits of no-fault divorce include the ability to de-escalate conflict. In this episode, Alex starts by going over a recent rant from the right-wing podcaster Steven Crowder. Crowder seems to imply that he does not support no-fault divorce laws and Alex worries that no-fault laws may be the next target in the right's culture war. Next, Alex looks into a recent drone attack that occurred outside the Kremlin. Russia has blamed the United States and Ukraine, it also is now looking to escalate the conflict and wants to eliminate the Kyiv government. Alex argues that this was likely a false flag event and gives reasons why Russia would do this. Finally, Alex looks into a recent trend of regional bank failures and discusses whether this is a worrying trend or just a phenomenon happening to a few outliers. Also, as the debt ceiling crisis looms, Alex worries that the Democrats and Republicans are playing with fire.
The Squiz team is on a long weekend so we thought we'd pop ‘How Far We've Come' into the Shortcuts feed for any long road trips or lazy mornings you may have planned. It's a 6-part series that looks at some key moments for women on the path to financial equality and aims to give women the tools to lock down their financial freedom. In episode 4, we're diving into one of the watershed moments in family law. Unless you can ‘unconsciously uncouple' like Gwyneth Paltrow and Chris Martin, splitting up isn't easy… It's also something that many go through, and a factor in why women over 55yo are the fastest-growing demographic when it comes to homelessness. In this episode, we'll talk about no-fault divorce and what it means for women's financial independence today. A special thanks to our podcast partner on this series, NGS Super. Find out more about them here.
Part 4 of How Far We've Come, a 6-part dive into the history of women's financial freedom and independence in Australia. In this episode, we rewind to 1975 and the introduction of no-fault divorce in 1975. It was groundbreaking legislation that allowed couples to split without pointing fingers and a total game-changer for those in unhappy/downright abusive relationships. A special thanks to our podcast partner on this series, NGS Super. Find out more about them here.
