Modern UFO investigation did not begin with the AATIP, but instead goes back to Project SIGN, GRUDGE, and BLUEBOOK starting in the late 1940s. Recent reports from the U.S. military and pentagon date back to at least the second World War with incredible detail about “discs” even before Kenneth Arnold accidentally coined the term “flying saucer” in June, 1947, after witnessing UFOs near Mount Rainier. Even Roswell was pre-dated by Arnold's experience, and his was pre-dated by Maury Island three days before in Washington State. All of the incidences took place in the Pacific Northwest, just west of Arnold's home in Boise, Idaho, a state that today has the highest per-capita rating of UFO sightings. Knowing that these objects have traditionally been attracted to National Labs during the Manhattan Project, nuclear missile silos, and ICBM tests, it makes sense that Idaho would be home to much lore considering that it is also home to the Idaho National Laboratory which built the first nuclear power generator, powered the first city with nuclear power, and experimented with new nuclear technologies. Now the INL has been contracted to build micro-reactors for space travel called MARVEL, which shares a synchro-mystical connection to comic book movies dealign with multi-dimensional travel - the very realm many believe the UFO originated. In parallel is the Oak Ridge National Laboratory publicly working on breaking into the ‘mirror-verse' while building an ion-accelerator to conduct similar research to CERN.

This week on Legally Speaking with Michael Mulligan:An appeal in a criminal case does not involve asking the judges hearing the appeal to retry the case. It's a review of what took place at the original trial.The Court of Appeal can allow an appeal if the verdict at trial was unreasonable and not supported by the evidence, if there was a wrong decision made by a trial judge on a question of law, or if there was a miscarriage of justice. When a trial is decided by a judge without a jury, the trial judge would provide detailed reasons explaining how they arrived at their decision. That permits a review of the legal analysis when there is an appeal. Where, however, there is an appeal from a jury verdict, there are no reasons for judgment so appeals will focus on legal rulings the trial judge made during the trial and the instructions they gave to the jury. One of the things that juries are commonly told is that they should follow the trial judge's instructions with respect to the law because, if the judge makes a mistake with respect to the law, that can be reviewed on an appeal.  Even when the Court of Appeal determines that a trial judge made a wrong decision on a question of law, a new trial may not be ordered if the mistake could not have impacted the outcome of the trial. The language used when there is such a finding is that there was “no substantial wrong or miscarriage of justice”.In the appeal of the Andrew Berry murder conviction, which is discussed on the show, the defence argued that the judge made several legal errors concerning the admissibility of evidence. The Crown's submissions were that the decisions made by the judge were not mistakes but, if they were, they would not have changed the result of the trial. Also on the show, an application for a ban on publication of evidence provided to the accused during the criminal contempt prosecutions for members of the Rainforest Flying Squad and others is discussed. In criminal cases, the Crown is required to provide disclosure of all the evidence gathered by the police. This is an important requirement to help prevent wrongful convictions. In Canada, there have been several instances of innocent people being convicted because exculpatory evidence was not given to them.When evidence is provided to an accused person or their lawyer it is often referred to as disclosure material. There is a legal requirement called an “implied undertaking” that prohibits the disclosure material from being used for any purpose other than the defence of the criminal case. In the case discussed, one or more of the more than 400 people being prosecuted for criminal contempt failed to keep the disclosure material they received confidential, and it ended up in the hands of journalists. The Crown was successful in applying for an order that the journalists do not publish the contents of the disclosure material unless and until it was used in open court. Finally, on the show, a man convicted of drug offences and sentenced to six years in jail based on evidence from a disgraced former Victoria police officer is discussed. The man was connected to the drugs in question based on a key allegedly found by the former police officer that opened a safe in which the drugs were located. The former police officer claimed that he found the key and put it in his pocket before officers assigned to take photographs of the room where he said he found it did so.   The former police officer was subsequently alleged to have engaged in 13 counts of improper disclosure of information, 3 counts of deceit, 2 counts of discreditable conduct, and 1 count of neglect of duty.Follow this link for the cases discus

I'm Josh Cooperman and this is Convo By Design with a conversation unlike any we have had on the show before. And after 9 years doing this podcast, that's saying something. DISCLOSURE… opinions voiced by guests appearing on this episode are their own and not necessarily the views of Convo By Design or the host of this podcast.  I was reading an article recently about another Los Angeles mansion on the slow march to its demise. This one is in Beverly Hills, as many of them are and it's the same story. Someone with more money than almost everyone else comes in and buys a property for which he has other intentions than living in it, as is. I read this article on dirt.com, and this property sits on North Roxbury Drive and Lexington Road. The Hollywood Regency-style residence was designed by architect, Carleton L. Burgess. Let's stop here for a moment. What makes “significant”, or “special or, more to the point, worth saving? Serious question and one that is really hard to answer for a number of reasons, not the least of which is the rights of a property owner. They worked for the money, or inherited it, whatever, it's their money. Can they not buy and do with it what they wish. Well, yes, unless there are regulations that prohibit it. This Burgess residence lies within the city of Beverly Hills and unfortunately, Beverly Hills was extremely late to the preservation party and because of that, many architectural gems have been wiped clean, again… being honest here, is an LA tradition and every architect since the 1940's knew that going in. Now, in 2012, the City of Beverly Hills discussed ideas around architectural preservation at a city council meeting. In that meeting, they reviewed a list of significant Beverly Hills architects, calling it “A list of local master architects” and the list included 150 such designers. This list was part of a recent requirement to an ordinance that the city adopted to begin preserving properties it deemed “significant”.  It's important to note that at the time, the city was also compiling a list of original architects for more than 2,900 structures. Using their own mathematical formula, they determined that there would be under 500 structures that would be awarded with a historically significant designation.  Interestingly enough, the time for significant architecture in the city was crafted by those working in Beverly Hills prior to 1970. Fair enough. The city had a pretty solid plan. The list would be used as criteria for preservation designation and designation as a “local historical landmark.” An interesting note, the criteria verbiage states, “Represents a notable work a person included on the city's list of Master Architects or possesses high artistic or aesthetic value.” Now, that last part is tricky. “Aesthetic value” to whom? And then it get's even MORE fascinating with some very specific criteria that includes according to BHMC 10-3-3212:(1) A. The property meets two of the following criteria: B. The property retains integrity from its Period of Significance. C. The property has historic value. 1. Is identified with important events in the main currents of national, state, or local history, or directly exemplifies or manifests significant contributions to the broad social, political, cultural, economic, recreational, or architectural history of the nation, state, city or community; 2. Is directly associated with the lives of significant persons important to the national, state, city or local history; 3. Embodies the distinct characteristics of a style, type, period, or method of construction; 4. Represents a notable work of a person included on the City's List of Master Architects or possesses high artistic or aesthetic value; 5. Has yielded or has the potential to yield, information in the prehistory or history of the nation, state, city or community; 6. Is listed or has been formally determined eligible by the National ...
