there is a scam going on around Frederick County Authorities say they've received calls over the past few days from citizens who say a representative from the Sheriff's Office had called, using the name of an actual member of the Sheriff's Office. That person advises them there is an active subpoena, and it can be resolved by paying a certain amount of cash. The Sheriff's Office says the phone number is an online-based number that cannot be tracked. If a citizen calls back, a person answers “Frederick County Sheriff's Department Warrant Division.” Officials with the actual Frederick County Sheriff's Office say this is a scam. They say the Sheriff's Office and other law enforcement agencies will never ask for money or restitution to resolve an incident. Residents should know that these scams have a sense of urgency; if you don't take action, something will happen. These scammers also say not to contact family members or friends, or police. The Sheriff's Office say slow down, and think before letting these scammers rush you. Citizens who have received calls that sound suspicious should contact the Sheriff's Office non-emergency number at 301-600-2027, and report what happened.See omnystudio.com/listener for privacy information.

Robert E. Moffit is a senior fellow in Domestic Policy Studies at The Heritage Foundation. Moffit long has specialized in health care and entitlement programs, especially Medicare. He brings to the reform effort his government experience as a senior official of the U.S. Department of Health and Human Services (HHS) and the Office of Personnel Management (OPM) during the Reagan administration. To achieve affordable health care, Moffit has urged policymakers to give Americans more direct control over their health care dollars, to eliminate barriers to personal choice in health care options, and to allow citizens to own private health plans. At the same time, he believes policymakers should limit government intervention in what should be a much freer and far more competitive health care market, and work to restore the traditional doctor-patient relationship. This podcast is provided by Ben Glass and Steve Emmert www.BenGlassReferrals.com - www.Virginia-Appeals.com Granted Appeal Summary Case MICHAEL V. MCCLARY, ET AL. v. SCOTT H. JENKINS, SHERIFF, ET AL. (Record Number 191132) From The Circuit Court of Culpeper County; P. Peatross, Judge. Counsel Vishal Agraharkar, Eden B. Heilman, and Jennifer Safstrom (American Civil Liberties Union Foundation of Virginia) and Casey E. Lucier, Dale G. Mullen, Travis C. Gunn, and Ashley P. Peterson (McGuireWoods LLP) for appellants. Rosalie Fessier (Timberlake, Smith, Thomas & Moses, P.C.) and Bobbi Jo Alexis (Office of the Culpeper County Attorney) for appellee. Assignments of Error The circuit court erred as a matter of law in sustaining Sheriff Jenkins’s demurrer, denying Plaintiffs’ motion for reconsideration, and entering final judgment on Plaintiffs’ Counts I and II because neither the Constitution of Virginia nor the General Assembly has authorized Virginia sheriffs either (A) to contract with the federal government to enforce federal civil immigration law, or (B) to otherwise enforce federal civil immigration law. The circuit court erred as a matter of law in sustaining the Board of Supervisors of Culpeper County’s demurrer, denying Plaintiffs’ motion for reconsideration, and entering final judgment on Plaintiffs’ Count III because neither the Constitution of Virginia nor the General Assembly has authorized localities to appropriate funds to enforce federal civil immigration law. The circuit court erred in denying Plaintiffs’ request for leave to file an amended complaint because courts should liberally grant leave to amend and additional factual pleading would remedy any issues potentially supporting dismissal. http://www.courts.state.va.us/courts/scv/appeals/191132.pdf
